I would think that the statistician would have to break down those percentages by age. How many are 18 years old and could serve as a juror? How many are children and not qualified to serve. For all we know, the African American percent of 23% could be mainly children under the age of 18.

Georgia jurors are selected randomly from the rolls of registered voters.

That automatically makes a minimum age, excludes convicted felons, etc.

If the Judge allows the alternates to be regular jurors, IMO our entire judicial system is in jeopardy.

I can't believe this defense attorney actually thought this would happen, but as we know, they will try anything. Also, they want any appeal issues they can get.
I can't imagine any judge would have ok'd this request. This issue is raised all the time and it is addressed on appeal. jmo :seeya:

There are 12 jurors with three alternates. In all, nine men and six women, all of whom are white except two black women, who are alternates.

This follows two failed attempts by defense to get a new jury pool. The defense claimed the jury pool was racially imbalanced. Superior Court Judge Stephen Kelley found no evidence of that and the trial was moving toward opening statements Tuesday afternoon.

Seems ridiculous that media picks up on every crackhead entertainer's broken fingernail, but this story & this trial is not newsworthy.

Is this case not getting much attention over in the States then? I'm surprised, given that it involves two juveniles who are accused of killing a baby, I would have thought that was unusual enough to be newsworthy.

During her opening statement, prosecutor Jackie Johnson said her evidence will prove that DeMarquise Elkins not only shot and killed 13-month-old Antonio Santiago and wounded his mother, but that he also shot a man ten days earlier in a similar armed robbery.


But in his opening statement, defense attorney Jonathan Lockwood claimed other evidence will prove that accomplice Lang is a liar.

He also suggested the dead toddler's parents may have had something to do with their child's violent death instead of his client.

IMO. Of course she did. The poor lady didn't have any money to bury her dead baby!!!

Also from that article the jurors do not know which 3 are alternates. In trials where I have been in the courtroom, the jurors always knew who was an alternate. Here is a copy/paste from the article:

"Even so, Judge Kelley again refused the defense request challenging the jury makeup.

Just after lunch he swore in 12 jurors and three alternates.

The jury makeup is 9 white males, 4 white females and 2 black females.

The jurors will not know which of them are the 3 alternates until they begin deliberations."
