Shadlow's new trial starting date in Dickinson County is Jan. 7. The trial was moved there because of trial publicity in Hardin County.

Tyler's trial is scheduled to begin Nov. 5 in Cerro Gordo County. Shadlow had requested separate trials , citing the likelihood that his defense would conflict with that of Tyler.

Spirit Lake jury to consider kidnapping, torture allegations

"If investigators are correct, the summer of 2017 was hell for a little boy identified in court records as “E.S.”

His teachers were alarmed at the start of the school year. E.S. was too thin for his age.

He was always looking for food.

His hair was falling out in patches....

District Court Judge James C. Ellefson on Monday, Oct. 15, ordered a Jan. 7 trial for Shadlow, who is the 8-year-old boy’s biological father. Shadlow’s first-degree kidnapping case was moved from Hardin County to find a less-influenced pool of jurors at the Dickinson County Courthouse in Spirit Lake....

E.S.’s mom, 39-year-old Traci Lynn Tyler, faces the same charge. Her kidnapping trial also will be heard by a separate pool of jurors. A trial date hasn’t been set for her relocated case at the Cerro Gordo County Courthouse in Mason City....

The young boy has signs of post-traumatic stress. He also sustained permanent scarring on his back and limbs, but defense attorneys would like to block or limit the number of photographs and videos because the images could “inflame the jury’s emotion and rouse hostility against” Shadlow....

Shadlow said he is not guilty in the written arraignment and plea signed on Aug. 2 and has waived his right to a trial within 90 days.

Hardin County Attorney Darrell Meyer and Assistant Iowa Attorney General Laura Roan successfully asked the court to allow E.S. to testify through a closed-circuit television. Attorneys and the judge expect to call 90 Dickinson County residents to jury duty for the case. Shadlow will be able to wear street clothes at trial.

Shadlow and Tyler remain in Hardin County Jail in on $500,000 cash-only bonds. First-degree kidnapping is a Class A felony that carries a potential life sentence.

Nice, the child is too traumatized by the abuse to testify in court, the therapist would prefer CCTV.

But, that denies the rights of the accused to face their accuser in open court. The Father of the child states.

Apparently, the Father has been allowed visits with his son, who is in foster care.

My take on this, is that the kid thinks that he will end up with the Father anyway, and doesn't want to antagonize him further, for fear of more abuse. The Father has probably done the classic abuser manipulation.

These kids are smart, even by age 9, they know how the system works. He knows he will be back. And he is probably right.

Apparently, the Father has been allowed visits with his son, who is in foster care.

This was in 2017 though, not now.

According to statements in court, Shadlow had voluntarily placed the boy in foster care in September 2017, which was before his July 2018 arrest. During that time, the father took part in Department of Human Services monitored visits with the boy. The defense said where no issues during the visits.

The abuse of the child is horrific. But the dog, who was urged to bite and attack the child, was also abused. A dog like that is probably dangerous due to bad training.
