omg....it sounds like the prosecution turned over this tape to the defense by mistake and that is how they got it. Good Grief.

Demarino told his mother in a jailhouse phone call there was no photo. He says that was a lie to protect her.

Before that he told the defense he never lied to his mother.

Defense attorney hammering with questions about lies and perjury.

EDIT TO ADD: Ok, I believe there was a photo and he saw it. He just lied in the recording to protect his mother (didn't want to stress her out). But he really did see a photo.

At this point no matter if he is lying about the photo or not I think the prosecution should just tell the jury in closing that they can throw out his testimony if they want to and all the other evidence still shows the defendant is guilty in this case.

His reason for lying to his mother is good enough for me. He DID NOT want to worry and stress her out over it!! I BELIEVE HIM!! He saw what he says he saw!!

Well, I don't believe him that he didn't tell anyone else about the picture. I can't decide if I believe him or not.

I believe him because he was in a better place during SM's trial - he's not in a good place right now though, had I not seen him during SM's trial I may think differently. I worry about the jury

I believe him. Nancy just brought out that his mom knew about the photo because HE talked to her about it. My opinion is that later, his mom starts getting worried about it and he brushed it off with a lie to stop her worrying or possibly ASKING Tammy or Sidney about it.

If I were HE's parents, I would run after him and ask him every little detail about that photo I would HAVE to know what happened to my baby.
