I hope that is not an issue for appeal.
He is probably lucky there are not many blacks on his jury. Of all the people that I am friends that are the angriest at JS for doing this hoax---are my black friends. They really take it personally that he does such an embarrassingly stupid act that brings other racist actions into question. I don't think they'd go easy on him as jurors.

Murray testifies she was informed by her partner that the victim of the battery they were investigating was Jussie Smollett, an actor on the TV show "Empire." She says she had not heard of him or the show.

Murray interviewed Smollett at Northwestern Memorial shortly before 6 a.m. on the day of the attack. He was with his creative director, Frank Gatson. "Due to the sensitivity and trauma that this crime would've put Mr. Smollett through we wanted him to be comfortable," she says"

"The injuries were minor," Murray says. Smollett had scratches and redness to both of his cheeks and "redness to his neck area." He also said "he felt soreness to his back and rib area." She had an evidence tech take photos."

"Jurors were shown a series of photos depicting the injuries Smollett had from the attack. Murray says she asked him to recall the details of the incident... He said two people attacked him "while he was on his way home from getting Subway food," and that he didn't know them."

Murray says she asked Smollett to tell her what happened--Smollett said he went to get food and was attacked--he said that did not know his attackers.

Murray said Smollett described the attack to her--Attackers yelled racial and homophobic slurs. Murray: Smollett felt that his clothes were wet and told detectives that his attackers poured bleach on him. He was unable to observe one of the attackers because he was behind Smollett at all times. Smollett described the other attacker as white

Smollett told Murray he was trying to get back to the lobby of his building when he heard one of his attackers state, “Empire f----t Empire n----r!" To which he replied "What the f--- d did you say to me?" One of the attackers then responded, "This is MAGA country, n----r!"

Murray: "Mr. Smollett related that he was then struck to the left side of his face and he and his two attackers fell to the ground and he was kicked in his back an rib area. He said that he felt a tugging around his neck that the attack stopped suddenly and the attackers fled."

"Smollett described one of the attackers was a male white of unknown age, about 5’10 to 6 feet, 180 to 200 pounds, wearing a dark colored jacket and dark pants and a ski mask. Murray said Smollett could tell the attacker's race because of the "open eye hole" in his ski mask"

"Murray says Smollett told her about the racist letter he'd received at "Empire" set, as well as a homophobic phone call where an anonymous called said, "Hey little f----t" before he'd hung up. The letter was still under investigation by the FBI, Murray said."
 
Jussie Smollett is a real piece of work. He reminds me of Jodi Arias. Thank god he didn't kill anyone, but he is so gd childish and obstinate. The charade he staged is outrageous. I am from Chicago and I remember when the story first broke. Initially, I felt so sad. But when the details started to come out, I remember thinking to myself, this doesn't sound like a Chicago crime, as weird as that may sound. Everyone knows all about the horrible crime we have in Chicago, and no doubt there is plenty, but his embellishments about MAGA country, the extreme cold, the subway sandwich, etc... it just sounded off. Chicago PD was, and still is, worked to the bone. That this loser wasted so much of their time and contiues to insist his truth and is now accusing CPD of bad stuff is disgusting.

Smollett declined to give police his cell phone, Murray testifies, even though she explained to him they would not keep it long and that it was important to establish a timeline of the crime. Also the attack could be related to the homophobic call he says he received days earlier"

Murray concludes direct examination by saying she had a phone interview with Smollett on Jan 30 and told him the POD camera did not capture the attack. "Mr. Smollett was upset by this ... he was upset that the attack was not captured on the camera."

Murray: Smollett declined to turn over medical records. She wanted them to document the injuries that he sustained. She requested a cheek swab to try and pick up any DNA on rope--and Smollett declined that as well.

Smollett declined to turn over cell records. Murray said the records could be helpful in determining who made that threatening call the Saturday prior--and establish a timelines of events

Murray said CPD wanted Smollett to feel as comfortable as possible.

Murray returned to do a "walk-through" with Smollett. It was so cold out that officers did the walk through from a car. Smollett had two security guards with him--despite being in a car with several police officers.

If JS had just signed a paper, admitted guilt, paid his fine and moved on, no one would even care now. He has stead fastly refused to acknowledge any part of this situation.

The fact that he was terminated from his position in his show, was significant to me. A bit too much drama for them.

JS really needs mental health assessment. I see this as the next move.

On cross, Murray testifies she was aware that Smollett did not call the police, his manager did. She says she also understood that he wanted to keep the whole thing as private as possible.

Q: Were you aware Mr. Smollett was an actor? Murray: Yes. Q: Are you aware that actors sometimes like their privacy? Murray: Yes. Q: That they sometimes have information in their phones that they cannot disseminate to others? Murray: I guess so.

On re-cross, Widell gets shut down several times when she tries to ask about Smollett's aversion to releasing his medical records, which Murray had said she would have kept strictly confidential. "Are you aware that there were leaks in the Chicago police depart ---" OBJECTION!

Widell: Are you aware that 50 people at Northwestern were suspended for -----" OBJECTION!!! Linn sustained both and ordered the jury to disregard the questions, saying they were "far afield" from the issues of this case. Murray is done. on a short break"

Next #Smollett witness is Detective Robert Graves. The indictment charges Smollett with falsely telling Graves on Feb. 14, 2019, that he was a victim of a battery. That was the day the Osundairo brothers were arrested, and the day of Smollett's Good Morning America interview.

"Graves, like his partner, Murray, says he didn't know who Jussie Smollett was when he was assigned to investigate the battery. He went to the scene first, then to the hospital."

"Graves becomes the latest witness to testify that the weather that day was not just cold, it was the POLAR VORTEX. Murray said the same, as did Detective Theis. Prosecutors mentioned it like 62 times in their opening statement. I'm guessing they all watch

Graves says that on Feb. 14, the lead detectives told him "Mr. Smolett was going to come in to be re-interviewed" and they wanted his assistance. This was just after the Osundairo brothers had been arrested at O'Hare.

"Graves says that in the new interview, Smollett’s description of the attack was “mostly consistent” with his previous statements. But his description of the attacker changed, now described calling him "pale-skinned" rather than "white." "

"Graves said he confronted Smollett, reminding him he had previously described his attacker as a male white and never said pale skinned. Smollett replied, "Well, he acted like he was white by what he said." Graves said he was "upset that (Smollett) was now changing his story."

Remember: Smollett now knows that the Osundairo brothers are in custody, and they definitely are not white.

"Smollett changing his description was self-serving, prosecutors have alleged."

"Graves says Smollett was shown photos of both Osundairo brothers. He identified Abimbola by name, says he's his personal trainer and friend. He said Abimbola was straight so they didn't have any issues over girls, no money issues. The other brother he said he didn't know well "
