I think they think this judge is not bowled over by Lori’s charms haha and I think they’re right.

I wonder, though, if the bail hearing would qualify as a “contested proceeding” under the rule. If so, they can no longer ask for disqualification “without cause.” It sure seemed like a contested proceeding to me...

Interesting. So is there a small chance the motion will be thrown out and they won't get a new judge? Who decides this motion and who assigns a new judge?

Exactly what I would like to know??!.... This motion (the fact that it exists in the way it's written) seems soooo weird to me!!

Part of me wonders if this is just Lori's pathetic 'Defense Team' just pulling a stunt?.... Making it look like they are doing something/ have something,, but in reality just royally screwing up their case.... IDK, their website is such a joke.... seems like a bunch of bumbling idiots.

The motion seems very routine to me. I just think the bail proceeding ought to count as a “contested proceeding,” in which case the motion is too late and should be denied.

Most likely this issue has already been decided in Idaho and the prosecutors already KNOW whether the bail proceeding counts. So I suggest we all just wait and see if there is an objection/response filed to this motion. If not, I’m sure it’s because the bail proceeding (although contested) doesn’t count for whatever reason.

Probably the current judge would be allowed to decide this motion (as it’s routine and doesn’t accuse him of any bias). I’m sure if it was a motion to disqualify him WITH cause it would go to another judge.

Quoting myself. I would love to hear thoughts from any legal folks such as @AZlawyer or @Mormon Attorney on this move by Lori's lawyer to ask for a new judge. If I'm reading the rule correctly it seems that the defense has the option to request a new judge once without giving cause, as long as they do it in a timely manner. I wonder what their strategy is for changing judges? Do they think a new judge will reduce bail?
Per the rule, the prosecution also had the same option. Also, if after the preliminary hearing it moves to district court, both the prosecutors and the defense have the option of disqualifying the judge that gets that case in the district court.

Judge currently on the case is same as in civil custody dispute. Both defense and prosecution likely seek impartial judge for optics.

Wow! How about the line about them preparing a case against the whole group “putting anything to the group as a whole”. PAP has got to be feeling some heat!

Yeah! This feels very much like a deliberate leak on the part of LE..... Even with Justin requesting info.... Unless you've been following the case like we the WSers have been.... The only other people who completely will 'get' this are those directly tied to it!!

No trips to Europe for a month either! I'm hoping they won't hold packages from the UK/EU for 30 days though???.... I have jewelry orders (for my shop) coming from there.... :(
