If I'm frustrated, I can only imagine what Toni's family is feeling. Here's some of what the article says:

Defense attorneys filed two motions today: one seeks to dismiss the five first-degree murder counts of the indictment because they do not specify what acts caused Keller's death, which prevents Curl from adequately preparing a defense, and the second asks for a hearing on whether testimony from a witness the state intends to call – Daniel McDevitt, an expert in criminology and major case management – should be allowed.

A motion filed by prosecutors requests that the court bar testimony from Dr. Jayne Braden, who conducted a psychological evaluation of Curl. Her report says Curl has a tendency to "distort or fabricate information," according to court documents.

The state plans to bring up at trial a statement Curl made to police that ties him to Keller's death, according to the motion. Braden's observation might cause a jury to think she believes Curl's statements to police are false, when she has not offered an opinion as to whether what he told police is true or not.

The next hearing date is Nov. 13, 2012

Hi all. A little background and then some information that may be interesting/helpful.

I live in IL and two of my three children attended NIU. My son graduated before Toni's murder. Both were on campus during the 2008 horrific shooting incident. My daughter lived blocks from campus when Toni's tragedy occurred. I remember the absolute drop in the pit of my stomach when I heard there was a missing student. The horror of this murder on the heels of the shooting was more than many thought they could bear. All who were on campus or had loved ones on campus during these tragedies were affected and will always remember it. However, we always remember those who have suffered so much more, either with their own lives or the life of someone they loved very much. Toni and her family are prayed for and thought of more than they can know, along with the victims of the shooting and their families.

I just found WS about a month ago when Harsha Maddula was missing in Chicago and just found this thread today. If Toni's family is reading - we haven't forgotten Toni. She will always be in the hearts of those who walked through that terrible time with you.

Now the info: there is online court records for DeKalb Co. It is relatively new (last yr or so?) as it used to only show traffic and misdemeanors. Anyway, the place to go is here:

My son is a current NIU student, who lives right across the street from the park where Toni was killed. It seems like there are frequent crime incidents around the campus (I'm on their "email alert notification" list) but maybe it's that way on most large universities, and I just don't hear about the rest. Thankfully, few are of the magnitude of the mass shooting spree that took place in 2008, but even a single death, like Toni's, is one too many.

I do think every college has some crime issues. Stolen property, drinking issues, vandalism, fights, etc seem to occur at every college. If you don't know someone attending there you won't often hear of them.

Unfortunately, on top of those things NIU had the shooting (beyond horrific) and Toni's murder (so incredibly tragic). They caused such an atmosphere of fear at the time, but they also made the college review it's emergency procedures and made the students more aware of their surroundings and how to stay safe. It also bonded the students to one another more closely and made them more willing to look out for each other.

Every parent worries when they send their children to college, esp if the college has had "the unthinkable" happen - it takes away the "that could never happen here" line of thinking. But that isn't all bad, kids often feel invincible and this is a clear message that they need to be aware of what is going on around them. It is finding the balance. Knowing bad things can happen yet not being held back from letting our kids follow their dreams.

The truth is that unfortunately, it can happen anywhere. We do our best to teach our kids how to be safe without giving the a crippling fear. (why, when we see those cute little chubby babies, no one warns us that parenting is HARD sometimes? :) )

All this to say, hi to another NIU Mom and I pray your son enjoys his college experience and finds a career that he loves!

I am somewhat ticked off. Last week it was announced that Curl's hearing set for tomorrow (11/13) would be delayed because he has an earache. Yes, really.

Today I was reading a DeKalb news website and saw that the SA has been defeated in his election and he is not cooperating with the newly elected SA. POLITICS!

They have told Toni's family not to count on the trial beginning 12/3 either.

Any opinions?

I'm not seeing it anywhere, I am making the conclusion as my opinion. Last week, Curls 11/13 hearing was postponed, and they told Roger Keller the trial will probably not happen 12/3 either.

I realize politics plays into anything in IL (probably everywhere) and the new SA takes office Dec 3. Which happens to be when the trial would have started.

In the article, it says old-SA is not briefing new-SA... so *I think* the EARACHE story is complete BS. An antibiotic eardrop would clear that up in 24 hours.

It doesn't appear the outgoing or incoming SA were directly involved in prosecuting Toni's case, at least from the MSM articles linked.

I think they'd be delayed due to postponing tomorrows hearing. I agree in most cases an earache would clear up quickly, if treated right away. Though, I had one a few years ago that I didn't seek treatment immediately, and I was prepared to go deaf in one ear, it was that painful. Took weeks and a few rounds of antibiotics to clear up.

anyhoo, I know waiting stinks, but the last thing we want is to rush this and Curl get off on a technicality of somekind.

Toni's Dad, Roger Keller was notified 11/8/12 that Curl had an earache.

Oh I know, Cubby... I can wait... I am not invested in this by any personal connection (just as an archivist) but when this kind of BS comes into play I just want to expose it and that is all.

Curl is in jail where he ought to be, so it doesn't really matter when the trial happens --TO ME-- but imagine this poor family.... ripped up one side and down the other by the BS BS BS in this case. One BS thing after another.

After the delays we say awaiting the Vaughn trial, nothing surprises me time wise anymore. Though, I agree. The stopping and starting, postponing, delay after delay has to take an emotional toll. And Curl deserves to be in a penitentiary, not in some county jail protected from other inmates.

Hopefully this judge has room on the calendar so the delay isn't too far from December 3rd.

You know what pisses me off.

The night before she disappeared, an apartment building across the street from me burned down. I have a point of reference for the day that she disappeared...and it feels like AGES AGO.

Why the f is this a-hole not in jail yet.

I'm from Naperville and graduated from NIU. I live out west now, so I really appreciate all of the updates on this case.

I'm ashamed to even tell people I'm from IL, with all of the crooked politicians, lousy state fiscal management, and this kind of court system fiasco. (Truthfully, I'm not very happy with NIU as a university, either. OT, but I have the same for the Vaughn murders. I was at the Dells and at the same time both the Vaughn murders and Jesse Davis's murder occured back in 2007. Vaughn was just tried this fall and Jessie's case, not in IL was tried in early 2008. Both murders occured the same time and Cutt's, Jessie's killer was sentenced in Feb of 2008. I have to wonder why Illinois is so last in everything.

Judge Stuckert denied Curl's motion to dismiss, and he will stand trial on the murder charges.

Next hearing Dec 17.

Another trial delay.

Jan 14 is scrapped because of the pros needing some psyche thing.

New trial date is April 11, 2013.

Or maybe the 12th of never. Eyeroll.
