12/18/19 Update: State’s motion to set jury trial on 1/6/20 & disposition hearing on 1/8/20. Newton County Prosecutor Jeff Drinski said Wednesday that plea negotiations with Kirts had broken down. Kirts was in line to get a 45-year sentence under terms offered. Drinski said he since pulled the deal & will go to trial in a case where he plans to ask for life without parole. Trial set to begin on 7/13.
1/6/20 Update: Disposition hearing on 1/8/20 is cancelled. Trial is scheduled to start on 7/13/20. 1/22/20: Discovery motion filed. No update as of 1/27 for future hearing date.

*Charged (1/20/19) with strangulation & domestic battery.

A deposition is the taking of an oral statement of a witness under oath, before trial. It has two purposes: To find out what the witness knows, and to preserve that witness' testimony. The intent is to allow the parties to learn all of the facts before the trial, so that no one is surprised at trial.

I didn't know exactly what went on regarding discovery. The murder happened 10 months ago so I assumed all the discovery was already finished. I was a bit surprised at the number of depositions.

According to a probable cause affidavit, among the evidence collected and submitted to the Indiana State Police Laboratory included fingernail scrapings from Bowen’s right and left hands.

The certificate of analysis from the state police lab, according to the affidavit, indicates Garth is a contributor to the DNA profile collected from those scrapings, as well as from a scarf and cardboard tube collected from around Bowen’s neck.

Kirts stated in the affidavit that Garth handed him the extension cord and a scarf, but he tied it around Bowen’s neck. Kirts added that Garth helped him tape Bowen’s body and that she tied a knot in the extension cord that she unplugged from a wall and a TV.

Trial was set to begin on 4/6/20-was vacated.
6/28/19 Update: Omnibus hearing on 11/22/19.
11/22/19 Update: Four of five people who have been tied to the March 29 strangulation & torture death – including the murder suspect, Kirts, – have been offered plea deals, the Newton County prosecutor and attorneys for the accused said Friday morning in Newton Superior Court. Judge Daniel Molter set a Dec. 18 court date for Beckley, Mathis & Garth. Those three were charged with assisting a criminal, a level 5 felony that carry possible prison sentences of one to six years.
12/18/19 Update: Mathis is in negotiations for a plea deal. Drinski said Monday that those deals likely would be similar to one accepted by Parker in the fall. Trial on 4/6/20 has been vacated. Next final pretrial hearing on 2/12/20.

Where do you "see" any plea agreement on what Tippy Lynn posted? Did I miss something - or did you find some article re his hearing? TIA! :)

I know that Kirts is in a possible plea deal agreement for Nicole's murder - 45 year sentence.
