Does she have to have a hearing on the motion to recuse or can she just flat-out deny it?

If she refuses to recuse, does the D go for an interlocutory appeal? Or something else?

She can do whatever her judgement tells her to do.

With this situation, I'm not sure what the D does next, should she decide not to recuse.

It's easy to forget that with all filings calling out appearance of bias or unfairness ... the D is also making a record for potential appeals.

I would add that if a person murdered 2 young girls in the fashion as Abby & Libby, they are already insane to a degree, and probably aren't worried or thinking about future trouble.

To be clear, I was not suggesting that a child killer (any killer) isn’t insane. Just it seems stupid to invite the attention of the Odinists into your life / your crime is all.

Thank you for posting this, I wanted to mention MW’s military background but didn’t have an approved source on hand.
So do we think his military background has anything to do with this case aside the fact he sent the things to another military man?

I was living happily with my one poi, until LE came around the corner with RA and brought my house of cards tumbling down. ;) Since then I have to arrange myself with new and different facts, and I'm having a hard time with it. NOW I have doubts - 5 years I had not one.
Without naming anyone, how would you describe your original POI? Just curious.

I believe he is guilty and acted alone but the only question for me is if he knew they were there then how did he find out that information.

He worked in a CVS and had a kid so knowing children were off that day I guess was common knowledge so maybe he just went out there on the off chance and saw a opportunity and took it.

If it was an off chance then when did he prep the scene? There was evidence of a tool used to cut a branch or stick per the LE PCA. Had he been there before? Do Le have evidence of him coming and going in the days or weeks prior? I’d be interested to know. Did the cut stick come from the woods? Cut at scene or come from elsewhere?

The state has filled paperwork asking for the defense to hand over discovery because as of today, the defense has FAILED to offer any at all? And yet they claim to be ready for trial weeks ago?
Come on, this is so unbelievably absurd at this point that I can't understand how it is that anyone believes that they are great attorneys.

I want the girls to have justice. I do. But I don’t want a possibly innocent man railroaded into a conviction. If he did it. He should rot. If he didn’t then he should not. It’s not justice if the accused is railroaded or treated unfairly before his case is heard and ruled on.

R&B filing a Motion for disqualification of Judge Gull. Not surprising to me at all, just that it took them this long.

This should add another few weeks or months for them to get prepared for a real trial.

Per the Franks Memorandum it stated that RA often hiked the trials.
Although he denied ever being on RL’s property.
I think his frequent hikes could have been used to plan the crime, look for optimal points to survey hiker arrivals and departures. best places to hide and abduct quickly , easiest places so cross the creek, closest place to take the girls that would be out of eyeshot of hikers.
He may have even planned to murder on RL’s property because it was beneficial in many ways.
As far as the sticks being cut- I think RA came prepared for that, if it is indeed a fact they were cut recently.
The area is covered with branches and sticks. There are also deer and other wildlife in the area that could have broken a limb or branch off of a tree.

Yes I cringe that they felt compelled to add this information. It’s an over-reach and undermines the credibility of the whole motion.

I understand it seems cringy and I also cringed when I read it!
(I cringed even more when she did not pay B or R billings until Sept 2023.)

Here's the gist I got as I read through it ... (caveat - this is just how it hit me as I read ...from memory...)

the docket's a mess
RCA rules flouted
the bills aren't paid
motions unanswered for months
hearings cancelled on a dime; not rescheduled
the P requests DQ of the D and the Court makes it happen
public disparaging D's as liars
exparte discussions/plans w/ D and w/ LE
conducting court business via text
no competence hearing
public ambush planning
cancelling transport for D's witnesses
6th A decisions based on emotions rather than facts
All decisions without citations or legal reasoning
hearings granted to her local new D but not to the old D
personal social FB (facebook) carelessness
appearance of bias ad nauseum

In context, I didn't see the cringy FB point as undermining but rather as underscoring that JG's pervasive carelessness as to the appearance of bias ... goes all the way to her Facebook. :)

By the end, I was sensing there's issues here beyond bias.
Just brutal.

Let's get this recusal and get this trial back on track for all parties and all families.

He didn't confess to LE interrogators, he confessed no less than 5 times to his wife and his mother, goodness! The two women in his life that know him the best, most likely. They didn't coerce him, they listened, well until his wife couldn't listen anymore and hung up on him. If that doesn't scream credibility I don't know what does. It was from the horse's mouth, a good old-fashion let me purge to the ones I love what I have done. AJMO
I didn't say he confessed to investigators, I said "his people" (meaning family). We don't know if he was coerced, or what frame of mind he was in when he said whatever he said. We do not even know WHAT he said, or how consistent his statements were to his family members. We don't know if the guards were on the other side of his cell taunting him, or scaring him. We've no idea. I'll wait to hear what both sides have to say in court before I decide the statements are convincing of his guilt or not.

It's clear MRC earned some type of LE deal/protection for his cooperation.

Also, the State wants those sanctions Hennessey was offering.

After that, I assume, the D & P can get back to being friends. :rolleyes:

P.S. McL involvement in the Westerman investigation still makes me wince.

Sections 15, 18 ad 21 are very troubling. Definitely what many of us were assuming and not at all what AB was trying to sell with his "snookered and abused" story.
