BBM- Not only that she is licensed there but she has to have an active LAW practice which is a requirement. JP said he thought it was a consulting firm but he said his research was not complete. She testified that she has an active law practice as well as a small civil practice but no criminal as it would be a conflict of interest.
I believe the point she made of not having a conflict of interest in regards to not being a defense attorney in any cases. She stated that she was a prosecutor.

It actually makes me wonder if she is LDS. Has a connection to Idaho. Why did they pick her out of other, just as qualified folks...
Yep, especially with the name of Smith. Well, maybe it won’t hinder the case at all.

Yes that beast (in the best sense of the word possible) of an attorney is her.
Prior and Means stand no chance really.
Never did, less so now.

It seemed to me that this was way out of the league of Means and Prior. No offense to small town Idaho attorneys...the team LVD had in the beginning from Boise seemed far more qualified for a case of this magnitude.

Where were Tylee and JJ if Charles was killed immediately after arriving? To me it seems plausible that JJ was in Charles' rental car and that Tylee was told to go join him before the shooting occurred. This way she didn't have to lie about Charles being killed in self defense. I wonder if she really had anything to do with a bat. Lori telling her to lie about it would make her aware of a cover-up. Did Tylee ever believe that Charles was a physical threat to Lori (Lori's sister did)? How about him being a zombie?

LOL, I don't know if I would give Lori the credit for protecting Tylee from having to lie. That would be something an adult who feels that children are not her tools would do.

Yet, interesting thought. It has been noted how quickly after the shots the car would have to be on the road. It is a brilliant consideration that the car was on the road well before shots were fired.

I love Websleuthers! What interesting ideas about the whereabouts of Bailey and the whereabouts of Tylee when Charles was killed. We may not have reason to be sure Tylee was in the house, let alone wielding a bat, just before shots were fired.

It was stated in a prior post a few days back, that Mr. Wood used the recommendation of Vera Causa Group. This is the group he hired to serve as consultants. Vera Causa Group recommend Attorney Rachel Smith.

The reference is pretty far down the article.

I feel awful as I believe I was the OP that made a joke and said that. My :pemoticon didn't give enough to let y'all know I was just pointing out with sarcasm how ridiculously often he was there vs. not there, and documented by our very own SleuthD (vs. the other way taken that I didn't want to see dailies)

So much to learn from dailies, e.g. MM and JP there the same day!

Apologies to the entire thread for my bad taste and humor affecting the flow of the thread, and especially to you @SleuthD-o-doubleg :( so sorry and so thankful for your dailies.

Each time I read that MM is in the building, it puts a smile on my face. Who knows what is going on in there! But as I imagine it, it is a humorous, rhythmic reminder of just how much Lori seems to need attention, and the amazing well of people who seem ready to provide her with it.

There is some tragedy. How can poor Lori shop for wedding #6 now that she has been denied a cell phone? The naughtiest sleuther in me loves reading that update.

TL: DR
Rachel Smith is on the case.

There were 2 concerns about her coming on, namely 1) Is she currently licensed to practice law in Missouri? and 2) She needs to be approved by Fremont County.

In regards to 1) Rachel Smith was sworn in by the court and testified herself that she is currently practicing law in the State of Missouri. This satisfied the court's first concern. In regards to 2) Rob Wood declared that Rachel Smith would be deputized under him, and since he is already approved by Fremont County then as a deputized attorney Rachel would enjoy the same authority as he does in the case. The court agreed, but needs paperwork submitted showing that she is deputized before she can fully join.

I'm sure this will happen before the day is over.

Just one more thing - this currently only applies to Chad's case. Court reserved ruling in regard to Lori's case.

I sensed Scott (Crime Talk) was insinuating there's a bit of a comedy show going on in Idaho. He was very gracious and used code to described how Wood must be feeling about bringing in help. He called it humbling but I sensed he really meant embarrassing. With all that's gone on in this case, over a year on Woods own hands, hes just now figuring out he needs help? I know everyone feels the same about these two criminals but I would not be surprised if the prosecution blows this case.

I dont think that at all about Woods. JMO and I am not a legal person or have legal background, so just basic thoughts here.

I think he may feel humbled, but NOT embarrassed at all because I
think he is doing what he feels is best for Justice for JJ and Tylee. ( and TD also)

I also believe, in regards to the above remark that it has been over a year, is because the recent autopsy reports, possibly even toxicology reports now being completed, which is why he NOW brought in an experienced crime prosecutor.

He wants to be sure he can get justice as he only has ONE chance at it.

I just want to echo, I also have faith in him. I’ve mentioned before he’s done well with past cases. Though this one definitely has a lot of twists and turns. But even Batman needs backup.

MM's wifey might be getting annoyed. Seems like MM is spending an inordinate amount of time with LVD. What about the rest of his practice? It doesn't seem "normal" to me that a criminal defense attorney spends almost every single working day with one client.

Maybe he has other female incarcerated clients there.

And is there a "next" court hearing date? I have next a status hearing for both on 4/7/21. Is that still good?

At the present time it's in relation to Chad only.

Maybe Lori's already spilled the beans? It's all very confusing at the moment with sealed filings.

I'm just going into hypotheticals here. Say Lori confessed already to get death penalty off the table (let's ignore that she's translated and can't taste death, or something :rolleyes: ). How would this affect the prosecution of Chad? Can they pronounce judgement and sentence Lori if he's denying everything and wants to take it to trial? What if her - hypothetical - confession, maybe backed up by psychological evaluation, is that this was a folie-a-deux and he masterminded everything? I think striking a deal with Lori could be complex from that point of view. Chad is presumed innocent until trial finds otherwise. It might require the assistance of a complex case prosecutor to navigate prosecution of one party in a joined up trial. Gives me a headache trying to work it out.

Next hearing date is unchanged Niner.
