Gun Expert Says Trigger Needed to Be Pulled for Shot That Killed Diane McIver

"A firearms expert with the Georgia Bureau of Investigation testified Thursday that the Smith & Wesson .38 revolver Atlanta attorney Claud “Tex” McIver was holding when he fatally shot his wife would not have fired if it was simply resting on his lap.

Zachary Weitzel, a technical director in the GBI’s firearms division, said the gun would not discharge if someone was simply holding it.

“Something would have to act on the trigger,” he said. “The trigger has to be pulled rearward.”..."

I wonder if anyone had a conversation with Tex in which he seemed worried or distressed regarding how much pain Diane must have felt from the gunshot wound. (Other than, perhaps, the two ladies who said he was hysterically crying around them, one of whom spent the night). It must have been horrifically painful. So sad.

There sure are a lot of theatrics and props in this coutroom. Not a bad thing, I just find it more entertaining than it is maybe intended to be. It started with the dollar bill during opening statements and hasn't let up since. Some of the tweeted photos are priceless. MOO

I have said this repeatedly this is the most unsad murder trial I have ever watched. Tex actually all upset today frankly looked fake to me.

I wasn’t familiar with this case at all and just started watching with opening statements. As of right now, I believe good ole “Darlin” talking Tex was strapped for cash and ready to capitalize on Diane’s death, whatever the consequences were. He thought he had planned the perfect murder ... imo ... and it would have been if he had just acted right. But IMO, he screwed up with his actions both before and afterwards. It’s all coming out now and I think he’s guilty. I want to hear from the masousse. And Janie. I hope the state brings them both to testify. Thanks YesOrNo for the updates. I couldn’t watch today so you are a life saver. As of right now ... if I’m on the jury ... guilty. Perhaps the defense will change my mind. I doubt it but we’ll see.:thinking:

sickening...has it come up yet about the codicil or such that Tex had signed but Diane had NOT , in regards to Diane's 1/2 of estate to go to her godson?
I have said this repeatedly this is the most unsad murder trial I have ever watched. Tex actually all upset today frankly looked fake to me.

sale of her personal items and not to mention the 350 k loan wont have to be repayed, so there's that.....He may not need as much to run ANYthing with her dead....he's selling the condo right? Also, trying to draw her SS???AND if he downsizes, he'll be fine and he had planned to retire end of 2014 but had that 300k loan he had to repay Diane so kept so kept working, retired as soon as she died, or let go anyway...
Financial expert lays out Tex McIver's financial situation during murder trial

"...The defense pointed out that Diane’s response was light-hearted. They added that McIver needed Diane to live so his finances wouldn’t get worse.

“If he doesn’t have access to cash that’s in Diane’s estate, his cash flow problems were not as bad before Diane died because she was giving him money every month.”

But the state said that’s not the case. McIver collected a $600,000 life insurance policy of Diane’s, along with close to $300,000 from her 401k.

McIver had a $1 million retirement plan, but the financial expert testified that based on his cost of running the ranch that money would have only lasted him two years."
