I agree with snoflake. Police show up at a scene where one man has been shot dead inside the house, the other is sitting on the curb with a bump on his head, and there's a rifle and an aluminum bat inside leaning against the wall. There are no witnesses to the shooting present.
There were no witnesses to the shooting because (according to AC) Lori had left with Tylee before the shooting occurred. I'm not making a judgement in this post about whether Lori should or should not have left with Tylee at the time that she did.
But Lori and Tylee had to have left while her brother was supposedly being assaulted the first time, not the alleged second time - because if we are to believe AC's story, Lori and Tylee were gone before the shooting, and that's precisely when the shooting occurred. Maybe there was a long stand off of some sort, where AC was swinging and missing a lot, during which Lori and Tylee fled, but that's not what AC described.
Even if CV had in fact taken the bat from Tylee earlier, and in the midst of a fight with AC had hit AC with it (causing an injury that apparently wasn't bad enough to prevent AC from going back and getting his gun). Idk where the gun was located, but from AC's account it doesn't sound like he had it right next to him. There is no simply no evidence to prove that AC didn't just shoot a possibly empty-handed CV when he returned with the gun.
Who knows what CV was doing when AC returned with the gun? Nobody else was present. CV could've just been standing there "enraged". It certainly would seem foolish to have chosen to attack AC a second time - this time while AC had a gun. But if AC says CV was coming at him, there's no one left alive to dispute the claim.
It's just a he-said, .... And now it's not even a he-said. But to me AC's account doesn't seem sufficient for PD to just walk away and say, "okay, had to be self defense". So
they HAD to have found lots of other evidence which supported AC's claim.. right? After all, it's not like he's ever done something like this before.. oh, wait..
If I called the cops to my house, and they found me sitting outside on the curb with a bump on my head and my wife shot dead inside, with an iron skillet nearby and with my shotgun leaning against the wall, I don't think they'd be all that eager to believe my claim of self defense (even if a witness who had been there earlier said my wife had hit me in the head with the skillet).
I'm not saying CV is innocent, or even that he wasn't "mean". Just that we don't know, and probably never will. If I'd been through what CV'd been through with Lori over the past year, I might be pretty mean too. Given AC's background, his relationship with Lori, and the mounds of the evidence of Lori's mental instability and threats of violence, I don't believe AC's story.
