nah, he's got the same right to show his arse that we all have, lol. In light of all that LE have based on the charging documents this motion to get SW's records won't fly. I feel much better about those odds now.

These people are falling like dominos. No stopping that now.

Hickory, I don't think there's a 10 day thing. I've never heard of that, and that would go completely against the spirit of the law - the prosecutor has to share what they have with the defense. The prosecutor is expected to share information with the defense, and not withhold. Right now in Austin there is a huge case where the prosecutor withheld information from the defense and sent a man away for decades who was innocent.

You would have an automatic delay of trial at the ten day mark if the defense didn't have what they needed until then.

The information the prosecutor has, should go to the defense as soon as they are able to share it, from what I understand. That's just a rule of discovery.

It is my understanding the prosecutor doesn't have to release all evidence until 10 days before trial. Does anyone know this for a fact?
I caught this in an article earlier this week:

One of Elkins’ lawyers, Assistant Public Defender Jonathan Lockwood, pressed Barton to schedule a preliminary hearing in which the district attorney would present evidence in the case. Although the hearings are intended to determine whether there is evidence to support the charges, defense lawyers often use them as early discovery.
Because District Attorney Jackie Johnson’s office is taking Good Friday off, the next possible date for a preliminary hearing would be April 4, Barton said.

I agree that they are all going down or at least that is what should happen,and I know his comments are borderline silly,but he reminds me of another attorney from another case.JB

My thinking is that the DA is not rushing to decide on how to proceed against DL because she can sit on her evidence a bit longer as LE continues to investigate. DE and DL are linked even though not represented together. Evidence against one is tied to the other.

Mr. Gough has filed motion for speedy trial in an attempt to hasten that discovery coming to him.

We are into trial tactics now, from both sides.

Buckle up.

I wonder if any information will come out about the other two males in the first robbery attempt of the male over his wallet.
I noticed that DE was the only one named in the indictment with no mention of the 15 yr old in that case.
Could be that the victim couldn't ID anyone other than DE or we may have two more culprits that may turn up later in this case...maybe.
Still curious about the fast getaway from the scene.Not sure if it was only a relative of the 15 yr old providing them with a ride.

I did notice that. Was going to mention it but got caught up in reading the grand jury indictment and forgot to. I think that there will be lots of help in the both the DAs and the PDs depts. The DA and Gough will be the main players and the ones that are lead attorneys, but many ADAa and APDs will help build the cases for each department.

I wonder if DE and DL will be tried together.

Each side will probably try to say the other was the shooter so I'm thinking they won't be tried together.
They may have DL testify against DE for a reduced sentence.

I lived in warner robins for awhile. 3 years when I was stateside. Man, I don't miss that place. Walmart was my favorite spot.

I think this incident (on March 11) is why the Police Chief has been waffling on his statements about gang activity. Plus the fact that law enforcement executed more search warrants on Tuesday.

As for "other charges" or others being charged - here's a thought to chew on. The ballistics of the gun. Obviously LE linked it to the earlier robbery (had the bullet from the guy's arm) and they have the bullet from Antonio. BUT, what if, they have some unsolved shooting cases and they are now comparing those ballistics to this gun?

I know I sound like a broken record - but I really don't think there will be a trial on this one. Nope. DL rolled on DE very early on. He's singing like a canary - and probably on quite a few others (and other crimes) as well. After Gough sees all they have - there will be a deal struck - DE pleads guilty for XXXXXX amount of time. DL's sentence will be decided on his cooperation.

Gough filed for speedy trial because he wants to know what they have. And they have it - ALL of it. I would really like to know if they have any video - that we've gotten wind of the other day. Gough won't want to risk his "record" on taking this to trial - he'll deal with the DA. DE and DL will be sentenced by a judge and sent away. Now mom, sis, and aunt - they just might go to trial - but Gough isn't defending them.

Apparently, the indictment of DE made a preliminary hearing unnecessary so Mr. Gough won't get a chance at early discovery.
Kevin Gough, a public defender representing Elkins, said he felt prosecutors rushed to indict his client before collecting all available evidence. Gough had asked a judge for a preliminary hearing next week to determine if prosecutors had sufficient evidence to charge Elkins. The indictment means a grand jury has already made that determination and Elkins' attorneys won't get an early look at the evidence against him.

"It's a major setback in the sense we would like to have an opportunity to test the strength of the evidence against our client," Gough said.

With the intelligence level of some of the characters in this case I wouldn't be surprised if we find there was another person there/involved/driving and he/she recorded the entire crime and posted it to YouTube. :doh:

You know, they do have quite a few unsolved shootings and rewards offered for information lately. I wouldn't be surprised if they do link up some more.
