I looked at all the cases filed today and that number is not there.

I am seriously wondering if they took it down until they had a chance to arrest him. Seriously. I think with people like us finding these things so fast, they may not have wanted word getting out what was about to happen.

Just a thought and pure speculation on my part. :dunno:

I'm no mary jane expert, but I am pretty sure that a half smoked joint would not qualify as Sell or Manufacture... those things don't multiply themselves in a bowl in the garage right?

They had charges from 2010, and most of feel that the case number would have started with 2010, not 2011. :crazy:

BBM. Is it possible it's just a clerical task -- such as filing? LE could've looked up any past criminal history, saw the drug charges from 1 1/2 years ago and used that as some kind of leverage during yesterday's questioning. I'm kind of assuming any time paperwork's involved, LE has to state why they're looking up old records. The "Other Events" dated today look like they had probable cause to search, then the info was filed after it was looked at.

All speculation on my part.

Could be that whatever it is is being processed as the file no's filed today jump from 2011-CF-016476-A-O to 2011-CF-016496-A-O. The file that was posted was 016494. It's interesting, for sure. Theory - if something came from his interview with LE yesterday, and they thought to issue a warrant on him (Dale Sr.) for probable cause - and it WAS filed today - and showing on the public records site - afterthought may have had them remove it so it wasn't yet public, per se? Then again, that theory still doesn't support why that type of filing would include the drug charges from last year that do not even show up on the records - see? there would be a 2010 case showing on the records. It's convoluted no matter how I try to spin this one.

Honestly. I HAVE to quit even trying to follow fast-breaking stuff when at work! I had to go notarize 2 docs and meet w/ an opposing atty about a settlement agreement for a few minutes... And this.

Nevermind. :doh:

Seriously, somebody just :slap: me when they see me here when I am supposed to be working.



At the very least just ignore my way-too-late musings. :ignore:

Those were the ones posted from today, but that no one can find on the OCC site now.

I can't find any drug charges for Dale Smith, Dale W. Smith or Dale Wayne Smith for 2010 or any year for that matter, at least on OC website.

Someone, please check my work for me. :crazy:

I know I was on the website within a minute of seeing the original post of these charges because I went "what"? Not possible to have a 2011 year for a 2010 criminal charges.

Okay these are NOT drug charges but I did find the orginal judgement against Dale Wayne Smith (Sr) on the OC Comptroller Site.

Any idea why these charges that Sr spent 60 days in jail for were not recorded on the Orange County Clerks site??? Anyone?

I've checked Patty, and I don't see any either.

Can you look at my post above and tell why you think these charges that lead to a judgement against Sr are not found on the OC Clerk site?

Anyone else thinking DSSR might be the one responsible for Michelle's disappearance? Not saying this because of the court records but rather because of the close proximity of his house, the area where the phone was powered off and the location where the phone was found. Looking at the map I believe Michelle is either in Lake Conway or Lake Jessamine. I'm so sorry for her family, the reality that their daughter is most likely not coming home must be devastating.

The case number should read 2010 as this is when this offense happened. It is odd to have a 2011 case number for something that happened the year before. At least, I have not seen it that way.

Not necessarily. If he was caught by the police in 2010 the SA's office has until the statute of limitations runs in which to file their charges. The case number is dated the day they file a criminal "information" document. For this case it looks like they had 5 years for the felony and 2 years for the misdemeanors. Here is where I got the statute of limitations information:

I am not sure why the Information document showed up and then disappeared unless they sealed it immediately after filing it. Maybe the Clerk's office posted it and then realized they weren't supposed to and then they pulled it. I hunted for the case number too and it isn't there although there are some numbers before and after it present. The numbers should be consecutive. I think if this is in fact Dale Sr, OPD is trying to put some pressure on him because they think he knows something about Michelle.

I'm just supposin' here. Can't explain the entry suddenly disappearing but let's say it was indeed there.

Remember, I'm just supposin' here:

Supposin' when this case started or at some point, another LE goes to the LE handling this case and says something like, "You know, his Dad (DSSR) was involved in another case I was working, but we were only interested in some one else and decided not to move on him." So they go back and review what all they had from the previous case in 2010 and decide there is enough (probable cause) to go forward with charges now, and do so, maybe to gain some leverage with DSSR.

The case would then have a 12/08/2011 date and sequential case number.
