The defense is asking for evidence of a proffer agreement between Burke and investigators regarding subject matter related to Heuermann’s case and for information related to the county’s ongoing prosecution of Burke, who was also arrested on a public indecency charge in 2023.

Burke’s attorney, James O’Rourke, of Smithtown, told a Suffolk judge at Burke’s Oct. 30 conference that after discussions with prosecutors he believes the former chief’s case can be resolved at his next appearance Jan. 22. O’Rourke and Suffolk County District Attorney Ray Tierney declined to comment on Burke’s case or any possible connection to the Heuermann prosecution immediately following that October conference…

Tierney scored a big win in the case in September, when Mazzei ruled that the DA’s office may use the DNA evidence at Heuermann’s murder trial.

On Tuesday, Tierney doubled down on his refusal to consider a plea deal for Heuermann – and said he shared the judge’s impatience with the pace of the case.

“The judge was very explicit, and we are ready,” he said.

I'm rewatching the Killing Season. The amount of discussion there was about how many killers were responsible and the people we now know are connected to RH, Valerie Mack, Jessica Taylor, Sandra Costilla, and the GB4... It's just insane. Heuermann must have killed so many more.

I'm glad he is going to be held responsible. But I also really wish he would plea and tell officials about all his murders. So many unsolved in the area, seems like some have to be connected to him. I hope Keith Jesperson's notes about butter will get to Rex.

With over 50 hotel/motel room key cards found in his possession, I can only imagine how many victims there are. IMO, these were his "souvenirs".

He had seemed like a normal family man who worked hard and got on well with his co-workers but secretly he was allegedly leading a double life and went undetected for years.

Muriel Henriquez had worked with Rex Heuermann when she was office manager at his architectural design firm in Manhattan, New York, in the early 1990s. She was gobsmacked when she discovered he had been arrested for allegedly being the Gilgo Beach Serial Killer.

Speaking exclusively to The Daily Mail she recalled how they'd bicker about politics, argue about the bookkeeping and chat about his love of guns and his trips to the shooting range.

There's likely some truth to that. At the same time, he must have been hungry after his surprise arrest on the streets of NYC where he was headed for din-din I imagine and was rudely interrupted by all those cops! They likely only offered him junk food at the station also. And he must have been exhausted from the day's shocking events, because he smugly thought he was one step ahead of LE. The world knows he's guilty anyway so what he eats and how he sleeps is the least of his worries IMO.

Prosecutors also urged Mazzei to shoot down a request made by Heuermann’s defense to obtain potential statements made with immunity by former Suffolk County Police Chief James Burke, who they intend to introduce as an alternative suspect at trial. While prosecutors do not deny that such an agreement exists following his 2023 misdemeanor arrest for indecent exposure, they argue the case has no relevance to the prosecution of Heuermann…

The judge previously said he intends to rule on the remaining issues when Heuermann returns to court March 17.

I somewhat hope Burke is allowed in as a defense witness.

Obviously, I don't want Rex to prevail, assuming, as it appears, that the evidence against him is overwhelming.

But I want Suffolk County to see and feel the consequences of letting corruption taint LE. The law can't be enforced by lawbreakers.

It was bringing in Feds, State and super leadership in Rodney Harrison that allowed this breakthrough in the face of SC corruption. SC need to get to a place where they don't need such extraordinary resources to solve crimes like this. (Including willingness to accept help from State and Federal agencies in a routine way.) They are a large, well-funded force.
