Pity they didn't have a weapon to defend themselves when they were attacked. Like I said, D was very lucky to survive the encounter with MM. If he had not been armed, he might be dead at the hands of a man who took offence at his woman being told she was in a handicapped space.
That is not the legal definition of threat. She was not threatened, and she was not attacked. She says that in her police report. MM was killed because he ATTACKED a man, not because he said something to him. In fact there is no evidence MM and D said a word to each other. Remember MM attacked D from behind without warning. D was very lucky to survive that encounter.

As many as possible. I consider the victim's life to be more important that the attacker's life. In a perfect world, people wouldn't be attacking other people for no good reason. If MM hadn't decided on a cowardly attack from behind, perhaps he would be alive.
What reason can justify a man coming up behind another man and brutally slamming him into the ground. He couldn't have known what the conversation was about since he didn't pause to listen, he just attacked. You can't just attack someone for saying another person is in the handicapped space illegally. The woman admits in her police report that there was no threats or harassment. NO, MM's attack was unreasonable.

And yet again...MM was on a walkway and approached MD from the side. You don't know what MM knew or saw or heard.
What did he hear in the second between exiting the store and attacking D? A reasonable person would be afraid if they were in D's situation. Lying on the concrete after being brutally slammed by someone you didn't know was coming for you. How would you feel if you were in his place? If you just received a blindside slam that took you off your feet and down to the concrete? If you were on the concrete and the person who attacked you was a couple of feet away staring down at you. A person who proved a second ago that he didn't care about your wellbeing. A person larger, younger, and quite capable of beating you to death.
If you "haul your ass up" you have to put your hands upon the ground to get up and therefore you have no way to defend yourself from another attack. You would allow yourself to be beaten?
Of course they checked. If he had been under the influence, it is illegal to carry the gun. You must be sober.
By the way, if you park in a handicapped space illegally, sooner or later someone will tell you what you're doing. You don't get any more inconsiderate than to illegally park in a handicapped space. By the way, it is quite legal for someone to tell you that. It falls under the Freedom of Speech, and it is not an excuse for someone to beat you over. If MM had acted in a reasonable civilized manner, things would be very different.
