Day 3 of Tyshawn Lee testimony under way. An important— and reluctant— witness on the stand, an 18-year-old who, as a 14-year-old, was in Dawes Park the day of the shooting and allegedly saw defendants there, and chatted with them before Tyshawn was shot.

This witness is wearing an orange jail jumpsuit, and has been locked up since late August for defying a prosecution subpoena dating back to May. The witness at a court hearing tossed away a subpoena handed to him, and has said he wouldn't cooperate.

Three other witnesses, kids who were then in their teens, who were also hanging out in Dawes Park the day of the shooting, also were jailed ahead of the trial. This guy, who testified that he has joined a gang in the years since the shooting, had by far been the most defiant.

Today, he's been cooperative, speaking clearly, giving "yes sir" and "no sir" to questions from ASA Tom Darman. There was some quibbling before he took the stand about a conversation he had with Darman, in which the witness asked if he would be released from jail if he testified

The other three witnesses were jailed for weeks— including a college student who was arrested on a warrant in this case and hauled out of his dorm room— and only got out within the past few days after attorneys challenged the no-bond holds.

So far, he's testified to descriptions of the three people he saw in the park the day of the shooting, black men in their 20s, and their vehicle. He was within a few feet of them, chatted a little and played basketball with them.

He testified these older guys asked to join their game, and asked who of the younger guys was best at basketball, who got the most girls. He also noticed one of them had a gun tucked into a pouch on his sweatshirt

This witness, however, did not see Tyshawn enter the alley where he was shot, and fled the park after hearing gunshots. He talked to police the next day, as officers canvassed the neighborhood.
