How can anyone sell anything without a 501c3 filing with the secretary of state for non-profit status?

Has anyone obtained such a status to our knowledge?

I'm catching up but wanted to respond to your question. Legit 501c's rent out their non profit status allowing nefarious groups to use their info as a subsidiary. These scammers have found a way to get around qualifying for a 501C status. So having a 501C does not make an org non profit or legit.

Also a 501C is not always required. It's only needed if you want to allow your donors to have a tax free deduction. And in the case where there is no 501C your donations can be spent however the recipient wants to spend it. Most states have no laws covering this and the donations are basically a gift to the recipient. ETA: they can buy a tv if they want to.

Because of what I have learned, I rarely donate to anyone anymore.

If you read through here, it is more clear on the 501c3.

Don't really know about what the situation going on is here- but I can say with confidence that 501c3's are not necessarily set up for the purpose of accepting donations. Some don't accept them at all.

COLORADO CITY, Texas -- A group of volunteers have launched the website "Hope For Hailey" as they work to keep the missing Colorado City teen's case alive.

Maybe I'm strange, but I would feel better about Hailey's parents selling merchandise than some of these other groups who hate one (or both) of Hailey's parents. At least her parents have some connection to the girl, whereas we don't really know what the agenda of other people is.

And I believe as long as they don't falsely advertise that their group is a "Non-Profit" when they haven't filed papers as one, I think they can sell whatever they like, as far as I know.

I know about another group on Cafe Press that copied merchandise and tried to fool people into thinking it was the original group's just to make a buck. I don't think anyone but the families should lay claim to Hailey Dunn merchandise at this point because that's the money that's going to be alot harder to trace than any coming to the families. :cow:

It was written for the many viewers who inquired about t-shirts, bracelets, and pins, but can not attend any "Hailey events" or make a trip to Colorado City.

When I visited Colorado City Middle School last Tuesday administrators told me all the money raised from bracelet sales will go toward the "Hailey Dunn Scholarship Fund." Kristy Lloyd, a school counselor and search team leader says the scholarship will be offered to students in Hailey's graduating class at a later date.

Aren't scholarships in honor of a student done when the student passed away before they could graduate? It sounds like the school is convinced that Hailey is deceased, and unfortunately I think so too, but it seems a bit soon to be announcing a scholarship. That seems more appropriate if Hailey's body is found or if she is still missing when senior year comes around.

Maybe they are doing it as a creative way to get the child's face out there. I do understand people's reactions but at the same time I do think that is a creative way to get Hailey's face out there in hopes that someone has seen her. IDK

Exactly! When I first read about the scholarship fund...I thought perhaps they were raising funds for a scholarship *FOR* Hailey, for when she's found. Then I realized the funds are being raised for a scholarship in her name- usually done in honour of a person who has passed

Unless her name is trademarked (as was Madeleine McCann) along with her image, then it is legal.

The pics became public domain once they were released via multi media outlets.

I drove myself crazy following the money in the MM case and don't dare venture there again.

Missing children are BIG business, and not just the families are cashing in.
