I should know this, but did LE (either before or after helpfully cleaning up blood evidence) ever interview JJ? Clearly it would require a specialized interviewer sensitive to his needs, but he’s the only one involved who would have probably told the truth.

Which is why I suspect he was not present at the time.

Children with disabilities react to any change in routine extremely negatively. He went to school that day, after experiencing high drama at home and his father being shot at the house where he was at the time? Even a high functioning autistic child wouldn't be able to just shrug and go to school like nothing happened.

Disconnect there. Of course, we don't know what may have happened at school that day. But it is highly unlikely that LVD would have wanted JJ anywhere around the "planned" attack, if that is what it was...

But, we really don't know...

5:26... we are just now live in virtual hearing. Discussing the new prosecutor from Missouri coming on board at this time. Judge is also asking if Freemont County has approved her. Wood said that Madison County is funding it so he has not talked with Freemont. Judge said he is over Freemont case, so Wood needs to talk to Freemont.

I was watching the hearing on the judges channel. I was about 15 minutes behind real time and just as Woods was confirming Smith did have an established active practice the video went dead and a message that “this video is private” was in it’s place.

Can someone who was watching it live please summarize what was discussed before they cut the feed. Thanks!

Rachel Smith is on the case.

There were 2 concerns about her coming on, namely 1) Is she currently licensed to practice law in Missouri? and 2) She needs to be approved by Fremont County.

In regards to 1) Rachel Smith was sworn in by the court and testified herself that she is currently practicing law in the State of Missouri. This satisfied the court's first concern. In regards to 2) Rob Wood declared that Rachel Smith would be deputized under him, and since he is already approved by Fremont County then as a deputized attorney Rachel would enjoy the same authority as he does in the case. The court agreed, but needs paperwork submitted showing that she is deputized before she can fully join.

I'm sure this will happen before the day is over.

My knowledge of law is very minimal... Is bringing Rachel Smith onto the case indicative that murder charges may actually be on the way or is this the type of thing that the prosecution would do (at least in part) to put more pressure on the defendants to turn on each other?

I'm assuming this is all extremely costly and would only be done if they have 'enough' to try LV and/or CD for murder.

I certainly see John Prior as an attorney who is on top of his game and making prosecutor look bad. I don’t even know why Mark Means shows up. ;)

BBM- Not only that she is licensed there but she has to have an active LAW practice which is a requirement. JP said he thought it was a consulting firm but he said his research was not complete. She testified that she has an active law practice as well as a small civil practice but no criminal as it would be a conflict of interest.

Means and Prior do not look real happy. Maybe they thought they could get something by Mr. Wood and now they know a lawyer with more experience in cases such as the murders of the children, Tammy and others, will know what to do, what to look for and what to watch for. I believe this was a very smart move.

Apparently. That one surprised me. I thought one only had to be currently licensed to practice law in the other state, not necessarily actively practicing law. But the judge specifically asked her if she was actively practicing and was the lead attorney on any pending cases.

I don't know the ins and outs of law, I'm sure it's pretty strict for a reason, but it seems kinda excessive to me. It's almost like making sure a doctor is currently operating on someone before they're allowed to practice medicine in another state, rather than just having a medical license.
