At 5:30 Lori says I just went and bought a phone so she had a throw away phone to use (since Charles took hers that am)

I just wanted to comment about the mental health evaluation that LVD was asked to undergo. There were actually 2 different times LVD was asked to meet with mental health professionals to determine if she had an underlying issue that was problematic for CV & their marriage.

We saw the 1 time where she was asked to go to Community Bridges because CV alleged LVD was a "danger to herself or others". This type of mental health evaluation is only to assess that specific topic and whether she needed to be "detained" by a court order for 72 hours for further evaluation and treatment. It is an emergent request because it is an effort to prevent harm to self or others from someone who is having a psychotic episode, or maybe under the influence of drugs/alcohol. This is what LVD attended after going to the police station and being interviewed. The officer even commented that she did not appear to be needing this level of intervention and even gave her hints of how to get out of the evaluation quickly (IMO). LVD probably walked in and said "CV is the one who is crazy - I would never harm him or myself or anyone else" or something to that effect and they had to let her go. The allegation that she was a threat to society or self was not proven so they had to drop it. (I am just assuming based upon her demeanor in the body cam at the police station and MG's statement about passing with "flying colors").

Secondly, there was a court order during the divorce proceedings that was granted to have LVD undergo a psychological evaluation (testing, interviewing, assessment, metrics, reports, etc.) which LVD never showed up for. (based upon information that has been given so far).

Hence, I do not believe we have any real psychological evaluations of LVD and given her patterns of behavior and personality traits I am not surprised. Most people with cluster B (Narcissistic) traits avoid being assessed and seeking treatment as that would prove they might have a "flaw" - hence failure.

“Psyche evaluation? I’m fine. He’s the crazy one.”
“Dead ex husband? My brother had to shoot him in self defense.”
“Missing children? I’m hiding them from threats.”

She must have been stunned when LE refused to accept her story and the court demanded she produce her children. I think it will hit her quite hard when she finally realizes she won’t be able to blithely dance away from this one.

Chad: I did kill a raccoon that day and burn limbs
Chad: I thought I heard someone close but didn't look out after I came in, texted Tammy, went to BYU etc...

Lori: MG and DW came in for the weekend and spriritual conference.
Nothing about Tylee.
JJ was himself. Lori asked AC to remove him and care for him...yeah right. JJ was dead.

If one child is dead, how could the 2nd one be dead without you being complicit?

Chad didn't get a text email or call from AC about burying another child on his property and never noticed...okay no. Hope the LE have proof otherwise.

Doubtful as the risk of upping the information shared would then lead to murder conspiracy learned too great? There are just too many cases that hinge on this one central to work out from MOO to give such a deal.

And the backlash if the prosecutor did such a deal... I don't think even Larry and Kay would agree with.

I skimmed the first half of the websleuths podcast on the case

I thought the experts had two key points

1. The defence strategy will surely be "blame AC" but likely passive - i.e. the accused won't testify, so it will be more a slinging of mud and see what sticks approach. This makes sense because they can't really construct any coherent version. They'll just be trying to raise doubt about precise roles.

2. The murder conspiracy will need to be folded into these charges because of double jeopardy issues. You can't bring another trial on basically the same factual matrix

IMO its pretty clear that at the least, they should be charged as parties to a murder conspiracy, even if AC was the actual killer.

So one suspects those charges will come at some point, and this will all head to trial in a modified version

"I was having an affair? Charles was the one cheating on me. I have proof."
"I was saying crazy things about being a god? That was Charles making it up to cover for his affairs."
"I was threatening to kill Charles? He was the one sending me threatening messages."
"I wanted his 1 million insurance payment? He put 3 million insurance on me. He had the bigger motive."
"I set him up on July 11? He was coming down to kill me that day. Luckily Alex was there to protect me."

Those claims were made by both Lori and her family (MBP and/or SS).

I wondered what thoughts everyone has about JP's strategy at the prelim, emphasizing that JJ had difficulty bonding with males?

I think I know where he's going with the MG and LV were close as sisters. I think he's going to say LV was the murderer and even Alex and MG didn't know her, despite being super close, she never shared her secrets with them, or with CD. She pulled the wool over all their eyes, and was an adept liar.

Perhaps the bit about male bonding was that LV killed JJ because she knew he wouldn't want to live with CD. He seems to be sowing seeds also for Tylee not being easy to get along with.

These are not my opinions of the truth, but my thoughts about his trial strategy.

Maybe he will say it was LV who took Alex's phone to Chad's property. He seemed to want to create the impression of a great friendship between Alex and Chad, such that Alex could be trusted by Chad, and emphasized that Alex was not necessarily with his own device.

I don't have any suggestions for how LV would have managed to burn/bury her children without CD knowing. Is he going to suggest the possibility of an unknown accomplice? CD was convinced to send that text to Tammy to cover for what LV was doing?

Just a few ideas. He might be trying to get ahead of LV blaming CD for the murders, since it's common knowledge in her history that she has no loyalty and will do/say anything to save herself and trash everyone around her.

The judge in the Chad Daybell Case ordered that:

"All plea offers shall be placed on the record. All plea agreements shall be reduced to writing or stated in the record. Written plea agreements shall be signed by the attorneys for both parties and by the defendant."

The plea agreements on record is not uncommon, but plea offers being placed on record is unheard of, according to the host panel. Their speculation is that there is very possibly some plea offers taking or about to be taking place.

The judge in CD case has ruled that any deals offered must be entered into the record. Not just deals agreed to but any offered.

They mostly discussed that the order of having the plea offers being put on the record. "I've never seen that before.. it doesn't make sense to me"...as that information as to plea deals is inadmissible in trial. Or.... judge just wants to ensure that an effort has been made for pleas.

(MOO, it could very well be that the offers would be put on the record, but sealed unless it turns into an agreement)

So apparently there has been a New Discovery Filing for LVD concerning an alibi. The bone of contention is that the time is not narrowed down enough to present an alibi. Also, her next arraignment is Sept 10th where she will enter her plea.
