Smith admits he never went into the ER to see if #TexMcIver was there. "I was under the impression they'd left already." Didn't interview Tex for two more days.

Detective: Masseuse Accompanied Tex McIver to Police Interview
Annie Anderson, a massage therapist and friend of Tex and Diane McIver, has surfaced in testimony by four witnesses as being in Tex McIver's company in the immediate aftermath of his wife's fatal shooting.

"When Atlanta attorney Claud “Tex” McIver appeared at the Atlanta Police Department to talk about how he had fatally shot his wife, he brought two attorneys and his massage therapist with him, a homicide detective testified Friday.

Darrin Smith, the lead homicide detective who investigated Diane McIver’s shooting death, said he began trying to interview McIver early on Sept. 26, 2016—just hours after Diane McIver died at Emory University Hospital.

When McIver arrived at the Atlanta Police Department shortly after 1:30 p.m. on Sept. 28, 2016, to talk for the first time, he brought along criminal defense attorneys Stephen Maples and Calvin Leipold, and masseuse Annie Anderson, Smith said...."

Oh and at the end of the day today after the jurors had left I could not believe my ears....Rucker is considering asking for a "field trip" to view the SUV!!!!!!!!! Any comments from you sleuthers what value that could possibly have after bringing in that whole interior???? Nothing happened on the exterior of the vehicle. Maybe they could take them down to the exact spot and hope some BLM protestors are around?

Perhaps Rucker wants the jurors to see the back seat and how much arm room there is in relation to Tex's arm space - since there wasn't any pics of the back with the door shut.? They might be able to judge for their selves where the gun was in relation to his lap/arm, etc. and in relation to the front seat and the bullet hole? I don't know- couldn't hurt, IMO.

A big 'thank you' to YESorNO for all of the updates (not only this trial, but for all you have kept up with)!!

I question some of these witnesses that the prosecution has put on. It seems like throw everything out there and see what sticks, but the defense has turned some of these witnesses in my opinion.

Not particularly fond of this judge either.

i think most of the witnesses were on both lists so they just presented their case on cross...the one solid witness that gave nothing to the Tex camp was Billy Corey....but I guess it could be argued that he has a personal vendetta on Tex and not open to any other options.

OH GAWD!!!!....:tantrum:... Harvey is still on, telling his long story monologues to that Det- who doesn't even know when he should say "correct" "right" 40 gazillion times...:gaah:

I'm so glad there will be a week break from this trial and Harvey....or I'll have to go down to Georgia and cut that braid off of Mr. Correct...:okay:

Why can't the defense use those other lawyers who actually ask questions instead of tells stories?????.. Even the reporters don't tweet what Harvey is saying anymore :sheesh:

wonder if during the break Rucker et al will realize they are close to closing and have not proved the case? I am not sure what happened but this is really disappointing. Might as well just shoot for lesser charges and stop unless they have something major which I don't think they do.

Yeah, no slam dunk here.

This *is* similar to the Ross Harris case as mentioned in AJC podcast, but in Ross' case the character assasination did him in. I thought he was guilty anyways but doubt they could have gotten the malicious murder conviction if they had severed the sexting with minors charges.

In this case, the collective evidence presented by all the witnesses indicating collusion in the hospital plus the shifting narrative plus his financial woes plus the fact that she is dead because, oh I don't know... he pulled the trigger? is enough reasonable doubt for me.

The slayer statute only counts for murder not manslaughter, so I get why they went with murder. If he only got charged with manslaughter, which would be a slam dunk, then he would still inherit. I think the witness tampering charges go towards character assasination because it's a purely circumstantial evidence case and they really want to convict him of murder just so he won't get her money. MOO

I still have some catching up to do. Too many cases, too little time.

i find his asking for the gun...expressing extreme concern about the area and then snoozing off again pretty inconsistent. For the sake of argument lets just say he is as stupid as it seems and he did not intend to do this...at minimum he is guilty of reckless endangerment with the firearm (not even sure if this is one of the charges) tampering with witnesses (which I have heard experts say is a weak case?) and frankly insensitivity to the extreme after her death (no charge or penalty). I am concerned the worse he will get here is having to look at his red face in the mirror every day and know that he caused Diane's death and having to fend of Billy Corey who wants revenge on him. And to top it off he may just hook up with Janie Calhoun (as per his exressed desire after Diane's death) and be back at the Villas Condos again. Nothing would surprise me with this group. Janie for whatever reason has been in full "protect the Tex" mode and I have to wonder what is up with that. And as a finale Tex will be the consultant for the Hallmark made for TV movie about life in Buckhead and at the "ranch".
