Something ain't right. How can they say they reviewed the testimony of 75 witnesses if they don't have everyone's transcripts? I don't care if the court has to pay $100/page. The jury can't deliberate and come to an unanimous decision if they're only reading their notes. Wtf is this Mayberry or what?

So the 2 minute archive says that they have finished with letting the second juror who asked to speak to judge have his moment. No summary yet on what that juror communicated. I think that's why the 2 PM video ended suddenly, because he was saying to bring in that juror, and Akaku knew they were not permitted to record that.

Transcripts are produced on request only. They cost a lot of money, especially for trial transcripts, which are charged at a higher rate than hearings.

Court reporters here are like independent contractors, and they do not produce transcripts until they are paid by the requestor. And there are only a handful of reporters for every trial and hearing going on on Maui.

The more common way to access the content is to request the DVD video, but those are made pretty quickly, so I'm guessing they are using only paper transcripts for the jury.

If I recall correctly there were no videos being made at the time Earles and Hamilton were testifying.

So.........I watched the video clip Pua posted, but I'm still unclear if the jury will continue deliberations until they receive the transcript copies on Mon 19th or if they'll take a break until Mon.

Based on the testimony the jury is asking for what are your thoughts on what they are focusing on?

It's always being recorded on the court's closed system, for court's own use.

Media recordings were not made ... not the same thing.
For instance, the court system is directly hooked into the microphone input, and it has multiple cameras that switch angles depending on the speaker, whereas media has limited camera set up and has to
record sound from their own mikes.

MM, they left it up to the jury to decide once the jury finds out the transcript ready date is Monday, so the answer is unknown to us at the moment.

I am still trying to figure out what the heck the jury has been doing for almost two weeks, for hours a day, if they don't have testimony transcripts to review. Insane.

Ugh. I suspected there was at least one juror who was siding with the defense, based on the occasional jury questions during the trial. Now I know it's true. I am trying not to get too emotional about this, but I can't help but feel outrage toward the person/s who can't see the plain truth of this. And the nitwits who didn't get that DNA evidence submitted on time! How on earth could they bungle something so critical to the case? I'm too emotional about this to write much else right now.

At this point the Jury needs to decide whether or not he is guilty. Whether or not you would let him date your daughter. Not whether or not the State proved its case. If you think he did it then Guilty, if not then Not Guilty. I dont know is unacceptable.

Im not sure one Juror cant see the plain truth of this as mush as they are "OK" with it. The Pregnancy. Old Story of a dude getting rid of it Old School. Its a Mans world. Maybe even something against the State and Authority figures.

Regrettably, I think you're right: This could well be someone who's got a grudge against the MPD, someone who wants to sock it to the system somehow, and/or someone feeling sympathy for a guy "trapped" with a pregnancy.

I didn't know Charli, and I don't know her family, but I have shed real tears for them throughout this ordeal. I can't begin to imagine what they must be going through right now. My heart is with them.

Holidays are already so hard when you have lost a loved one. The Scott's have been through an incredible amount of pain and loss already. I really hope they get an answer soon.

I can't help but wonder if there is something shady happening with one of the jurors. It's just so small here that it seems like it could happen. I just don't understand how someone could think he's innocent.

These last comments sound very possible explanations of why there would be a hold out.

It's also possible it's just someone (most likely male) who can't get past that no one saw it happen, or knows for sure where she was killed, or exactly how, or when, and no one saw him with her that night although Steven did say they were, and maybe buys the sex and miscarriage and bleeding out theory. They may just not be comfortable with circumstantial evidence.

maybe he is not too bright, who knows unless they have really gotten to know the jurors?

Has anyone here who has gone in person gotten a specific juror vibe that seemed pro defense?

Has this ever happened before? It's like the jurors that came forward are dealing with a hostile environment in the jury room. One or more jurors that just will not be swayed.

How stressful this must be for them. What gets me is the holdout(s) have probably known all along they would vote not guilty.

Re the transcripts, there was a strong jury admonition from Cardoza that written transcripts are not evidence and are not primary tools for jury deliberations. He said that the spoken testimony is primary.

They also have to leave their personal trial notes from all this time behind when they go to deliberate. What they do is talk about the testimony and sort it out. We've been doing that for almost three years, so nine days seems small to me. Remember they were forbidden to discuss the case with each other for this whole time until nine days ago.

They may have video or at least audio of the testimony. With 75 witnesses, it would be unrealistic to expect them to remember all of that. I have a feeling that they are only supposed to ask for paper transcripts if nothing else will do, but I'm not sure.

It costs about a $100 for a 15 minute transcript, by the way.

What a backwards system that is if that is indeed how it works in Hawaii. Oh man! What good are juror notes during the trial if they leave them with the baliff at the end of the day and can't use them during deliberations? I honestly do not care about the cost of the transcripts as a tax paying resident of Hawaii. If the costs are too outrageous then they need to employ someone in-house.
