In the docs he says the second warrant (Dec 19th) was to search Alex's apartment "next door".

We know Lori's apartment was #175, Melani's was #174 and Alex's was #107.

I wonder why Melani signed a one year lease if she was marrying IP who already had an apartment.

Not sure why it says "Next door".

So were they searching the next door apartment (MBP's) or Alex's or even IP's I wonder? Alex's I would think, as he had died recently.

Lol. For real though, what possible facts could he be referring to? Is he going to try and pin everything on Alex, and claim LVD is a victim? That would seem stupid. I do think something in the evidence that was handed over during the initial discovery will be the "new facts", but at the same time, I think Mr. Means is looking for ways to get her off on some technicality. I can't think of one thing that would make her look like she is less of a risk or deserves her bail to be reduced. Please, fellow WS pals, give me something to ponder during home quarantine. Share your thoughts of what these new facts could possibly be.

My opinion leans towards your thoughts here:

Maybe he's going back to this exceeds "standard bail schedules" (particularly when her bail wasn't reduced in Hawaii). Or maybe this doesn't play a part in the legal argument now? Heck, I dunno... I'm just guessing.

Unless LV has some sort of underlying condition that makes her more susceptible to the virus... I can't imagine COVID-19 would be the new facts that "recently came to light".

Maybe one of our resident lawyers can weigh in here but i dont think its as simple as a lawyer just deciding to dump a client because they ran out of money after they accepted the initial retainer. They need better cause than that to withdraw from the case. Also I think the state will reimburst some of their unpaid fees so they are not working for free.
The problem however might be that chad married her and she wont be considered destitude until both their reserves are drained.

A lawyer can withdraw if they are not being paid. They have to do it in sufficient time to not jeopardize their client's rights. Depends on how far along they are in the process. For instance, in a case like this a judge would have to decide if withdrawing 3 or 4 mos before trial, or 3 weeks, or 3 days would put their client in jeopardy. They don't have to accept and assigned counsel appointment.

I expect Lori's defense strategy will be loaded with religiously motivated motions designed to design a mistrial, so buckle up. If they're really crazy, and they are, they might claim that a judge is a clandestine member of Lori's religion or is a descendent of someone who is. I have some specific ideas about how they could disqualify any judge based on:

-Lori's belief in multiple lives (grounds 1, 2, 3 & 4)
-Lori's affiliation with LDS (grounds 1 & 2)
-Lori's high-profile "cult mom" reputation (ground 4)(maybe even 1, 2 & 4)

Interesting. I'm expecting the opposite-- no crazy religious beliefs will be brought up in court by the defense IMO. Instead she will try to claim someone else took her children and she has no idea where they are now. Maybe she will claim (through her lawyer) that JJ's grandparents are hiding him and they are persecuting her through the police and courts out of spite because her brother Alex shot Charles. And she might keep saying (through her lawyer) that Tylee is in college somewhere but is an emancipated teen and stopped communicating with her, so she doesn't know where she is either. Neither explanation will make any sense but I expect she will double down on whatever explanations she has given to her lawyers and followers already. I'm basing that on Lori's past history of interactions with the police and others outside the cult.

Some examples:

1. When she talked to the police after Charles was murdered she knew not to mention any religious beliefs at all and she blamed the victim. She made up a bunch of lies about Charles being abusive and mean. She had been telling her friend in Hawaii the same lies and had been lying to her family saying Charles was cheating on her before he died. None of her lies had a religious component.

2. In early 2019, after she had stolen money from Charles' business bank account, changed the locks on the house, removed all his clothing, his business computer and anything of value from the house, taken his truck so he couldn't get back from the airport, canceled his flight, hidden Bailey's collar and JJ's meds, JJ's clothing and i-pad, etc, Charles took her purse and car keys to try to prevent her from leaving the parking lot of JJ's school so that she could be served with the order for a psych eval. Lori went straight to the police (with a friend) and told a story that made herself the sympathetic victim and made Charles look like a controlling/abusive spouse who stole her purse. She didn't mention any religious beliefs to the police then.

3. Lori has passed at least 2 psych evaluations in the past, which indicates to me she knows not to bring her crazy religious beliefs up. The first one we know about was in 2011 during a joint child custody case involving Lori, Charles, Charles ex-wife Cheryl and Lori's ex-husband Joe Ryan. Lori tried to make an excuse to get out of that one, but in the end she ended up showing up early for her appointment and as far as we know nothing was uncovered. The 2nd psych eval she passed was in early 2019 right after the purse incident- she was in and out within a matter of hours. If she had mentioned anything about Charles being possessed by a zombie named Nick Schneider I believe they would have held her for observation.

4. During that same time period as the 1st psych eval mentioned above a judge ordered cameras in Lori and Charles' home because of accusations of some kind against her (we don't know what the accusations were). Nothing untoward was ever captured on camera. IMHO Lori knew she was being filmed and was able to control herself as long as the cameras were there.

5. We have records of Lori talking to JJ's school and other people such as the dog trainer and nanny. She knows not to use her religious beliefs as an excuse for her behavior with them. She makes up other lies instead. Sometimes pointless lies-- such as telling JJ's school Charles committed suicide and telling the dog trainer that Tylee was already in college in Idaho when Tylee was at home and would move with them. She lied to make herself seem like a victim who was forced to move out of state and uproot her children's lives because of "circumstances beyond her control" when the reality is she is making choices on where to move and what she wants to do.

Lori is very cunning at this lying game and has seemingly been doing it all her life, never accepting any personal responsibility for failed marriage after failed marriage or anything else that happens to her. When her 2nd marriage ended she told a friend that Colby's father didn't want a relationship with her and Colby. We don't know the truth of the situation, but she was the one who filed for divorce in that marriage. I think the wild religious beliefs are only shared with people they perceive share their beliefs and will accept that as an excuse. Believing your children and/or spouses are zombies has never been grounds for murder and it never will be. Lori and company are well aware of that IMO. I expect instead of revealing their wild beliefs we will see more wild accusations against other people such as the ones made against Brandon in the letter from Melani's lawyer.

So... IP was leasing 106 or 108 when they searched? Which would imply that MBP and IP met after she moved up there. Maybe he even finished out his lease.

Exactly. Her lawyer's defense will be SODDI (Some Other Dude Did It) all the way. She will blame her accusers for JJ and Tylee being missing. Any witnesses put on the stand to tell about Lori's "zombie" beliefs the lawyer will attempt to discredit the witness rather than arguing against what the witness says. These poor family members who have already suffered for months not knowing where JJ and Tylee are will be accused of all manner of false accusations. We should brace ourselves for more disgusting lies with no hard evidence coming from the defense. It's all she has. She can't argue against the charges by producing the kids or presenting positive evidence of her innocence, because if she could do that she wouldn't still be sitting in jail. MOO.

So they searched Alex's Rexburg apartment a second time on 19th Dec. Did they believe the kids may have been there between 27th Nov, when they previously searched it and 19th Dec? I wonder if they also searched the house where he died on the 12th Dec in Az? They surely would not just search the Rexburg appt and not the Az home would they? I do wonder about Alex's wife and what she must know. Do many posters believe Lori can produce them unharmed?

It's very interesting to me that LE searched that apt again on Dec 19th and then on Dec 20th the case of the missing children was announced to the public for the first time. Alex's unit was empty in the Nov search except for a couple things in the garage. What could they have found on that Dec 19th search that made them ramp things up by going public? I wonder if maybe they brought cadaver dogs in during that visit? Also, since Alex's unit was next to IP's unit and Melani stayed with IP that afternoon, I sort of wonder if police had a warrant to place Melani and IP under surveillance and we haven't heard about that yet. Walls are thin in most townhouse style units like this and it would be easy to plant listening devices in an adjoining unit. Also, why would Melani spend the day at IP's apt because of police searching next door to there? Did Melani and IP hope to hear what police were saying/doing in Alex's apt? IP went immediately to check the apt after LE left. I think he was checking for any info he could report back to Melani. MOO.

Tamara "Tammy" Douglas Daybell passed away peacefully in her sleep on Saturday, October 19, 2019 in Salem, Idaho. She was born May 4, 1970 in Pasadena, California to Ronald and Phyllis Cooper Douglas. She enjoyed growing up in South Pasadena and Anaheim in southern California with her Cooper cousins and living close to Disneyland. She and all her siblings were chartered members of the mentally gifted students at Cerritos Elementary School, enabling her to develop creative thinking skills she used through the rest of her life. She loved putting on “family” shows that she produced and directed, corralling any family members she could. It was a happy childhood with many memories, including trips to the beach, camping at Elfin Forest, and Calico Ghost Town.

When Tammy was 13, she moved with her family to Springville, Utah. She was an excellent student, and she played the drums and clarinet in the Springville High School Band. She was the Yearbook Editor her senior year. Most of all, she was known for her friendly smile and kindness to everyone. Tammy shared a love of books and reading with her family. She created her own library lending books to her siblings with actual library cards and fines when they weren’t returned on time. She loved classic musical movies and learned the songs and words, then she and her siblings would reenact them. Hilarious!

During the summer following her freshman year at Brigham Young University, she met Chad Daybell. They quickly fell in love and were married on March 9, 1990 in the Manti Temple. While Chad continued his schooling, Tammy supported the family by working as the secretary for Springville’s Parks Department. As part of her job, she typed thousands of handwritten burial records into a computer database. This helped spark her interest in Family History, which later would become her favorite hobby. Throughout her life she submitted more than 100,000 names for temple ordinance work. She even managed to teach her computer-challenged mother to learn and join in the gathering of family history – a miracle!

After Chad graduated and took a job in Ogden, Utah, Tammy became a full-time homemaker and mother as their family began to grow. She loved her children deeply and encouraged them in countless ways. She often took the children to the public library and helped them develop a passion for reading. The family returned to Springville, where Tammy later became the computer teacher at Art City Elementary.

Tammy was a computer genius who also had a talent for graphic arts. In 2004, she and Chad founded Spring Creek Book Company, and Tammy wore many hats as their company grew, juggling her role as Chief Financial Officer with designing book covers. She was the true backbone of the company, and she was proud of the dozens of books the company published over the years.

In 2015, the family moved to Salem, Idaho and she became the assistant librarian at Madison Middle School. She later became the librarian at Central Elementary School in Sugar City, Idaho. She was treasured and loved by the staff and students alike.

She served in numerous capacities in the Church of Jesus Christ of Latter-day Saints, including as Stake Girls Camp Director and as Young Women President. She also served in Relief Society and Primary presidencies. She loved the women and girls she was privileged to serve with.

Tammy’s true focus throughout her life was her family, from serving a delicious dinner each Sunday to remembering every birthday and holiday with gifts. She also loved all sorts of animals, but she especially loved Indian runner ducks. She also raised pigeons, chickens, cats, and rabbits, knowing each one by name. She loved gardening, cooking, and playing games with the family. Her laugh will be remembered and cherished.

Tammy is survived by her husband and five children: Garth Daybell, Emma (Joseph) Murray, Seth (Makayla) Daybell, Leah (Adam) Murphy, and Mark Daybell, who is serving an LDS mission in Johannesburg, South Africa. She was a doting grandma to Chase Murray and Jordan Murphy, with a third grandson, Oliver Daybell, on the way.

She is also survived by her parents Ron and Phyllis Douglas, and four siblings: Michael (Kiffon) Douglas, Samantha (Jason) Gwilliam, Matthew (Cherylyn) Douglas, and Benjamin (Kelsie) Douglas, and numerous nieces and nephews who loved her dearly.

Funeral services will be held Tuesday, October 22, 2019 at 11 a.m. in the Spring Creek 6th Ward Chapel located at 860 East 200 North in Springville, Utah. A viewing will be held on Monday evening from 6 to 7:30 p.m. at that location. Interment will be in the Springville Evergreen Cemetery.

A memorial service will also be held Wednesday, October 23, at 1 p.m. in the Henry’s Fork Stake Center, 2001 North 3000 West in Rexburg, Idaho.

Hmmm seeing as I don't think she likes jail, even though Chad has in the past touted being joyful during the struggles of the end times, no I don't think it's possible. And the #1 and 2 reasons her bail won't be lowered. Quite a few other reasons as well, but those 2 stick out like a sore thumb.

I was just going to post this...premeditated looks like JMO .

I don't even have words for ordering a ring and gown before the current wife is gone, but Kay and Larry have known about this order and Lori's search history for a very long time. And Lori/Chad knew they knew.

Hey Chad, how DO you explain this to Tammy's family??? We'll wait.
