Does anyone know anything about the judge in this case, ie is he reversed often by the court of appeals? He seems to have made some questionable rulings, allowing the gun parade when the video of him saying he wasn't a gun person plus a listing of the guns he owned or a picture even would have sufficed.

Not to mention if he follows through and allows the testimony of a doctor overhearing him call a fellow doctor 'boy' - can't help but wonder how the State is going to use that bit, do they have a video of him saying how 'color blind' he is? Surely they aren't just going to throw that out there since it seems to have zero to do with the charges against him.

There's probably an expert out there who can testify to the fact that grieving men benefit greatly from on-demand massage, [emoji870][emoji870]especially if administered in-situ [emoji933]and as unsettling events are unfolding [emoji603] (not at a later date, when society deems it be more appropriate).

He needed her services more than ever, hence the unusual setup. She probably started off on the floor, but drafts kept her awake, so she decamped in favor of comforters. There's always a reasonable, logical, innocent, and research-based explanation [emoji72]for these seemingly unseemly things, people! Must we always be so cynical? [emoji6]

I have wondered the same geevee. I have found some of his rulings questionable...not to mention his demeanor in the courtroom.

I couldn't think of why this judge reminded me of someone???? :thinking:

He looks like he could be a brother/relative of those HGTV Property Brothers- Drew and Jonathan Scott:

This judge seems to be a very personable judge, IMO- very involved in the trial/with the jurors, and a, sort of, folksy, down-to-Earth, type of person (if you know what I mean). Maybe that's just his style? Might tend to make all involved more at ease- especially the jurors.

I don't think allowing the carting in all those guns to court by the prosecutor could hurt- seeing them in person would make a bigger impression to the jurors than seeing a pic of them, IMO. What could the defense say- no? Tex owned all the guns and there were lots of them.... I think the more tangible things shown in court for the jurors to see to somehow help them make a decision, one-way-or-another, is a good thing.

Clearly the McIvers had a different lifestyle...in all respects but really unless the state is going to a specific motive (Tex and Janie or Tex and Annie) and has solid evidence of that motive none of this is worth anything other than contributing to the script of the made for TV movie.

well tomorrow we are back at it...enjoyed the week off to get caught up and will have to use archives much this week. But you can bet there will be some motions and other things happening first thing tomorrow as a result of this long break...and million $$ question will 61 be back and be on time ? And have there been any jury issues during the past week? All 61 needs to do is ask to talk to judge and come in and indicate that she saw extensive coverage over the break...could not avoid it and I think he has to let her off. I think she wants off but not sure...and on the other hand my guess is she is the one asking lots of questions. Will anyone call Annie? I don't think so...bad for both sides. But they can stipulate she is the masseuse and wearing the boots!!

McBurney would love nothing more than to make an example of juror 61 shirking civic duty.

Like sand through the hourglass, these are the days of our lives...

I am sure the Lifetime Network is already hiring the scriptwriters and thinking about casting lol.

*Trial continues (Day 15) (@ 9am ET) - GA - Diane McIver (63) (Sept. 25, 2016) - Claud "Tex" Lee McIver III (74/now 76) arrested (12/14/16) charged (4/27/17) with malice murder, felony murder, aggravated assault with a deadly weapon, possession of a firearm in the commission of a felony, and 3 counts of influencing witnesses and bribery. Pled not guilty.
3/30/18: April 9th or 10th Pros will rest and then the Defense will begin.

The Tex McIver murder trial returns from spring break this week. Superior Court Judge Robert McBurney told the jury before the break that prosecutor Clint Rucker still has witnesses to call, and he has already called more than 60.

The judge didn’t sound thrilled.

"Mr. Rucker and his team have helped me understand there are not a whole lot of witnesses left,” McBurney said. “I don’t think there are that many people left in the world.
