If this video is (as rumored/expected) footage of him telling his mother that he made up the story, it will effectively discredit him, in my experience.

Also, he didn’t make enough to need to file taxes, IIRC, isn’t it approx >10k that must file as a single taxpayer? to suggest that makes him a criminal is laughable, given the already healthy amount of data that shows he’s had a criminal history.

The male prosecutor is now debating with the judge. I am almost certain the discussion is about them not being made aware of this recording.

They are probably objecting to its admissability as evidence because they were not told about it in discovery.

Just guessing but a huge drawn out debate with judge about something going on.

Honestly, after watching the defense's tactics, it would not surprise me if they kept this recording hidden from prosecution on purpose.

I think it is $2,000, but I agree. He probably has never made $2,000/year in taxable income. He probably earns most of his money under the table.

omg....it sounds like the prosecution turned over this tape to the defense by mistake and that is how they got it. Good Grief.

Right now the defense is playing an audio recording of Demarino talking to his mother on the phone while he was in jail. In the phone call, his mother asked why didn't you tell me about a picture? Demarino says it's not true. @WBTWNews13

ETA: I still believe him but this is incredibly awkward and I feel bad.

I think this it the very first time in this trial, that the defense has been effective in their cross examination of a State's witness.

Demarino tells the jury that he lied to his mother so she wouldn't worry. The defense said in his testimony earlier, Demarino testified he never lied to his mother. The defense said they just caught him in a lie. @WBTWNews13
