Are they not allowed to put forth their theory of the defense in filings? The state put forth their case in the arrest warrant and search warrant affidavits. Which were unsealed. By Gull herself.

State put forward basic, straightforward facts to obtain the search warrant and subsequent arrest warrant. Not wild theories based on fiction with main objective to cause distrust and doubt.JMO

Surely MW broke some kind of law and charges are pending but if he didn’t why wouldn’t AB file a civil suit? That‘s the only reason I can think of why his affidavit is sealed, unless it’s already proven to be untrue.

I can’t help but wonder if the need for confidentiality and protection around the former D’s recent filings is due to the likelihood of an ongoing investigation into the leaks? MW allegedly claims to be the source of the leak…but is his word credible? The person who could verify whether MW is telling the truth is dead. Unbelievably tragic on so many levels.

I don't know if the judge is "hiding" documents because she " doesn't like" them and isn't the reason for removal of some of those documents because they were filed when B&R were no longer RA's attorneys as they had withdrawn?

I thought Judge Gull ran the hearing very well. Maybe they expected her to lose it and cause a scene after they sat themselves down at the defense table? Didn’t happen. H apparently also tried but was ignored. What has occurred to change things in the last 12 days? When do you plan to turn over discovery? Good open ended questions. We know this from Brad Rozzi's praecipe. He is the one who alerted us to the fact that this was audio recorded when he asked for it. She ignored that filing and removed it from the record. I think it will come out. Under public records request any of us should be able to obtain it but it has to be made part of the record in order for it to even be found so take from that what you will. The audio may prove pivotal. You can't get tone from a written transcript but audio may prove to shed a completely different light on what occurred in there.

Unfortunately these 'antics' have real consequences. Can you even imagine how the families of Abby & Libby would have responded to that sickening unnecessary CS section of their little "Memo". What about the people they named in detail, who have not been named POI by LE?

There are real people with real feelings and lives whom they are trampling all over in an effort to appear as the genius creativity. Yes, they actually state in their response that the legal community claimed their Memorandum was genius? Who says that, really????? Maybe 1st year law students on a paper they are especially proud of, not professional attorneys with 50 combined years of experience.
