Update of March 15, 9:37: A jail insider spoke with the "image" on the impression that Rebecca's brother-in-law Florian R. makes: "The inmate came in shirt and jogging pants quite loose. His look was open and friendly. Not at all like a man who is suspected of manslaughter. "

His lawyer should now have access to the file. She has already filed a complaint against the detention on Wednesday. This is something other than a pure adhesive test. Here it is not an investigating judge who decides whether Florian R. will be dismissed, but the next highest instance - in this case the Berlin district court. When it is decided on the complaint is still unclear. But Florian R. could soon be free again.

Meanwhile, the "Bild" reports on the current whereabouts of the brother-in-law. Florian R. has been in custody for twelve days. According to the 27-year-old to inhabit a twelve-square-foot cell with a bed, a wooden chair and a table. In this part of the detention center accused persons are to land who have to live separately from other inmates. As the newspaper also reports, the lawyer of the suspect has now filed an appeal. When the application is decided is still unclear.

19:01: Still missing from the 15-year-old Rebecca from Berlin every trace. In an interview with Bunte , the family spoke exclusively about the disappearance of the girl. In the interview, mother Brigitte Reusch reports that her daughter met a man on the Internet before she disappeared. In January, the 15-year-old reported a Max or Maxi. Rebecca also said that the man wanted to visit her. Before the meeting, however, the mother had warned her, "I told her that she could not meet him alone."

Then Rebecca had promised to take someone to the meeting. When the 15-year-old then disappeared, the mother immediately had to think of the Internet acquaintance. At the request of Focus Online , a spokesman for the police said, "According to our knowledge, the homicide squad was not aware of this until now." A few hours later, however, the police have told Focus Online that the previous statement was a "misunderstanding" and that nothing should be said about current investigations.

But it is clear: Rebecca's sister Vivien confirmed via Instagram the girl's internet acquaintance."There was an internet connection. The police have been aware of one of them since day one ", reads on the social media channel of the 23-year-olds. At the request of Focus Online , Sister Vivien explains, "We told the police this from the start, and if the police want to complain to us, they should do it directly with us, not the media."

Missing Expert: Police and family have made mistakes
Update from March 13, 1:16 pm : Rebecca from Berlin has been missing for over 20 days. The family searched on their own, published photos and talked to the press about details. Did the police react too late?

Focus.de interviewed the expert Lars Bruhns on the missing person case Rebecca in an interview. Lars Bruhns leads the " Missing Children Initiative ". Initially, his initiative had even made contact with Rebecca's sister Vivian.

Bruhns sees searches of relatives critical. "It happens in many cases that the relatives make themselves on the search. But it can even hamper the investigation and the search, "says Lars Bruhns to focus.de . In his opinion, participants would not be trained forensic technicians.Traces could be blurred.

"There is a danger that such a witness will erase other potentially important clues from his memory because he does not consider them relevant. The police would be interested in getting this information, if possible, "explains Bruhns in the focus interview. In his opinion, the police would have had to control Rebecca's missing-person communication much earlier and go public. AND: It does not help if family and police do not speak with one voice.

According to the BZ , a total of 25 people are currently involved in the search. In addition, the forensics should have taken plaster casts of tire marks. Apparently, the police want to match these with the tire prints of the red Renault Twingo of the suspected brother-in-law. As the picture reports, in the afternoon employees of the Criminal Police took over white protective suits. However, it is still unclear whether this is related to an important find in the Rebecca case. However, the protective suits are often an indication that possible traces should not be contaminated.

Police look for Rebecca at the lake
Update from March 12, 15:58 : As reported by the Berlin courier , officials are looking for the missing Rebecca Reusch. According to a police spokeswoman and the Technical Relief Agency (THW) was also involved. Twelve members of the THW are therefore using special technology in use. Furthermore, a spokeswoman had denied that the police with boats on the Wolziger See looking for Rebecca.

I really really want to know what trace evidence they found that point to murder. Blood is the only thing I can think of. But wouldn't it have to be a large amount, lots of trace evidence all over the place? (Cleaned up of course, but made visible by forensic technicians.)

And what is also odd to me is, if they found evidence that a crime happened in the house why did they have to release him?

If they found blood it would be tested by now I assume.

Just putting some thoughts out ... this case is very confusing.
Do they release information like this in Germany?

This (from your link) stands out for me:

"Apparently, however, no evidence could be found during the search"

I'm curious how circumstantial trace evidence found in the house could be useful. The victim and suspect spent time together at the house. Any trace evidence of them together will be dismissed simply because no one can connect trace evidence with a date. Trace evidence of Rebecca's blanket in the brother-in-law's car might strengthen the case, but not if there was any other instance where the blanket was in the car.

The cell phone log evidence contradicts statements from the brother-in-law. I hope investigators are able to track his movements and determine what happened to Rebecca.
I'm hopeful they have more evidence they have not disclosed which is why they are searching for a body - I cannot understand the family's support of the suspect. JMO

From what I learned it can take up to three days for the detention complaint to be processed and decided. So if the new judge decides there is no, or not enough, evidence to hold him he could be released today or tomorrow.

However, the detention complaint only takes into consideration evidence that led to the first arrest, not what investigators found in the meantime (in the last 12 days since he's been put into U-Haft). It could therefore happen that the detention complaint is decided in his favour but due to new evidence he's arrested again immediately.

The fundamental search of the homicide commission continues, but there was no renewed major search campaign in Brandenburg on Friday. Whether something is planned for the weekend was not known yet, as a police spokeswoman said.

If this insider was quoted correctly by the media, FR doesn't look to me like someone who is worried about being accused and will possibly be convicted of manslaughter. He seems rather relaxed. Is this because he knows he's innocent and trusts that the truth will come out in time, or because he is guilty but knows they will never be able to prove it in court?

There is no trace of the missing Rebecca Reusch from Berlin. But the police still want to find the girl - and now uses a specially trained dog.

The Berlin police continue their search for the missing pupil Rebecca. On Thursday two officials with a special dog to control a certain area, as a police spokesman said. Where exactly this area was, he did not want to communicate for "tactical reasons".

In addition, a police spokesman t-online.de said on Thursday: "However, we can not publish more detailed information on the search with the special dog", the investigative work of the police should be protected. The police continue to assume that Rebecca is already dead, the spokesman continues to t-online.de.

I cannot understand the family's support of the suspect

Well if they believed that he killed her all hope is gone. They have to believe in his innocence to keep hoping she'll be found alive. They probably don't know more than we do. Would you accept your child is dead because of some router data and hairs in the car trunk? I can understand them to some extent, I just find it odd they give all these interviews to the tabloids. They should talk directly with LE and let a spokesperson handle the press, maybe hire a PI. I read they have money. imo moo

Curious - those of you who are familiar with German law. Is it possible / likely to obtain a conviction without a body? If this Max/Maxi did take RR, would they be able to travel freely through EU countries?

As for the other question...conviction without a body always seems tricky, imo.
I did look it up and found this :
List of murder convictions without a body - Wikipedia
Guess, LE is doing everything to find her (body)
I do not know, when it comes down to... these crimes related, but the EU law is above National law.

Murder without corpse - Case Rebecca Reusch: Conviction of brother-in-law Florian R. possible?
Legal tip from 14.03.2019
(6)
Currently, the case of the 15-year-old student Rebecca Reusch goes through the media. The girl from Berlin is missing since 18.02.2019.Currently, Rebecca's brother-in-law Florian R. is suspected of having killed her and is in custody. This, although Rebecca's body has not been found and especially her family assumes that she is still alive. The execution of pre-trial detention on her brother-in-law is incomprehensible and leads to the question of whether the remand of custody or even a criminal conviction for a homicidal crime is even possible, as long as Rebecca's body was not found.

In fact, it is possible to convict someone for manslaughter without finding a body, or murder if one or more of the murdering characteristics are found. Otherwise, any perpetrator who dissolves his victim in acid would get off scot-free.However, in addition to evidence of the perpetrator, there must also be significant evidence that the missing person is dead.

Indications of the perpetrator and death of the victim are required

This would be quite strikingly the case, for example, if a witness had observed the killing and subsequent dissolution of the victim in acid and would testify in court.

Also, if there is a lack of evidence relevant to the facts of the crime, a conviction for a homicidal crime is possible. The transfer of the accused can also take place in that all concrete alternatives were excluded.

Judgment of the district court Cologne

Thus, the district court of Cologne has sentenced a man for murder, whose wife suddenly disappeared without a trace. This was preceded by disputes and finally a breakup. The wife, who was from the Philippines, moved into a flat with her child, from whom she disappeared without any indication of her whereabouts. The Federal Court of Justice confirmed this conviction in the last instance.

The evidence leading to the conviction of the husband was the following:

  • He had a motive. He wanted the sole custody of the child together and had little interest in paying maintenance to his wife.
  • In time close to the disappearance of his wife, he has issued powers of attorney which have enabled him to take care of the child and also to change his residence.
  • He changed the lock on his wife's apartment and took a key to gain access to her apartment.
  • He was the last person to have proven contact with her.
  • He took his son to death on the day of their disappearance, although this was not the usual day of the week for exercising his right of access.
  • He called her on the morning of her disappearance on the phone, left home before work began, and returned to her shortly afterwards.
  • He repeatedly made contradictory statements about his wife's stay and repeatedly became involved in contradictions during his interrogations.
  • He visited his wife's police-sealed apartment several times and penetrated his wife.
  • He reported the child together a few days after she disappeared, when it was still unclear whether she was actually missing or was about to return.
From the point of view of a defense attorney it is frightening that someone can be sentenced to life imprisonment for murder on the basis of such a thin blanket of evidence. However, the example from Cologne shows that this is possible.

Case Rebecca Reusch - suspicionagainst her brother-in-law Florian R.

In the case of Rebecca Reusch, according to media reports, in particular the following indications point to the perpetration of her brother-in-law Florian R.:

  • He is said to have been the last to arrive in the house after he got drunk from a party.
  • He is said to have sent messages on his cell phone at a time when he was supposed to be asleep.
  • It was unusual that Rebecca had left the house with her day clothes, school supplies and a blanket, but had left behind change clothes and cosmetic utensils.
  • In the raspberry-colored Twingo of the family were found in the trunk both fiber traces of Fleece blanket and hair by Rebecca.
  • The Twingo had been recorded on the morning of their disappearance as well as the day after late in the evening on the A12 motorway towards Storkow by the automatic license plate detection system KESY. Only Florian R. had access to the car at these times.
  • In his interviews, he had become entangled in contradictions.
For me as a defense lawyer, it is incomprehensible that Florian R. could be taken into custody solely on the basis of these indications.

Why even bring up manslaughter when there is no evidence as to how death came about, assuming she is dead?

And what kind of sentence would that bring over there...five years? Not trying to be snide but I am always astonished at the short sentences for murder in Europe and then changing their names afterward...jmo

Manslaughter in the US is different than manslaughter in Germany. Something like 2nd degree murder in US if I’m not mistaken?
