As far as I can tell, none of the other students tried to stop him either, and it certainly looks like there were other students watching.

And it's a disgrace that they didn't. Moreso the 13 year old who had more knowledge of what Treacy was up to, and led him to Josie so he could attack her, watched him attack her, and did nothing to stop him.

Yep BeanE she sure did. Although I've heard that once Treacy started the attack KM walked away and just went home.

Yes, there were other students there - they didn't react fast enough. I saw one interviewed the day of the incident on the news - he said he couldn't believe what he was seeing and once his "brain" kicked in, he ran to get someone but that teacher was already on the way.

Here's another story out of our paper today. God, I remember this day - I heard on the news about the shooting and was standing, with my car keys in hand ready to bolt out the door as my DD was in a public HS here at the time. I remember the fear I felt waiting to hear the name of the school!

FORT LAUDERDALE (CBS4) ― South Florida teen that gunned down a classmate at Dillard High in 2008 is expected to learn her fate Friday. A judge is scheduled to sentence 16-year-old Teah Wimberly.

In December 2009, a jury found Wimberly guilty of second degree murder in the death of 15-year-old Amanda Collette.

Wimberly could be sentenced to anywhere from 25 years to life in prison when she's sentenced.

She was charged as an adult.She had also texted people the night before at this.

Our school district is reeling from all these attacks. The lawsuits alone (justifiably filed by the parents) are costing millions.

I remember seeing Amanda's mom and the pain she was experiencing. It broke my heart. I couldn't imagine getting a phone call like this!

I am guessing if that is true, then even Josie herself didn't take it seriously, or presumably she would have asked for help.

Josie had no real reason to fear him, imo, seeing as how he didnt even know what she looked like. The 13 year old was front and center in id'ing her to him.

When he reached the school, he almost attacked the wrong girl, Lamberti said. Then Treacy met up with the 13-year-old, who directed him to Ratley, going so far as to point out a girl wearing a red shirt and black book bag, and then watched as Treacy beat her, Feeley said.

I am not convinced Josie sent the texts nor read them. We just don't know yet.

I wonder what time they are due in court today?

Never mind. Apparently the next hearing is April 6th. But I thought that was on the permanent gag order.

You are right BeanE - but she didn't stick around. Treacy hit her from behind - knocking her to the ground and then proceeded to smash her head into the curb - then he got up and started kicking her in the head with his steel toed boots. KM saw this - but she had walked away before it was over. She wasn't around when the police got there. LE didn't arrest her until the next day. She was arrested at her house.

Also, I heard yesterday that the SRO wasn't even on campus when the attack took place. It seems the SRO was in the neighborhood investigating a report of rock throwing.

Now, since the judge issued a gag order, we probably won't hear much at all - only the information that will come out in the court appearances.

It seems yesterday they (LE and school authorities) are focusing on the other people that Treacy texted during his 3 mile ride to school. He had texted several telling them what he was going to do and yet nobody reported it. Although this all happened so fast - I don't know what could have been done to stop it before he got there - unless one of the people he texted called 911.

I, too, believe that KM pointed Josie out because she was afraid he would attack her instead - if Josie couldn't be found. I also read yesterday that some of Treacy's "friends" had seen his penchant for anger and violence before, which makes me wonder what his mother was seeing in the home.

I also wonder how "close" Josie was to this KM. The pictures that were released yesterday showing her and Josie together were all taken on the same day. There were only 3 pics and Josie is wearing the same clothes in all three and two of them were taken in a bathroom (probably at the school). So, if all KM's family has are those 3 pictures, taken on the same day, doesn't really show me a "BFF" relationship. I haven't heard if Josie or KM ever spent time together outside of school or were ever at each other's home.


No word on Josie's condition today.

Judge gags lawyers and BSO in Deerfield Beach beating case

Lawyers and the Broward Sheriff's Office have been barred, for now, from talking publicly about the case against Wayne Treacy, the Deerfield Beach High School student accused of trying to kill a girl over an insensitive text message.

Broward Circuit Judge Elijah Williams issued a temporary order stopping prosecutors, the Broward Sheriff's Office, defense lawyers and a civil attorney from releasing details about the allegations against Treacy, 15, who is in a juvenile detention center facing an attempted murder charge.

Treacy's lawyer, Assistant Public Defender Betsy Benson, is seeking a permanent gag order after seeing "repeated, chronic and in-depth national and local coverage" of the case, which has been featured on NBC's "Today" show and CNN's "Larry King Live."

A hearing on Benson's request is scheduled for April 6.

In her motion, Benson expressed concern that too much potential evidence in the case has been made public, threatening Treacy's right to a fair trial. She specifically mentioned text messages allegedly sent by Treacy before and after the assault as well as photographs of the victim, Josie Lou Ratley, 15, a Deerfield Beach Middle School student who has been in a medically induced coma for more than a week.

"Wayne Treacy's due process rights will be fundamentally compromised," Benson wrote in her motion. She said the released information would taint a jury pool and foster a "lynch mob type mentality in the community" against her client.

Yep...I worried when the family's attorney released the hospital photos that the defense would jump on that. Other than that consequence, though, I'm really glad he did, because (as others have said here) they can be used to teach kids what happens when you don't express strong feelings in a healthy way.

Would not surprise me in the least although there are no documented reports on it. He obviously had a propensity for violence which in my opinion has nothing to do with his brother's suicide.

There has been some discussion here about the reported text message the perp sent to Josie's phone that he was going to "snap her neck". Whether she ever saw it or not is not known. But, if she had, and had sought out the help of a teacher or security officer I doubt anything much would have happened to stop the perp from carrying out his threat at a later time. I fully believe that if the assault had been thwarted that day, he would have carried out his threat whenever the opportunity arose. JMHO, but nothing was going to stop this perp, nothing. Sick, sick world - and his mother and stepfather looked so shocked at the initial hearing - how did they think he ever learned much in the way of acceptable behavior if both of the (as has been posted, so forgive me if I am wrong) had both been busy with their own struggles with the law????

99.9% of the time thats what cowards do. And KM watched part of the brutal attack. No doubt in my mind if he had a gun, there would have been a massacre at the school.

ITA it is obvious this kid has a lot of anger. The suicide of his brother, and finding the body, just two days before his birthday. Parents who have multiple brushes with the law, sounds like he wasn't exactly being given the coping tools, just plenty of things to make him PO'd at the world.

Not making excuses by any means, but just stating the obvious. We as a society and as members of humanity need to start showing kids how to respect themselves and others. A major part of what is wrong with some kids nowadays is that they are being given none of the needed skills to grow up and become valued citizens of the world.

That's what I'm hearing around town - it was never reported that way though.

It was said yesterday that they have him on suicide watch. HA! Not likely. This coward doesn't have the strength to pull off a suicide - nor would he do it to himself. Remember - he attacks girls - that's cowardly.

The noon news said that Teah Wimberly got 25 years (which was the minimum) - so she'll be 42 when she gets out - that's IF she does the entire time.
Teah took a gun to school and shot Amanda in a closed school hallway. Plus, she confessed.

Now, with that, what do you think Treacy will get? He didn't kill Josie - just attempted.

THINGS HAVE TO CHANGE!!!!

there was no jury, no trial - she confessed and pled out. It ended up with a manslaughter conviction.

As for Treacy and murder charges - I truly don't know what to pray for:

For God to make her whole again and survive or for God to take her in his arms. Quality of life means a whole lot to me and if Josie ends up bed-ridden with little in the way of conscienciousness - is that really a life?

I know Swag. God knows I am having these same thoughts myself. I am just praying for a miracle or mercy.

She has developed a fever today.
