A confession is admissible as an exception to the heresay rule, under the assumption that a person wouldn't falsely admit to a misdeed or crime.

Thanks. This helps me understand one of the exceptions that would allow heresay in testimony.

I looked up the definition of heresay the other day, and found some exceptions but did not understand them at the time. Your explanation helps me understand one of the ways it would be allowed. There were some other ones listed too, and I suspect you are correct that perhaps the prosecution is going to try to get the testimony admitted based on one of the allowed exceptions.

Hearing Delayed For Suspect Charged In Connection To Bobo Disappearance

Mark Pearcy was set to go before a judge at the Decatur County Courthouse, but it appeared a miscommunication between the US Marshals Service and prosecutors kept him from court. His new lawyer was then left to face the judge, who reset the hearing for September.

Pearcy has been held in federal custody on gun charges prior to being charged in the Bobo case.

Pearcy and his half-brother Jeff were both charged in May with accessory after the fact and tampering with evidence

A spokesperson said the Bobo family was frustrated by the delay and would like to see the case move forward.

In court on Monday, officials said Mark Pearcy was in federal custody in Jackson.

The Bobo family, friends and supporters all left angry because Mark Pearcy was a no-show.

The Bobo family Monday designated the newly elected Decatur County sheriff to be their spokesperson. Decatur County will also soon have a new district attorney. The Bobos hope new officials will mean more organization for the case.

The court hearing for Mark Pearcy has been continued until Sept. 22

More on today's "confusion" on MP's court appearance from the Jackson Sun:


When Mark Pearcy's name was called for the court hearing today, he wasn't there.

Attorneys for the state said Pearcy is in federal custody in Jackson. Pearcy was indicted by a federal grand jury on June 16 on two charges of illegal firearm possession.

"It's the state's responsibility to get him here," [Judge Rick] Wood told them.

"I was not aware that this was to take place today," the prosecutor replied.

The state was then given about 10 minutes to make some phones calls to see if Pearcy could be transferred to Decatur County for his preliminary hearing.

When attorneys came back, they said Pearcy couldn't be transported to Decatur County today.

Pearcy's court-appointed attorney, Michael Cash, also wasn't in court. Attorney Michael Thorn said he was hired by the Pearcy family to represent Mark.

WOW is right. The judge was pissed and righfully so. The judge said:
"Woods said that he wasn't going to tolerate this issue again."

It sounds like the case came pretty close to being dismissed altogether.

Why am I not surprised that the prosecution did not have their act together and have the defendent present at his own hearing. If it wasnt so upsetting, it would be hilarious.

Here is another question I have about this particular case.
He is charged with accessory after the fact. Wouldn't a simple defense argument to win this case be:
How can you be an accessory after the fact when the 1st case of proving someone murdered Holly has not even been tried yet. It seems you can only be an accessory after the fact when you have proven Holly has been murdered by someone.

This is the currently-in-office prosecutor whose term ends Sept.1. I think he's already out of office mentally. This is just :moo:

On Sept. 1, Keith Byrd will become the new sheriff of Decatur County and will inherit the ongoing investigation into the disappearance of nursing student Holly Bobo.


Byrd said his biggest goal is to find Bobo. The TBI has said it hasn't found her body.

"I'm going to be working very diligently on that," Byrd said. "In fact, I've already contacted some folks that I intend to use in order to do that. I plan on meeting with the TBI and finding out if there's additional places that we need to look and go to those places and look.

The judge threatened to hold attorneys in contempt of court if something like this ever happens again. Stowe promised that now that he's taking office, it won't.

That statement is an absolute admission that this case is lost and damage control is the prime motivation. John Q. Citizen can only wonder just what the TBI has been doing the last 3 years-playing mumble peg?

"well we just remembered that there is an old shack about 50 feet from where the victim was last seen-so, when we get time, were going to check that out"

It's just pitiful and the game plan of let the blame fall on anyone but us is obvious. Since the media has already determined that this case has gone down the tubes and they aren't interested anymore they hope this will all just go away.

9000 pages of discovery and not a single one can prove a crime has even been committed.

If I understand correctly, there is no shack, and those words were never said (except on this website, as a somewhat-tongue-in-cheek hypothetical).

BBM: WHAT ? SERIOUS CRIMES were committed against Holly:

- Holly was kidnapped from her home on the morning of 4/13/11 and this kidnapping was WITNESSED by her brother.

- The TBI stated that Holly is deceased.


ZA and JA: These 2 have been indicted/CHARGED with Holly's MURDER and are currently in jail.

MP and JP: These 2 have been charged with ACCESSORY AFTER THE FACT - MP is in jail on other charges.

SA: MAY or MAY NOT have an "immunity deal" that is still pending.

DJA: In jail on other charges, however, saw Holly AFTER she was kidnapped.


JMO but I still have hope that Holly will be found and that this bunch of career-drug-addict-criminals will be held responsible for Holly's murder !

BBM: With all due respect, I must totally disagree.

IMO the media is doing a good job of staying on top of this case. They are following ALL the perps who are ASSOCIATED WITH the perps currently in :jail: and they are even staying on top of those in federal :jail: on gun charges who are associated with this bunch of perps !

Has there been mistakes ? Yes but hopefully they will get their act together to rectify those mistakes !
