Judge Gull is GRANTING the Defence Motion Without Hearing in order to reserve the record for appeal as per their request. The D's Motion to Incoroporate Evidence was already included in the threads. She is just GRANTING it.

So, NO CHANGE ... Also no change to the requirement that the present tangible 'proof' vice rumours etc that is actually admissable at trial. Same as before. As she's lready ruled on their previous 'evidence' of SODDI as not being admissable due to heresay etc, the Defence will have to come up with something concrete this time linking another(s) individuals to this crime in order to get SODDI in.

The Defence will still have the option to OFFER PROOF at trial and outside of the presece of the Jury.

We also have new information on what the life of the jury will be like for the next month. Opening arguments start Friday morning in Delphi.




Today was a day off in the Delphi Double Murders trial after a jury was seated on Tuesday. However, things pick back up tomorrow with hearings on several motions that could have big impacts on the case.

DELPHI MURDERS TRIAL: Judge Gull has ruled on a request from #WTHR & other media to release trial exhibits. She will allow some pre-trial exhibits to be released in Ft Wayne next Tuesday & exhibits introduced during the trial will be available at the end of each trial day. 1/

The judge's ruling states media will get only 15 minutes each day to inspect the exhibits. Disappointing but better than nothing. Making the pre-trial exhibits available at a site 2 hrs away from #Delphi in the middle of the trial? Not great, but again better than nothing. 2/


Originally the judge said she wouldn't make exhibits publicly available until after the trial was over. That's not in alignment with court access rules or Indiana's Access to Public Records Act, so WTHR & other media filed a motion to ask the judge to reconsider her decision. 3/


The judge used some interesting language to take a shot at the media (me in particular), stating she considered WTHR's request for the public records to be an "unreasonable demand." More on that later. For now, I'm going home to rest up for a busy day tomorrow in #Delphi. 4/

Back in Fort Wayne this morning as Special Judge Fran Gull will hear a few pivotal motions in the #Delphi double murder trial.

Here’s what she’ll likely consider:

- The prosecution filed a motion earlier this week aiming to prevent the two sketches from being included in the trial. The left sketch was released in 2019. The right sketch was released in 2017.
- A request from the defense for jurors to visit the crime scene near the Monon High Bridge.

Trial is still set to begin tomorrow morning in Carroll County.

#NEW: The full jury in the #Delphi double murder trial has officially been sworn in. It’s made up of 8 women and 4 men. As far as alternates, there are 2 men and women.


#NEW: The defense in the #Delphi double murder trial has withdrawn their request for the jury to visit the crime scene at the Monon High Bridge.


#NEW: On the prosecution's motion for the composite sketches not to be seen by the jury, a witness testified saying he had helped in drawing a sketch, but it is not clear if he is the artist for any of the two sketches released in 2017 and 2019. Gull said she would take things under advisement and have a decision tomorrow morning.

The Carroll County Council has unanimously approved an additional $2.2 million for #Delphi trial expenses. That’s in addition to the original $2.1 million approved last year. It means the trial will cost every Carroll County resident approximately $200. #wthr 1/


Let’s put that in perspective. Carroll Co budgeted $9.4M for its 2024 budget. It has now budgeted an EXTRA $4.3 million in that general budget solely for trial expenses. ($2.1M original + $2.3M today) It’s an astronomical amount for a county of roughly 2OK residents. #wthr 2/


A county councilor told me they’ve been saving up for unexpected expenses like these, but still says the expenditure is “rough.” He says they cannot cut corners & want to ensure the trial is professional & both sides have adequate $. 3/

Delphi murders trial update: prosecutors argued in Allen Superior Court to keep police sketches of the Bridge Guy out of the trial of Richard Allen, the man accused of killing Abby Williams and Libby German in 2017. 1/


Prosecutors made a case that the sketches weren’t used to ID Richard Allen and wanted to head off assumed plans of them being introduced in defense’s opening statements Friday and imprinting on jurors. 2/



A retired FBI forensic artist who compiled one of the sketches testified that they weren’t meant for court to identify someone who has been charged. 3/


Allen’s attys ask (paraphrased): Is that because these sketches don’t look like Richard Allen? 4/


Judge Gull takes matter under advisement and said she would rule by Friday morning, when the trial begins in earnest in Carroll County. 5/


Also in play/argued this morning: can the defense keep a metallurgist on the witness list to challenge the reliability of matching tool markings on an unspent bullet found near the girls’ bodies? Judge will rule later. 6/


Plus, guards and inmates from prisons where Richard Allen had been held and watched/reported on his movements/talk may testify. Allen’s attys had argued that they weren’t experts who could address his mental health. 7/

DELPHI MURDER CASE LATEST:

This morning the jury of 8 women and 4 men were sworn in.They are currently on their way to a hotel in Lafayette before opening statements tomorrow. Reminder they will be sequestered for the length of the trial.

Judge Gull took under advisement the prosecution's motion to exclude the 2 “suspect” sketches. She also took under advisement the defense motion to bring in a witness to discredit bullet analysis.

She will allow prison guards and inmates to testify about Allen’s behavior and comments while in custody.

The defense withdrew their motion for the jury to visit the crime scene.

Delphi Council confirmed to us they voted to approve an additional $2.2 million this morning, bringing the total for the trial to $4.3 million.

Gull said she plans to ‘run a tight ship’, including holding court six days a week and won’t even stop for election day.

Jurors were told to vote before arriving in Carroll County and are now sequestered under the supervision of the sheriff’s office.

Gull told the media the jury will have no contact with the internet, radio or television that isn’t supervised. Jurors will be able to meet with family on weekend, under supervision. Jurors will be able to make calls, again under supervision.

Gull also told the media there are 72 seats in the courtroom. 30 of those seats are reserved for the family, 12 for the media and the rest for the public.

Gull handed out a copy of her decorum order for reporters, and she made it clear she expected it to be followed.

For example, Gull instructed the media not to film or photograph the jurors and not to try to follow them.

"If you've covered courts before, you know there's not a damn thing I can tell you," Gull said.
