ID - Charles Smith & Christina Haynes for child abuse, St Maries, 2008

I saw a bit of an update last week on KXLY but was unable to find anything on their website about it.

Little Kyra is still hospitalized and her mom is prohibited from visiting her (thank goodness). A couple of Christina's former neighbors were seeking to get "Orders of Protection", from Christina Haynes. I gathered that was due to their fear of retaliation for calling LE to do a wellness check on Kyra. The judge denied those requests.

What I thought was strange is that Christina has been ordered to live with her parents, in Post Falls, ID. Her former neighbors live in St. Maries, which is a considerable distance away.

Maybe Idaho4Groene's will have a better update for us, soon.

Hey everyone. I am hoping to get more information when our local paper comes out again on Wednesday. I will pass on whatever I find out from there. Also, just to clarify, Post Falls is only about an hour away from St. Maries.

Kyra undoubtedly has neuropathic pain from her amputations and injuries. For the judge not to grant the Orders of Protection is sad-those people tried to get the children help in a dangerous situation.

In terms of the foster parenting, I would think that Kyra's mom was a danger to children. Period. If they are actively fostering children, I think there is an issue there.

I just heard about this. I can't believe that poor baby had to endure that kind of torture and now to lose parts of her own body. I sincerely hope these people get some serious time, I assume you can't get the death penalty for this right? Too bad.

I mean, bio mom is out on bond...this is the part that kills me.

Thanks, I4G! I am about an hour from St. Maries but have never been to Post Falls. Appreciate any & all info you can provide, Idaho!

I agree about the Orders of Protection. I mean, what could it hurt? Thank God for neighbors like this, because one neighbor is the reason Kyra is alive today!

I hope Christina's parents are not currently fostering any children. IMO, that would be a crime.

You know, that is the way our justice system works. Her bond was quite high. I hope her poor grandmother doesn't end up losing her house that she put up, so Christina could be freed!

Smith asks judge to dismiss second felony. Charles Smith is the boyfriend. He was charged with felony child abuse, but then a second charge of felony battery was added several weeks later. The motion to drop the second charge will be heard in a hearing on the 15th. Smith's preliminary hearing is set for September 12, and he, unlike Christina Haynes, is still in Benewah County Jail on $250,000 bond.

There was no sexual battery charge? Now that surprises me. I thought she had been attacked in that way as well....regardless, he is due both sets of charges, but I wonder if he will plead guilty if the second is dropped-we have seen the value of children in this country-it is a toss up if felony child abuse will carry true punishment with it.

Thanks for the update, I4G! I've been searching all over and listening to local news because I'd heard that Smith was supposed to be back in court today, but I've come up with nada!

I'm kind of surprised there's been nothing that I've seen either on local news. And unfortunately, our local newspaper only comes out once a week on Wednesdays. Hopefully they will say something then at least.

A Hells Gulch man accused of seriously injuring a three-year-old child had his court appearance postponed again last week

Since Charles W. Smith, 29, was arrested more than two months ago and accused of causing extensive injuries to Kyra Wine, his live-in girlfriend's daughter, Smith's attorney has continued to delay his court appearances.

He is now scheduled to appear Sept. 12 to felony charges of injury to a child and aggravated battery.

Smith's attorney William Butler said he plans to ask a judge to drop the aggravated battery charge at the preliminary hearing.


He currently sits in the Benewah County jail on $250,000 bond.

Thanks, I-no offense but the article is a little underwhelming by characterizing the brutalization of this child as "a man accused of seriously injuring..." that could be breaking her arm-not torturing her in some way that caused her to lose digits and chunks of flesh, not to mention hair.

Experts hired for Haynes

A judge granted a request for the county to pay for expert witnesses in the Kyra Haynes child abuse case.

In an order that again postponed the preliminary hearing of Christina L. Haynes and Charles Smith, Magistrate Pat McFadden last week granted a request that $1,500 be set aside for the defense.

Public defender Dave Rogers, who represents Haynes, asked the court for the money last week.

“I would like to be able to shed some light on how this case came to be,” he said.

Not a clue what these experts are going to be looking into. For one, I don't care "how this case came to be", if they're talking about why "mom" and "stepdad" abused poor Kyra.

However, Benewah Co. Prosecutor Doug Payne tells KREM 2 News he would recommend the judge suspend five years of that sentence.

Kyra Wine will be fitted with prosthetics in the next few weeks.

In the meantime the three-year-old must learn to put weight on her stubs.

&#8220;That&#8217;s what they call them,&#8221; said her grandmother Deanna, an EMT and the head of the local ambulance service.

The &#8220;stubs&#8221; are what remains of Kyra&#8217;s feet. Surgeons at Sacred Heart Medical Center amputated most of the toddler&#8217;s feet in June to remove dead flesh authorities say Kyra suffered as a result of abuse inflicted by her mother and mother&#8217;s boyfriend at their Hells Gulch home.

I noticed in the previous posted article, it stated that Kyra now lives with her father. But this local article states that the girls live with their grandparents.
Unless maybe their Dad lives with his parents?

Just wanted to say thank you to everyone that has been keeping us updated. This is one of those cases that stick with you.

It sure has stuck with me. It is sooo sad. Yet Kyra is sooo lucky to be alive. Thank God for that person that called the police for a wellness check on her!
