But that's up to the attorneys. LE doesn't get to determine if it was self-defense by just asking the survivors and not investigating the scene.

Agreed - at least in theory. Unfortunately, I think in practice it's a mindset that "stand your ground" policies can all too easily lead to, for civilians and LE alike. Here's an article from the Arizona Republic that outlines the difficulties prosecutors face in challenging a citizen's account of the threat they faced. I'm not trying to go off on a tangent here, but it's a legal conundrum that seems, to me, to be ripe for exploitation by wannabe killers – just claim the other guy was doing something that made you feel threatened, and you're well on your way to 'just cause'. It certainly worked for Lori and Alex. MOO.

So one of their witnesses is a lay witness who conducted informal surveys of residents of Fremont, Madison and Bonneville, and the defense refused to give her name until two days ago. The other witness is also not an expert. Joe Adriany of Columbo Investigations, is ex-law enforcement and also conducted surveys in the same locations in December, simply asking residents if they are familiar with the defendants and whether or not they are guilty. He didn't ask residents if they could set aside their opinions and biases, or if they believed in the principle of innocent until proven guilty, or if they believed the accused were entitled to a fair trial.

Then there is Ironwood Insights, which hasn't provided its report yet, even to the defense.

In his motion to compel, RW wants this report by 12th March so it can be reviewed in time for the hearing to change venue on 22nd March.

Waiting for the day when MM requests funding from the court for his indigent client. CD can't be too happy about paying MM to hang out with LVD for days on end...

Did anyone notice this little dig in his court submission - "there has been an overwhelming amount of local reporting related to Ms. Vallow's actvities in Arizona prior to any relationship with Mr. Daybell. Articles and audio recordings of Ms. Vallow insinuating her right to cause harm to her third husband..."

That would be the audio of LV at MG's house from October 2018 saying she was going to murder JAR (after his death).

Here we go, yesterday's filings - including motions in limine filed by prosecutor, to exclude the defense witnesses from the change of venue hearing.


Question on the motion that was granted in part and denied in part. 3- Section B (Bolded below) Does this mean RW has to provide the content of any of the conversations he had or ONLY written and/or recorded statements? That seemed to be the argument at the hearing from RW is that a conversation doesn't constitute a "statement".

2) The Special Prosecutor shall state whether he personally has met with the following witnesses or prospective witnesses:

3) For those individuals the Special Promoter identifies as having met or conversed with, the Special Prosecutor shall:

A. Identify to the best of his recollection, the date and time of such meeting/conversation with the specific witness and list the names of any other person present for, or party to, such conversation/meeting.

B. Furnish to the Defendant the statements made by the prosecution witnesses or prospective prosecution witnesses to the prosecuting attorney.

C. Furnish to the Defendant copy of any written or recorded statements of the witnesses or prospective witnesses.

“We have prayed for the truth to come to light, but we never thought it would look like this," she wrote. "Tylee and J.J. are completely irreplaceable in our family... There are no words that can capture this loss. Words are just inadequate... Our family will never be the same."

As of now, no murder charges have been filed against either Lori Vallow or Chad Daybell.

However, Vallow has pleaded not guilty to two felony charges of conspiracy to commit destruction, alteration or concealment of evidence. If convicted, each charge carries a maximum sentence of five years in prison.

"Mrs. Vallow is entitled to all the privileges and rights that accompany our cornerstone belief of innocents, until proven beyond a reasonable doubt otherwise," her lawyer Mark Means said in a March 2020 statement. "Mrs. Vallow is guaranteed access to a fair and impartial legal process."

"In the coming days we look forward to the opportunity to work through the Court system to bring a resolution to this matter."

Daybell has pleaded not guilty to two felony counts of destruction, alteration or concealment of evidence. If convicted, each charge carries a maximum sentence of five years in prison.

Chad Daybell and Lori Vallow's next court date is March 22, as their team moves to dismiss the charges, as well as to change venue. The couple's cases have been joined by the court.

Good point, cellphone records will be important to all the cases. Perhaps they were already using burner phones, though.

That same month Chad labeled Joe extra dark, so he had to be in agreement with Lori. If Joe was still alive I have no doubt that they would have used the zombie card on him.

BBM. That is very likely. When Lori visited her friend AR in Hawaii in early 2019 (when she tried to avoid being served with divorce papers), she brought several phones with her, according to AR.

This raises the question for me, why did the FBI release all that info about AC's phone? Seems to me it does potentially prejudice the case. Similarly, MG's testimony. Perhaps someone on here knows?
