UPDATE: The court hearing has been delayed for about an hour from the original start time of 9 a.m. The judge and attorneys are currently discussing consecutive vs. concurrent sentencing for Kline, CBS4’s Russ Mcquaid tells us.

At 10:16 am, Kegan Kline has entered the courtroom. His sentencing hearing is underway in Miami Circuit Court in Peru. Judge says a matter came up that delayed hearing from scheduled 9 am start. But that matter was reviewed and settled.

Defense is asking for a continuance of sentencing so Kegan Kline can review evidence he claims he has not seen. Defense says Kline may want to withdraw guilty plea based on that evidence. Prosecution says this is just a stall tactic and Kline has been aware of the evidence.

BREAKING: Judge Timothy Spahr says he is granting continuance of sentencing based on defense position that Kegan Kline has not reviewed certain evidence. Defense has until May 26 to file any new motions, including withdrawal of guilty plea. New sentencing date July 27 9 am.

Will we see him slimmed down, shaved, styled, with glasses, suit and tie? Nicely painted by a court draftsman?

Maybe they can make him look respectable by the end of July. What do you think?

Does it have to be new evidence in this case? Could there be new evidence in another case and he is going to roll on someone else to get a plea deal? Does he now understand that he may have to serve consecutive sentences?

Can’t think of a reason why KAK would be allowed access to evidence from any another case, other than his own. And if LE already have that evidence, why would KAK need to roll on someone?

I will admit under no circumstance can I imagine him as a hero witness being granted a plea deal for incriminating testimony, if he was involved he ought to equally be held accountable. Besides his word means nothing, he’d be a terrible witness, huge risk that his involvement would result in a Not Guilty verdict all around, he alone would create too much doubt IMO.

Good question.

Miami Circuit Court Judge Timothy P. Spahr granted the delay after Kline's defense attorney Andrew A. Achey said his client needed time to review new evidence they received in last 24 hours.

Let's speculate.
I wonder if Achey knew about DC. By denying negotiations on a plea (if that's what they did), they forced him to either go to trial or plead guilty to all counts. When you consider how many plea deals are made, it seems like he wasn't treated fairly.

In this enormous universe that we live in I cannot imagine anything…not one single thing…that could have come up since he pled guilty, that someone might refer to as “new” evidence, that could suddenly make KAK not guilty.
Sentence him. If he has buyer’s remorse, he can go to appellant court.

Here's a wild one: what if the river search had promise of a plea if they found what he told them was there. And then his atty just found out that they did find something?

Do we think the judge is so gullible to believe it's not a delay tactic?

Or maybe the judge realizes it is a delay tactic but wants to give KAK one last chance before he sentences him to maximum allowable consecutive years.

Here's my last one (since I have the room to myself) and it's my favorite. What if the FBI or ISP found out that there really was another person who was using the EmilyAnn identity?

We'll probably find out KAK and his atty had a memory lapse and they really did see the evidence.
