Glithero did not get into specifics about his ailment, only saying that in all likelihood, the case would be interrupted if he stayed on as judge.

He also said he wished he could continue, but that it would be in the best interest of everyone involved if he recused himself.

So is there a shortage of sketch artists or none interested in drawing an up to date likeness of the accused in this case? What's up with these media outlets, can't they afford to update their sketch of DM and his now lead legal representative RP? Oh bother, DP isn't even his lawyer any more but CBC keeps publishing that same old sketch. :bored: Doesn't sound like MS's physical appearance has changed over the past two plus years so his old sketch will suffice. The sketch used in today's article is over two years old for Heaven's sake. Perhaps DM would like to see an updated version of himself instead of the same old sketch of himself with his now displaced lawyer. JMO.

Tim Bosma investigator awarded medal of merit
Staff Sgt. Matt Kavanagh receiving award in Quebec City Monday

Hamilton police Staff Sgt. Matt Kavanagh, who was the lead investigator for the Tim Bosma murder investigation, has been awarded the Canadian Order of Merit for a police officer.

Governor General David Johnson is presenting the 31-year police veteran with the award on Monday in Quebec City.

None of his investigations have been more well known than the Tim Bosma case, which attracted international media attention. Hamilton police say the case is the largest in the service's history.

If Goodman is the permanent judge on the case to be heard in January, he will have the option of continuing on with the pretrial motions where Glithero left off, or starting over again.

Only two days of pretrial motions have been heard.

News Release - Staff Sgt Matt Kavanagh receives Canadian Order of Merit

Staff Sergeant Kavanagh is a 31-year veteran of the Service. For 15 of these 31 years, S/Sgt. Kavanagh has been assigned to the Homicide Unit.

One of the Service’s largest investigations in its history was led by S/Sgt. Kavanagh. It was in May 2013, when Tim Bosma was reported missing. This investigation soon developed into a homicide investigation in which D/Sgt. Kavanagh was the Officer in Charge. The investigation caused considerable fear in the community among citizens. The case also attracted international media attention.

Staff Sergeant Kavanagh expertly led the investigation that resulted in the quick arrest of two men and the case is now before the courts. Virtually every member of the Service was directly or indirectly involved in the investigation. An extensive number of tips came in from the community. This was all co-ordinated by S/Sgt. Kavanagh. With the arrests, S/Sgt. Kavanagh and his team restored a sense of calm in the community. This was evident by the 450+ emails sent in by citizens praising his team’s efforts.

As well, S/Sgt. Kavanagh consistently and deftly served as media spokesperson during this extraordinary time for the Service and community. He held a number of news conferences providing updates to the media in his calm, professional manner. There were literally millions of impressions on social media on this investigation.

As well, Matt has been active in the Ontario Homicide Investigators Association. He is involved in setting up user-group meetings on a regular basis so that techniques, investigation and best practices can be shared.

With his extensive investigative experience, Matt regularly is a guest trainer and educator to the following groups: Recruits; Citizens Police College; Auxiliary Officers, and Police Cadets. As well, he is an instructor for Major Case Management, at Ontario Police College.

New Judge in Tim Bosma case

There’s a new judge presiding over a high profile murder case. After 2 days of pre-trial arguments in the Tim Bosma case, Justice Stephen Glithero fell ill and went to hospital. A week later he was back at court, but only to recuse himself. He’s not sure what his medical issue is, he’s undergoing tests, but he doesn’t want to risk another delay. So Justice Andrew Goodman has now taken over the pretrial, and he will also preside over the trial, which is still expected to begin January 18th.

Glithero has overseen some of Hamilton's most complex and highest profile cases in the past two decades, making him the ideal judge for the notorious Bosma trial. He has already spent months dealing with legal matters surrounding the trial.


"I wish I was staying on this case," said Glithero, rising one last time from the bench.


Before he could leave the court, assistant Crown attorney Tony Leitch stood and, on behalf of the Crown team, said "I thank you for your service to this case."


The sentiment was echoed by Thomas Dungey, counsel for accused Mark Smich.


"It was a pleasure serving with you on this case," he said.


Ravin Pillay, lawyer for accused Dellen Millard, nodded in agreement.


A half hour later, Justice Andrew Goodman entered the court and took over where Glithero left off.

Meanwhile, as these developments were unfolding in the Hamilton courthouse, Staff Sgt. Matt Kavanagh of the Hamilton Police Service was in Quebec City to receive the Governor General's Canadian Order of Merit for Police Officers for his work leading the Bosma investigation, possibly the largest criminal probe in Hamilton history.


Kavanagh, who spent 15 years in the homicide unit, oversaw the search for Bosma and the arrests of Millard and Smich.

Wishing Judge Glithero all the best. May there be positive and speedy resolution in regard to his health issue. IMO he seemed to be the perfect judge to preside over TB's case, but I also feel very confident Judge Goodman will do a fantastic job and we will see justice for TB.

I'm curious to learn more about the jury selection process ~ particularly when it comes to a high-profile case such as this one. I can't imagine how on earth it would be possible to find any local citizen who has not already formed an opinion regarding the guilt or innocence of the accused in this case. I suppose that I could be way off base in that thinking, given the fact that I spent a great deal of my time in this forum, particularly in the early months of the investigation. Any insight from our Legal Eagles here?

Jury selection I'd expect to happen about a month before the trial...sometime in November, maybe because of Christmas?

Right now the judge et al. would be working out if there needs to be a change of venue or not.

I don't think the story is as popular as it was a year or two ago, so it may not be as hard as it might seem to find people untouched by the media coverage.

I do wonder if it is appropriate for the police department to be handing out medals before there has even been a conviction. OTOH, if the GG feels there is good enough evidence for a conviction, and wants to award the lead LE investigator a medal, I am sure they think it's in the bag.

It appears that was three phone calls and 2 inmates. One inmate was taken to the hospital twice.

Hamilton EMS got a call at 2:12 p.m. on Saturday about a man in his late 20s showing signs of a suspected drug overdose, said EMS operations commander Ian Wright. They transported him to hospital.

Shortly afterward, at 2:27 p.m., EMS got a call about a man in his 30s also with a suspected drug overdose, whom they also took to hospital. Both men were conscious and in serious but stable condition, Wright said.

Paramedics got a third call around 6 p.m., and returned to the jail to pick up one of the same men who'd been taken to hospital earlier that day. He was in serious condition at that point, Wright said.

Well clearly derogatory is the wrong word to use when MK is being lauded for his achievements in the Bosma case.

Surely the case is the biggest of MK's career, and the case he would be known by, professionally.

I don't at all see how if could be a dishonour, or derogatory, for MK to be honoured for his work on the Bosma case.

This is after all a Governor General awarded medal - surely they don't give such a thing for mere involvement in high school sports.
