i believe it was Tex' mother winnie mciver that went...Annie was supposed to stay with her and make sure she was okay...she was 87 or something. Supposedly Annie bought her own ticket and some meals...I think that is a lie...if you are expected to be a caregiver you don't buy your own ticket.

I'm about 1 hour into Annie....I'm not buying this.

First I question her "business" that has no advertising and then every other action of hers just makes no sense. If she runs her own business and has a husband and 2 step kids, why is she spending the night at Tex's condo the night after Diane died, going to Tex's police interview and driving Tex to the Ranch that following week. Doesn't she have work and family matters to attend to? This is how you would react if an immediate family member passed away.

And Diane also gave her a $5K loan to pursue her personal dreams or fix a pool to sell her home?

And Austin slept in the bed with Tex the week following Diane's death? As a parent you don't let your kid sleep in a bed with anyone that is not a parent or grandparent! Especially not someone who everyone thinks is on suicide watch!!! with his masseuses or other random people sleeping on his floor.

And when Annie refers to Austin's brother, she calls him that, "Austin's brother", and incorrectly said it was his younger brother, but he's the older brother (only by about 2 years). Austin's brother's name is Craig, Jr.. Poor Craig Jr. He has a name. Why all this insane attention on the one kid, Austin. This whole story is just so bizarre to me.

IMO I just don't think Annie is telling the truth. Her actions make absolutely no sense at all. And she was being helped financially by DM.

On the line for her is potentially her reputation and business.

As Annie said many times "I am 1000% sure" ...I agree with this analysis...something very off with Annie. She is 1000% creepy...another one on the take from the McIvers...some sort of strange arrangement with them sexual or other...just creepy.

listening to Spencer arguing with judge..I simply cannot believe how the judge interjects himself in this trial and is 1000% (per Annie) for the State.

That was my reaction as well. The "moving his trigger finger reflexively in his sleep" is what pushed me over the edge. It came across (to me anyway) like she was laying it on a bit thick.

I'm skeptical about the whole shoe size thing as well. She's positive Diane was a 7.5, because her feel felt that size? I might believe a shoe salesman could tell a person's shoe size that way, but a masseuse?

She does not have an active license (masseuse) in the state of Georgia. If she wants people to believe she's a legitimate working masseuse, she should at least have an active license.

Annie Anderson says she told the DA’s office that #TexMcIver often fell asleep during massages and would flail or punch. Her rate is $100 per hour. Diane paid for both hers and Tex’s massages. Says Tex “never” asked her to do anything inappropriate.

Friday, April 13th:
*Trial continues (Day 19) (@ 9am ET) - GA - Diane McIver (63) (Sept. 25, 2016) - Claud "Tex" Lee McIver III (74/now 76) arrested (12/14/16) charged (4/27/17) with malice murder, felony murder, aggravated assault with a deadly weapon, possession of a firearm in the commission of a felony, and 1 count of influencing witnesses and bribery. Pled not guilty.
4/10/18: Pros rested their case. Before the Defense started Attorneys arguing about whether the judge should drop charges 5-7 of the #TexMcIver indictment. Those charges deal with influencing witnesses. The judge is taking the motion to dismiss the charges under advisement. If he doesn't have his decision by the morning, he advises he will by lunch.
On Tuesday (4/10/18), McBurney :denied: a defense motion to dismiss malice murder and felony murder charges.
4/11/18 update: Judge Robert McBurney is ruling on the McIver motions for direct acquittals on Counts 5, 6, & 7: Influencing Witnesses on Dani Jo Carter, Bill Crane, and Tom Carter. McBurney:
DENIES Count 5 of the indictment, agreeing that McIver tried to get Dani Jo Carter to lie and asked her to say she wasn't there.
GRANTS Dismissal of Count 6: Influencing Witnesses: Bill Crane - by instructing him to retract a statement.
GRANTS Dismissal of Count 7: Dani Jo's husband - voicemail left tried to influence her to stop talking to police.
Defense expected to rest their case today. Closing arguments are tentatively scheduled for Monday, 4/16.

Oh I could go on and on about Annie, and I'm only 1/2 was through her testimony.

How about the small stack of printed out text messages that she had b/t herself and Diane? She said she had to print them one by one and showed up with them on the stand? Strange to me. As if she was the one in charge of putting them together. No lawyer obtained her phone and printed the full text to be entered into evidence. How do we know what Annie screen printed from her phone was complete and why did she bring it with her on the stand?

And the check written to Annie from Diane was made out to Annie Anderson, not a company name, b/c I don't think there's any legitimate company. She's probably not paying a penny of taxes on all this money she is making for her "massages".

And her husband is a corrective exercise specialist who helped Tex out 2-3 times in Sandy Springs with his golf swing. Again we see Tex and Diane fully integrated with another couple, who are borrowing money from them. Annie went on vacations with them, down to the Ranch, etc. You would have expected Diane to be hobnobbing with other mink clad socialites, but instead all of her "friends" were people she had small loans to (Anne, Dani Jo and Annie so far).

Again this small close knit circle of friends....Annie says her best friend, Carrie, introduced her to the McIvers and Carrie just happened to be in Atlanta visiting the weekend Diane died. She was staying in condo 1402 in the McIvers condo building below the McIvers in the condo owned by Billy Corey.

And Annie has been watching the trial all along, and noone seemed too concerned about that. In fact, she's likely reading this thread right now.......

AND Tex's story is that he accidentally killed Diane b/c of some mumbo jumbo "sleep disorder" in which he's so out of it that he can't be held accountable for KILLING people in his sleep....Prior to Diane dying he claims he was a violent sleeper, kicking, punching, jerking, etc. yet, let's just let Austin, a little boy sleep, in Tex's room the week after the killing....when everyone around him is so concerned about Tex b/c he is on heavy medication and possibly suidical?!?!?!?

I think all of Diane's "friends" were conveniently very close this first week afterwards to see if there was going to be any financial gain in it for them. Perhaps Tex was offering them "deals" for alibis or other support, just as he did with the DA at a later date?

I think where I really gave up is that a very young Austin was "sleeping in Tex' bed" on these nights just after the murder. The Schwalls are highly suspect and sometimes I wonder if they had a hand in this death. Who in their right mind has their son sleeping in this environment with an old man who just shot his wife....others are watching him carefully as he has sleep issues....another in there with see-pap machine...I mean come on what the h.... is going on with this whole group. As previously mentioned Annie has a creep factor of "1000+" and running back to kiss that Dixie was just too much. I don't think he will be convicted but sure makes me wonder what was going on...way too many "couples" handing out with these people getting handouts and this "god child" distorted concept really bugs me.

And thanks to this theatrical judge and his lax ways...the lack of sequestration of the witnesses is really getting on my nerves. They all seem to feel they get a subpoena and can go along and watch everything. No one seems to care. Also while I think the jury seems engaged and smart I have to wonder given the length of trial and all the references in court to the media have none of them seen anything.? I have my doubts.

When I watched Anne Schwall's testimony I was paying more attention and one of the loans lined up around the time of her divorce when she needed to refinance her home, which makes sense. The first loan though was when she was still married, to a pretty successful judge, whom you would think would have made a good enough living that they wouldn't need to be borrowing money from Diane. And Diane was also paying for Austin's Suzuki school tuition....wonder if she paid for the brother's also?

Yes! When Annie first held up her stack of text messages with Diane, she said it was mostly massage scheduling and had a few personal things in there such as Diane inviting her step-daughter, as well as a friend, to Austin's b'day party at the Ranch.

She made it sound like she setting up a preschool playdate, and then we find out the step-daughter wears a size 12 women's shoe! She must be in HS or maybe college? Why is she going to Austin's b'day parties at the Ranch and bringing a friend?

Yes, she's a real estate agent, but I looked her up and her only listing was her own home residence, that she's owned since 2003. It's been on the market for 6 months and price keeps dropping. She must be selling that to move in with her new husband.

Everything and everyone involved in this trial is just strange. I have to admit that that story Annie gave about Diane's shoe size was out in left field...and that whole thing about Austin sleeping in the same bed with the man who just shot his wife threw me for a loop...she lost me there. If the defense puts her back on the stand today, it will backfire on them big time.

There are a fair amount of jury questions after each witness. They could be from several or just from one or two jurors. Waiting to hear what will be discussed in jury instructions as far as the charges, but I question if there may be a hung jury. I hope some of the jurors will talk after the verdict...I'm guessing some will as so many have wanted to get in on the media coverage.

Administrator of the estate was back on the stand. After many questions, sounds like after all bequeaths are made, Tex may end up with $150K, but still owes $350K loan to the estate. He may have to sell the ranch to pay all his legal fees, or to satisfy loan if estate needs the cash?...plus doesn't it cost $20K/month to run?
