It's Showtime...

I think her Defence could use the fact that SB has chosen to testify as legit proof that she's not right in the head.

If she takes the stand to testify she can be held in contempt or have her entire testimony scrapped if she refuses to answer questions or answers dishonestly.
I already hold her voice in contempt for my ears.

Owens hopes to waste some time before SB can testify
He would like to confuse the judge and prosecution team and bore everyone to death it would seem.

Geez, now Owens wants time for he and Sarah to test out the zipper.

And now Owens also wants permission to bring up past acts first... or something. He's strategizing on the fly.

I fear the judge will have to read Sarah her testifying rights again.

Owens needs more time. Inspect the suitcase, play around with it. Take the bat out. Enter photos into the record.

State is angry. Says the Defense has not asked for a second viewing of the evidence.

Judge, not happy.

Defense wants 15 minutes, then offers, let's take an early lunch....

Owens is on a serious time wasting mission now. Clearly he is terrified of SB testifying...

Good grief!

Take an early lunch??? Really???
Omg.
Defense is giving me a migraine.
IMO.

The judge is really not impressed.

Are the defense attys getting paid by the hour.....it would seem so as they are making sure to drag this trial out even against the judge's wishes. Giving the ole "I've been busy excuse". Laughable. JMO

Owens also wanted to refer back to a previous motion where he asked for SB's testimony to be done 'in camera' which means off public viewing and in private. So we would never get to see it. Judge said he is not reverting back to that previous discussion.

They want an early lunch before she takes the stand. And they have witnesses for tomorrow and Thursday scheduled? Thought this was going to be faster. MOO

Realistically all SB has left is to try and garner sympathy from a juror who remains admanent.
How can Owens get away with stating that he has to converse with SB because he hasn't yet had the chance?

Time to give her to change her mind?
Can she do that now?

They're not actually getting paid anything. SB has an agreement with Owens that is not being funded by the state and she isn't paying him and he isn't pro-bono (ie working guaranteed on the successful outcome). 'Sarah owes me' are the exact words he used.

I was making a joke about them getting paid more. My humor makes me laugh but not everybody else........

Can she do that now?

Yes, per the Judges instructions when he read the small print, SB can change her mind about testifying between now and the moment she actually testifies. She always maintains the right to silence, that is her legal right and can never be taken from her.

However, once she takes the stand, she cannot refuse to answer any questions, she cannot pick and choose which questions to answer, and if in answering questions it is proven she has given untrue or conflicting answers, this can be used against her to strike her entire testimony (unreliable witness / proven liar).

Judge says Sarah has right up until the jury is seated to change her mind.
