Occasionally the defense may choose not to make a closing statement. If so, the plaintiff or government loses the right to make a second argument.

That's kind of general, so I quit being lazy and looked it up for Idaho and found this

CLOSING ARGUMENTS
After the judge gives the final jury instructions, each side will have an opportunity to make a closing argument. Because the state has the burden of proof, the prosecuting attorney goes first and last during the closing arguments. In your closing argument, you may tell the jury what you believe their verdict should be and why. You can argue what the evidence shows, why the jury should believe or not believe a witness, what evidence is lacking in the state's case, or anything else relating to the facts shown by the evidence and the application of those facts to the law. During the closing argument, you cannot bring up facts or incidents that were not admitted into evidence.

I agree with both of your points, formerlyme.

Jim Archibald highlighted every possible exculpatory point the defense has to work with in his opening statement. I really, really want Lori put away forever where she can't hurt anyone else so I can't let myself feel sorry for the defense, but I almost do.

I think all doubts have been removed. It is evident LVD not only knew about what happened to the children, but she was impatient for it to happen so she could get on with her mission. Wonder what she sees as her mission now?

Is there something in the James and Elena story that says anything about murders g children and spouses? Why is the prosecution spending so much time on it?
It makes it pretty clear that the times they met up was purposeful, for one thing. It makes it harder to suggest Chad googled Lori because she left something and wanted her mailing address. They didn't just happen to go to the same conferences because of common interests. It pulls the timeline into romantic focus.

It also makes it clear that their intentions were "2 be 2 gether 4 ever." It makes the evidence that neither of them took actions toward divorce, although Charles did, more suspicious. (IIRC that Lori dodged being served didn't come up? Or did it?)

Yes I think it was in Zulema's testimony that Lori was supposed to stay in a hotel with them but couldn't because she had to avoid being served with papers.

2:03 p.m. At the conference, Zulema spoke with Chad about how Lori wasn’t able to make it. She canceled her trip at the last minute. Chad told Zulema that Lori wasn’t there so she could be protected, and the person who was going to serve her divorce papers wouldn’t be able to find her.

2:01 p.m. Smith asks Zulema if she remembers chatting with Chad at the Preparing a People conference in Boise. She remembers. They stayed at the same hotel. The conference happened before Charles died.

1:57 p.m. Smith asks to admit three photos. The first photo shows Zulema sitting with a group of women in a row at a conference. The second photo shows Chad with four women, including Melanie Gibb and Zulema. The last photo shows another group of the women at the conference.

Because they were raised in a culture that told them they were ALWAYS the MOST special in God's eyes. Better than literally EVERYONE "ELSE". They were raised to believe they were part of a very special club with a very special secret, and here they are, burnted out and broke, hating the place they've found themselves in, so they latch on to fairy tales about how important they were in a DIFFERENT life, how amazing their spouse was in a DIFFERENT life, how 6 degrees of Kevin Bacon they were with Jesus in a DIFFERENT life, and they speak in code on 25 different cell phones, all to get back to that "I'm special" feeling they've been missing. IMO:)

They made a deal with one (immunity) and "couldn't/wouldn't" call the other... doesn't seem well thought out, imo.

Clerical error on the indictment, is anybody surprised?

Okay- that was a fair one. They deserved to be reamed for bringing it up moments before, "I rest my case."

My opinion is over all the prosecutors did an excellent job. This case is very complex with 3 victims and 3 people charged, and they and most of the people around them had several names, either from past lives or various possessions.

The conspiracy alleged started in October 2018 and runs through October 2019. But bodies were not recovered until June 2020, along with mail house calls, etc.

Many witnesses were problematic because they were in a cult and manipulated. They were to varying degrees evasive or untruthful because they haven't fully pulled themselves out- or they haven't even tried to by appearances. They are super embarrassed and ashamed and horrified that they were vulnerable, and are not ready to see things as they were.

Witnesses who are like April don't have any information that would bring a conviction. Witnesses like Audrey have great information, but still seem very unrealistic about their gullibility. The witnesses with good information lie to make their motives seem purer or to hide just how poor their judgment was from others and themselves. Then they lose credibility.

I am sure LE tried to get even more value from those witnesses but they couldn't. They were not able to say, "I must have known on some level that this was ending in murder/ murders had occurred. I couldn't let myself see it. When it started to bubble to the surface, I squashed it with fantasies about the celestial world. They made me feel so special! I'm in therapy now because I feel so ashamed! I could have prevented/reported so much sooner."

That would be the ideal witness. Because nobody up close and personal would be a person who did not get sucked in, flattered, manipulated. Right? Less vulnerable people would have separated from the group before they earned the "trust score" (or vulnerability score, as I call it) to have useful information for the prosecution.

I admire this team for the case they put on. They needed a secretary, though.
