Well, my Worry Nerve is working, as it always does...
IF the jury believes JG about the drinks he had, he would have prolly not been inebriated. He is a big man; he had a meal; and the drinking was done within several hours, not rapidly in a short time. So, if they believe him and the people who testified that he did not seem "loaded," he may get away with the DUI.
The one thing that does not fit his story for me, however, is the time that elapsed between the time he left the Player's Club (~12:45am) and the time he appeared in the trailer occupied by Lisa Pembleton, which was 1:30am. She testified that her clock was correct, and when she was awakened by JG, she immediately looked at her clock which was at the foot of her bed sitting on top of the TV. If the time of the crash was 1:00am (and it was prolly a little later that that, IMO), that does not give JG enuff time, IMO, to orient himself, to wander slowly, I'm sure, down to the gate at Pembleton's (am I recalling her name correctly?), cross the fence, wander around Kampsen's (name spelling?) property, go in, look all over for a phone, and then sit & drink, and then wander back to the trailer by 1:30am. Of course the defense says the clock was wrong, but the time of the phone calls and the 911 call he made are on record. But this does bother me...
The 1st jury, however, did not have a problem convicting him. Is this defense team that much better? In my opinion, no.
