Jurors react to videos​

Since court observers were unable to watch the videos, media pool notes relied on reactions from the jury, defense lawyers and prosecutor.

As the first video played, one juror was “aghast.” Jurors appeared “tense” but not appalled at the second video.

During the third video, one juror was seen biting her lower lip. Defense attorney Jennifer Auger shook her head and looked away from the screen.

During video four, Carroll County Prosecutor Nick McLeland stood by the jury box to watch. One of the jurors sighed while the video was ending. The jury took numerous notes during the fifth video, the pool report noted.

Carter’s testimony​

Between video sessions, ISP Superintendent Doug Carter took the stand. Carter has been notably outspoken about the Delphi murders case and often appeared at press conferences to give updates on the investigation and the search for “Bridge Guy.”

Carter told the court that “dozens” of agencies were involved in the investigation, including federal resources like the FBI, the Department of Homeland Security, U.S. Marshals Service and ATF.

He said the FBI was involved until 2021. This led to a sidebar involving Judge Gull and counsel. Carter later testified that he made the decision for the FBI to leave the case and turn over all materials in August 2021.

He was on the stand for less than 10 minutes.

Reaction from Libby German’s family​

The media pool notes indicated that Becky Patty, Libby German’s grandmother, was upset while talking to McLeland before Saturday’s proceedings began.

Pool notes speculated that Patty may have been angry that videos of Allen were withheld from the public while graphic crime scene and autopsy photos of Libby and her friend Abby Williams were displayed in court earlier in the proceedings.

At one point after Saturday’s break, Patty left the courtroom and appeared “very upset.” She was later seen whispering to her husband.

We got some new sketches today from inside the courtroom of the Delphi Murders Trial. This one shows the large screen pointed away from the public so only the jury can see videos of Richard Allen inside an Indiana prison.

Day 15 in the Delphi Murders trial. The defense is expected to call Brad Weber and play silent videos of Richard Allen in his cell at Westville prison. Weber drove the van the state says interrupted Allen’s assault of Abby and Libby, causing him to change course and murder them.

INDIANAPOLIS (WISH) — Saturday was Day 14 in the trial of Delphi Murders suspect Richard Allen at the Carroll County Courthouse in Delphi.

Allen, 52, is charged with murder and murder while committing or attempting to commit kidnapping in the deaths of 13-year-old Abigail “Abby” Williams and 14-year-old Liberty “Libby” German. The girls’ bodies were found near the Monon High Bridge near Delphi on Feb. 14, 2017, a day after they went missing.

Allen was first investigated in 2017 and again in October 2022. After a second police interview, he was taken into custody.

12:49 p.m.: Jury watches more video; state police superintendent testifies​

Court returned from its recess at 11:05 a.m. After the jury entered, the defense recessed Max Baker and briefly paused the videos. State prosecutor Nick McLeland later said he would hold on his cross-examination of Baker until all the videos are watched.

The defense then called Indiana State Police Superintendent Doug Carter to testify. Carter has been superintendent for almost 12 years, and said his role in Abby Williams and Libby German’s death investigation was a “support role.” He explained dozens of agencies were involved, including multiple nearby county agencies, ATF, FBI, and Homeland Security.

Carter said the FBI stopped their involvement in August 2021. Defense’s Andrew Baldwin showed Carter an email from the FBI, which Carter confirmed to the jury was his decision to release the FBI from the investigation. He also also requested the FBI return any evidence.

Carter was then released from his subpoena. News 8’s Kyla Russell noted that Carter was only on the stand for around 10 minutes.

After Carter was released, the courtroom TV was moved and positioned in front of the jury. No one in the public seating area could see the videos played. McLeland renewed his objection.

Court starts late due to an in-chamber meeting. Gull met with Prosecutor Nick McLeland and Brad Rozzi to discuss presenting videos to the jury.

The defense shared camcorder video of Richard Allen in prison and a master sheet for the videos.The video monitor was angled so only the jury can see it. Gull said there were "explicit scenes" in the videos that the jury was about to see.

The 11th witness for the defense is defense intern Max Baker. Baker confirmed the videos are from April, May and June 2023.

He said he made a new zip drive this morning for the jury with a total of 15 videos. The jury saw "movement" videos of Allen being moved through Westville Correctional Facility.

Libby German's family was visibly upset. Some people in the courtroom questioned why Richard Allen's privacy was respected but the victims' privacy wasn't.

The 12th witness for the defense is Indiana State Police Superintendent Doug Carter.

Dozens of agencies investigated the Delphi murders, and every contiguous police agency to Carroll County was involved. The FBI was no longer used in investigating in August 2021. It was Carter's decision to ask the FBI to return, and he asked the FBI to return all of their investigative materials.

This morning in Delphi Murders trial we heard from defense’s neuro and forensic psychologist Dr. Polly Westcot who says objective tests show Allen wasn’t faking his mental health struggles/psychosis and we saw 2 videos from the surveillance cam in Allen’s cell showing him …

he chose not to show other videos showing Allen’s behavior. Baker: “as far as I can tell you didn’t either”. This afternoon we’re expecting testimony from Allen’s wife Kathy, sister Jaime and daughter Brittany. Brittany is in courthouse but hasn’t been in courtroom yet.

Delphi Murders Trial Day 15 Lunch Update:

-We began this morning with Dr. Polly Westcott who is a specialist in forensic psychology
-She is paid by the defense and was asked by them in May 2023 to evaluate Richard Allen

-She did so by reviewing his medical records, as well as the video of him from prison and she went to Westville Correctional Facility to evaluate him
-Her in-person exam was in August 2023
-In her report, she found Allen had an “ extensive mental health history”


-Said he was closed off as a child and began anxiety meds in his 20s
-He has struggled with at times severe depression throughout his life
-She diagnosed him with dependent personality disorder which means he needs other people to feel like a whole person


-The doctor said Alan relies heavily on his wife and mother
-She described him as a “fragile egg” when he arrived at prison after his arrest
-Dr. Westcott said she ruled out the possibility that he was faking his symptoms through several widely-accepted objective tests


-She described a clear decline in his mental and physical health while in prison
-She also did a handwriting comparison of Mr. Allen which she says even further shows his mental health decline
-She said writing can show a persons thought process


-She says the confession statement is disorganized and lacks grammar and punctuation. Also said the thoughts are fragmented and all together are signs of psychosis

-Dr. Westcott found that Allen is passive, avoids conflict and has a strong fear of abandonment
-She also testify that he is not very resilient and much more likely to decompensate under a stressful situation
-She said stressors, on top of severe depression, can lead to psychosis


-She said Dr. Wala’s medical notes and all medical notes are done through the provider’s eyes
-She seem to indicate that Richard Allen‘s detailed confession wouldn’t have been relayed in a narrative fashion as Dr. Wala put it in her report


-She also said Allen has sensory deprivation because the lights are on all the time and he was not sleeping
-During cross examination, deputy prosecutor Stacy Diener insinuated the Dr. Wescott received information about the defense attorneys opinion
-She said she did not


-Diener also pointed out that the prison psychologist and psychiatrist had more real time interaction with Allen so they’d be better suited to make a call on his health

-Westcott said her job was to look at mental health and documenting symptoms when asked why she chose to summarize some confessions and not others
-The jury asked several questions about Allen faking and Westcott’s testing methods


-After that, the defense attorneys assistant Max Baker was back on the stand
-Videos from insideAllen‘s prison cell were shown
-Again, the screen was turned so nobody from the public could see the videos

-There was some later testimony that indicated they showed Alan eating his own poop and banging his head into the wall
-Some jurors had some noticeable reactions like looking away from the video, but most sat stonefaced and watched-There was a test cross examination by McLeland


-He said the defense was only trying to get sympathy from the jury
-He then asked Baker if they were trying to make Allen out to be the victim
-At point Rozzi objected and both attorneys begin speaking over one another-Judge Gull had to tell them to stop


-McLeland asked why they didn’t show more videos where Alan was just sitting around and being normal
-Baker responded: “as far as I can tell you didn’t want them to see them either”
-Baker is referencing the fact that the prosecution objected to all the videos being shown


-Court resumes at 1:30
-Unclear who our witnesses are going to be for the rest of the day
-Could possibly be RichardAllen‘s wife since she has not been in the courtroom all day

13 Things To Know From The #Delphi Murders Trial Today - Nov 4


1. Important day for the defense. Their star witness was a neuropsychologist who presented compelling evidence that Richard Allen was mentally ill at the time he confessed to killing Abby & Libby.


2. Dr. Polly Westcott told jurors that she met with Allen in prison to conduct a series of psychological exams on him. She also reviewed prison videos, phone calls Allen made in prison, medical records & staff notes to write a 127-page report with a detailed set of conclusions.

3. Among her conclusions: Richard Allen suffered from Major Depressive Disorder and Psychosis, had significant mental and physical decline, and was not faking or exaggering his mental health problems during the time period that he confessed to killing Abby & Libby.


4. Dr. Westcott’s testimony undercuts statements by the State & its witnesses that Allen was not mentally ill at the time of his confessions & was faking mental illness. It’s a boost for the defense after jurors heard damning phone call confessions last week in Allen’s own voice.


5. To support that testimony, jurors saw 2 videos that show Allen inside his prison cell. Only jurors could see those videos – those of us in the gallery could not. But we were told the videos showed Allen eating his own feces and banging his head against the wall of his cell.


6. Jurors were visibly upset as they watched the videos. Some of them winced and repeatedly looked away. The videos were an effort by the defense to try to convince jurors that Allen’s mental health was so deteriorated in prison that it drove him to make false confessions.


7. Prosecutor Nick McLeland got into a heated exchange with the defense team. He accused them of showing only the worst images of RA in prison to get sympathy from the jury & to turn Allen into the victim. The defense countered by saying the videos simply showed jurors the truth.


8. Allen’s sister & daughter testified next — asked by def atty Andrew Baldwin if they had ever been sexually assaulted by Richard Allen. They both said no.
That supports Dr. Westcott’s testimony that RA falsely confessed to things in prison he did not do due to mental illness.


8a. I want to acknowledge an error on my part this afternoon. As one of 2 pool reporters today, it was my job to report accurate notes to other media who could not attend. While Allen‘s daughter, Brittany, was testifying, she was asked a series of questions…

8b. Among them:
Do you love your father?
Would you lie for him?
While quickly writing her replies, I wrote a series of NOs . That was a mistake. She very clearly responded she DOES love her dad. We quickly identified the error & corrected it for the pool, but it was a huge error.

8c. When journalists make mistakes, it is important that we take responsibility for them. I sincerely regret the error and hope to be able to apologize to Brittany in person. All of the families involved in this case have been through so much.

9. Steve Mullin, former Delphi police chief and current investigator for the prosecutors office, was back on the stand again today. The defense tried to hammer away at his credibility by highlighting inconsistencies & incomplete info offered in his prior testimony.

10. Then, a much-anticipated second appearance by Brad Weber. He lives right next to the murder scene & last week he shouted at Andrew Baldwin while being questioned about his story & exact location on the day of the murders. Today Weber was somewhat calmer but still feisty.

11. Weber acknowledged he gave different stories to investigators during two separate interviews in Feb 2017. In one, he said he drove his white van right home from work on the day of the murders. In the other, he said he left work and went to service some ATM machines.
12. The difference is important because the State claims one of Allen’s confessions references the van driven by Weber. If Weber did not go straight home from work, the State’s timeline for RA seeing the van right before the murders doesn’t work out the way it was told to jurors.
