Id'd on March 31, 2021) - *Henry Earl Dinkins (48/now 49) arrested (5/5/21), charged (5/6/21) & arraigned (6/16/21) on 1st degree murder & 1st degree kidnapping. Plead not guilty. Held with no bond in the Clinton County jail.

1/25/22 Update: Motion hearing on trial continuance. Judge Henry Latham granted the motion of continuance of trial. 2/2/22 Update: Setting hearing on 2/10/22 @ 8:30am. The Judge also set a status hearing for 4/19/22 & final pretrial conference for 5/4/22 with trial starting on 5/9/22. 2/3/22: Letter to Judge Latham by Dinkins. Dinkins is scheduled to be in Scott County Court at 8:30am Thursday for a hearing with Scott County District Judge Henry Latham to review the written request Dinkins made for a new attorney in late January.
2/10/22 Update: Order on incarceration status. Motion filed by Latham Brown. Other Order: Regarding motion for new counsel. 2/10/22 Update: 7th District Judge Henry Latham to deny Henry Dinkins' request for a new attorney. Judge Latham summarized the contents of a letter Dinkins sent to the judge Jan. 25 — the same day Latham moved the start of Dinkins' trial to May 9, with a final pretrial hearing set for May 4. Before the change, Dinkins' trial was scheduled to start Feb. 14. In the letter, Dinkins said he had not seen public defender Puentes "but once in eight months." Dinkins also claimed Puentes gave him false phone numbers & he could not contact the attorney. During Thursday's hearing, Puentes explained that as late as last Friday Dinkins had not expressed to Puentes a desire to replace him. He also explained a combination of factors led to infrequent in-person visits, including the fact Dinkins is housed in Clinton County & "discovery has not been done in a timely manner." Judge Latham concluded the hearing by ordering Dinkins to have better access to Puentes via phone & ordered Puentes to have a physical visit with Dinkins "at least once a week. Next hearing on 4/19/22.

2/22/22 Update: Order hearing set for new counsel on 3/11/22 @ 8:35am. 2/28/22: Order for continuance. 3/1/22: Other Order: Order setting hearing by video conference-rescinded. Dinkins filed a second request on Feb. 25 stating that if he does not get a new attorney then he will represent himself. In the letter, Dinkins claimed his attorneys were “not willing to put in the work” on his case.

The hearing on Friday was to address the second request.

The hearing began with Kyle Worby, Puentes’ co-council, telling the judge that they have tried to call Dinkins on three separate occasions and he has refused to speak with them.

Scott County Attorney Michael Walton then stated he believes that Dinkins is trying to prolong the trial date, which is set for May 9.

Given the opportunity to speak, Dinkins was adamant that he wanted to represent himself because he said he was not given the “proper representation.”

Judge Latham agreed that Dinkins seemed to be attempting to prolong trial, saying, “to me it appears you’re just frustrating the whole situation.”

“If ya’ll want to pursue [trial] and continue forward, [you] don’t have to change dates,” Dinkins responded, “I’ll represent myself, I don’t need council.”

Latham told Dinkins that the court was not going to address that request because he had not filed a motion to represent himself. “That can be filed at a separate time,” he said.

Latham denied Dinkins’ second request for a new attorney, stating, “you haven’t cooperated with your attorneys.”

I'm tired of Dinkins idiocy, soon it will be two years since he murdered Breasia. Move it along already, at some point the trial has to go forward despite his attempts to thwart it!!! Let him represent himself if he thinks he's so smart.

no next court date, but I do have a hearing on 4/19/22, but will wait & see if they update the docket on that one. I see he waived speedy trial & motion to withdraw counsel - so looks like his trial date of 5/9/22 will probably be continued...

Change of venue approved for man accused of killing Breasia Terrell

A change of venue has been granted in the murder trial of Henry Earl Dinkins, the man accused in the kidnapping and shooting death of 10-year-old Breasia Terrell in July 2020.

Scott County Attorney Michael Walton said District Judge Henry Latham made the ruling Wednesday after a hearing in district court.

Where the trial will take place was not determined Wednesday, Walton said.


“It is continued for a pretrial on April 8,” he said. “I assume we’ll know by then, maybe sooner.”

Dinkins, 49, also will get a new attorney assigned to him, despite a previous denial, after his court-appointed attorneys requested to be removed from the case.

Henry Dinkins, man accused of killing 10-year-old Breasia Terrell gets new lawyers

The man charged in the kidnapping and killing of a 10-year-old Davenport girl has new attorneys.

Henry Dinkins, 49, pleaded not guilty last year to first-degree murder and kidnapping in the death of Breasia Terrell. She was missing for nine months before her remains were found in a pond in rural Clinton County.

Dinkins asked for new attorneys in January, stating in court filings that communication with his appointed public defender Miguel Puentes had broken down. Scott County District Court Judge Henry W. Latham II initially denied Dinkins' request and ordered more and regular contact between him, Puentes and fellow public defender Kyle Worby.

Puentes and Worby asked to withdraw from Dinkins' defense on March 29, stating in a court filing that Dinkins refused to communicate with them.

Latham allowed Puentes and Workby to withdraw from the case last week. Dikins will now be represented by attorneys Jennifer Frese and Chad Frese, according to court documents filed Monday.

The judge last week also granted a request by Dinkins’ lawyers for a change of venue. A new venue for Dinkins’ trial was not immediately selected. Court documents state the location will be decided after Dinkins' new defense team consults with the court and the Scott County Attorney’s Office.

We all know how it ended for Bahena Rivera ... good, I hope Dinkins has the same outcome. JF was so annoying, reminds me Barry Morphew's counsel.
