A 9-year-old child accused of causing a mobile home fire that killed three children and two adults in central Illinois has been charged with five counts of first-degree murder.

The juvenile also was charged with two counts of arson and one count of aggravated arson, the (Peoria) Journal Star reported.

The April 6 fire killed a 1-year-old, two 2-year-olds, a 34-year-old man and a 69-year-old woman at the Timberline Mobile Home Park near the village of Goodfield, about 150 miles (240 kilometers) southwest of Chicago.

No child as young as this one has been accused in a mass killing since at least 2006, according to the AP/USATODAY/Northeastern University mass murder database. It tracks all U.S. homicides since then in which four or more people were killed (not including the offender) over a short period of time (24 hours), regardless of weapon, location, victim-offender relationship or motive.

The aggravated arson charge is based on the conclusion that the child knew people were in the home at the time the fire was started. Plead not guilty.

8/24/21 Update: Defense attorney Peter Dluski criticized the police investigation into the incident in a hearing on 8/12/21. Describing the police investigation as “extremely terrible in this case,” defense lawyer Dluski asked Judge Charles Feeney for more time to prepare for a hearing on a defense motion to bar certain evidence from the boy’s trial. According to Dluski, new information about the handling of the case was disclosed on Monday in a deposition of Woodford County sheriff’s deputy Robert Gillson. The lawyer said he wants to look into allegations that the state’s attorney’s office may have overstepped its bounds by appointing a guardian ad litem, a lawyer who would represent the interests of the child. The judge asked Dluski to focus his arguments for a continuance on specific allegations of violations of the child’s constitutional rights. Defense questions about search warrants & how the mobile home was released after the fire meet the standard for constitutional claims, said Feeney, in granting a delay. The defense also is waiting on additional mental health records from authorities. State’s Attorney Greg Minger said the state was ready to move forward with the hearing. If convicted, the boy faces probation & court-ordered counseling. A 9/13/21 hearing is scheduled to review the status of the case.
9/13/21 Update: A half-day hearing is set for 12/3/21 for a 10-year-old boy charged with murder & arson in connection to a 2019 fire that killed five people near Goodfield. December’s hearing, set Monday by Judge Charles Feeney, will argue a defense motion that aims to bar Woodford County State’s Attorney Greg Minger from bringing certain evidence to court. The boy did not appear in Monday’s brief hearing through Zoom, which came about a month after defense lawyer Peter Dluski criticized the police investigation for the case. A court-appointed childhood trauma expert last year found the boy unfit to stand trial. If convicted, the boy could be placed on probation for up to five years, as well as be ordered to complete counseling & therapy.

During a hearing Friday morning, Alwood’s attorney filed a motion to suppress two pieces of evidence.

The evidence in question was a shirt worn by Alwood and the trailer where the fire occurred.

Alwood’s attorney posed questions about a search warrant not being obtained before Alwood’s shirt was given to authorities by his mother and grandmother.

Judge Charles Feeney ruled against the motion, stating that consent is an exception to a warrant because Alwood was being taken care of by his mother and grandmother.

Judge Feeney also denied the motion to eliminate the trailer as evidence.

Another hearing regarding evidence is set for February 28th.

Yeah, excluding the trailer is a BIG reach and makes zero sense. I guess they had to try it either way, who knows lol.

I thought that this was over. Didn’t they declare him "incompetent" to stand trial? Who is keeping this going?

Next hearing is 11th April.

During the interview Kyle Alwood said he understood what a fire can do. Explained how he set a frisbee on fire and described what the night of the fire was like.

2/28/22 Update: Judge allowed a 47 minute interview to be seen at Alwood's hearing. During the interview Kyle Alwood said he understood what a fire can do. Explained how he set a frisbee on fire and described what the night of the fire was like. Next hearing on 4/11/22.
