That is interesting, I assumed they encountered him at the trailer or farm.

From your link.....

Enter Richards. He told The Chronicle he was sought by family members and friends of Rivera to locate him after he was taken into custody.

Richards said he successfully found Rivera was being held Tuesday night in the Tama County Jail in Toledo.

He said he had previously represented some of Rivera's acquaintances.
Looks like the Poweshiek County Jail is in Montezuma. Curious.

Is that the same county as Tama?

Tama is 26 minutes away from Brooklyn

I missed last night's discussion about CR's education and work history, but I thought I'd share some thoughts, belated. MOO

  • In one article I read the father said CR came to the US to work because there were no jobs in their native area. That tells me, possibly, that school was never even in the plans.
  • We don't know the uncle's situation at the time, either. Perhaps he wasn't in the position to take on a student with limited or no income.
  • The father had described CR's first years in Iowa as working a "series" of dairy farm jobs, although a different article said it was one. Either way, the fact that he got the job at Yarrabee's (some say with IM's help) right around the time IM got pregnant, indicates he could have previously been living in a different town, yet a town close enough to have had the social contacts to have met IM, and so moved closer to be with her.

He was attending Preparatoria 35 in San Luis San Pedro, Guerrero, Mexico. The school is 7 miles from his home in El Guayabillo, Guerrero, Mexico. This is the link to the school:

Unidad Académica Escuela Preparatoria No. 35 - Escuela Bachillerato General - Tecpan de Galeana - Guerrero

I don't speak Spanish, so please correct me if I'm wrong, but it seems to me that if he was attending Preparatoria 35, then he was attending Grade 10 at school at the age of 16 before he moved to Iowa. In fact, his birthday is in June, so it's even possible that he completed Grade 10 prior to the move, which aligns with moving at the age of 17.

My impression is that the suspect had two options: continue with his education at home, or move to Iowa illegally. I don't know how the rules work for illegal immigrants attending school, so I would like to hear about any legal reasons why the suspect could not have enrolled in school in Iowa.

Regarding finances to support a 16 year nephew, if extended family can pay for a lawyer, they could probably support a nephew for two school years.

The suspect has been employed at the same farm for 4 years, and I think we can assume that he worked off and on at some point between the ages of 16/17 and 20. How long does it take to obtain illegal documents? Was he hired as an illegal immigrant at a couple of different farms, perhaps working seasonal rather than full time, before he obtained illegal documents and obtained full time work?

But is it the same uncle with Yarrabee now or a different one. I just remember reading that he had family in other towns in Iowa and I took it that there were others. It is just hard to remember back that far.

I'm only familiar with the uncle who was quoted in the news.

Rather then CR's education records; his medical records if they exist would be far more telling; has he been diagnosed with any mental conditions that could have contributed to his heinous actions on that evening / night?

CR is not likely to have the kind of health records you are thinking if. While he could have health insurance through his employer, under his alias, he is a young healthy Male. Just the same kind as US citizens who ask why do they have to pay for Obamacare. As a group, they don't usually get sick and can get by without regular visits to the doctor. Also. If you are severely injured and /or critically ill, under Federal law any US hospital that accepts Federal reimbursement must accept you for treatment, no matter your ability to pay or your immigration status, and stabilize you and treat you. Also if you are in active labor.

Google EMTALA law of 1986.

The initial earing was in Montezuma as well. It’s most likely Tama has higher level protection for its prisoners and so that’s where he’s being stowed. I’m not noticing any news source to indicate he was arrested in Tama County and even if he were, there’s no rule that must be jail he’s placed in.

“Cristhian Bahena Rivera is escorted into the Poweshiek County Courthouse for his initial court appearance, Wednesday, Aug. 22, 2018, in Montezuma, Iowa. Rivera is charged with first-degree murder in the death of Mollie Tibbetts, who disappeared July 18 from Brooklyn, Iowa.”

It’s very common for a Mexican school to operate under a system of dual purpose, split shifts - elementary children go early in the day and after their school day is done, then the older kids attend later in the afternoon into the early evening. Therefore the online name of a school may be misleading.

Maybe he was being held in Tama for his own safety. Brooklyn was probably not the place for him to be held.

Yarrabee Farms may have some explaining about their hiring practices to do....one more time.
I just popped in real quick to see if there was anything new on CR or if we’re rehashing the same old stuff and then that news alert came up, so I guess that’s about it for now. (?)

I saw there was a discussion on CR’s ear shape a couple pages back, so decided not to stick around lol. Any news at all regarding a trial date and when would that have to be filed by?

I found this part amusing

"Absent unusual circumstances, it would be difficult to show they knew any more than what they were told," Teig said, adding that it would be "pretty racist" to assume a John Budd could not be Hispanic.
