Defense calls for mistrial in Oberhansley case

"EFFERSONVILLE — The legal team for Joseph Oberhansley is calling for a mistrial in his murder case.

Defense attorney Bart Betteau made the motion Thursday morning after a witness, Donna Victoria, made remarks regarding past drug use and the criminal history of Oberhansley, who is accused of killing and mutilating the body of Tammy Jo Blanton in 2014.

After the request was made, Clark County Circuit Court No. 4 Judge Vicki Carmichael dismissed jurors for lunch as she took the decision into consideration.

Betteau argued that prior hearings prohibited such factors from entering the record. The jury, Betteau said, will now be "thinking about drug use" and attributing those factors to the crime. The bigger issue to him, however, was the mentioning of past crimes.

"She also brought up prison reform, so now they know he has a criminal background," Betteau said in court. "There’s no way that we can counteract those things. If a jury hears about a previous crime, you can’t get it out of your mind."

Clark County Prosecutor Jeremy Mull countered by stating that the issue of drug use is "not as serious" as Betteau was making it out to be, arguing that Oberhansley himself had admitted to using drugs. Betteau said that Oberhansley had only admitted to using a "little marijuana" and "may have used meth."

Arguing against a mistrial, Mull told Carmichael that previous case law states that a "prompt admonishment" to the jury to remedy the error of improper evidence would be sufficient.

"A mistrial is the extreme remedy when no other remedy can cure the error," Mull said.

Trial proceedings will resume at 1 p.m."

"The judge presiding over an Indiana trial involving a man accused of raping, murdering and eating parts of his ex-girlfriend's body decided Thursday to grant the defense's motion for a mistrial.

The request for a mistrial came after a state's witness mentioned the prior criminal past and drug use of the defendant, 38-year-old Joseph Oberhansley. Clark County Prosecutor Jeremy Mull told Judge Vicki Carmichael that he met with each witness prior to them taking the stand and instructed them not to mention either.

The witness, Donna Victoria, who was a close friend of victim Tammy Jo Blanton, said on the stand that her friend didn't call the police after an incident between the couple at the time because she "didn't want him to go back to prison." Blanton felt he'd been "reformed," Victoria said.

Victoria also mentioned a prior conversation between her and Blanton about drugs motivating his behavior.

Bart Betteau, Oberhansley's defense attorney, said there's now a "skunk" in the jury box that will taint the way they see him.

"The jury now knows he had a significant criminal record. He went to prison," Betteau said. "This would be a legal fiction to think that admonishing (the comments) would make them forget about that."

The rules of evidence generally don't allow the mention of prior criminal history unless a special exception is made...."

During testimony today, Donna Victoria said Blanton called her the Monday before her death and had come to her home to stay for a few days. Victoria testified that Blanton told her Oberhansley had held Blanton hostage all weekend and had raped her.

According to Victoria, Blanton said she did not call police because she didn’t want Oberhansley to go back to prison. She also said Blanton had mentioned previous drug use by Oberhansley.

The statement about Oberhansley's criminal past and drug use led to an immediate halt to the proceedings because jurors were not suppose to hear evidence of that nature.

The 16 member jury from Hamilton County was removed from the courtroom as attorneys argued Judge Vicki Carmichael about what needs to happen now. Prosecutors are asking for court to admonish the jury while defense attorneys sought a mistrial.

Judge Carmichael has set a new trial date for Tuesday, Sept. 3. It is not immediately known from which county the new jury will be selected.

"EFFERSONVILLE, Ind. (WAVE) - On the first day of jury selection in the Joseph Oberhansley murder trial, Clark County Prosecutor Jeremy Mull said, "It's unusual, but it's an unusual sort of case."

Those words would prove true again days later when the first trial for Oberhansley, accused in the death of Tammy Jo Blanton, ended in a mistrial.

But that’s not the end for Oberhansley. He will once again be tried by a jury, selected out of Hamilton County in this Clark County case, but the court proceedings will have to begin anew in Hamilton County, all because of a quick few words uttered by the state’s third witness, Donna Victoria....

But that’s not the end of Oberhansley’s case.

Carmichael ruled that jury selection and the trial would begin again and soon, likely within a few days or a few weeks. Jury selection will have to take place in Hamilton County again to be sequestered in Clark County.

A date of Sept. 3 for that new trial to begin was mentioned by Judge Carmichael, but it’s likely that will change once a schedule has been worked out with the Hamilton County Courthouse. But once it’s scheduled, and a new jury is seated, many in this case are ready to begin again, and this time, hopefully reach a verdict."

Jury selection will begin Wednesday in Hamilton County for the Indiana man accused of killing and eating parts of his ex-girlfriend.

A judge previously declared a mistrial for Joseph Oberhansley, who was charged with the murder of Tammy Blanton.

Prosecutor Jeremy Mull said he's taking extra care this time to make sure this next jury is not tainted.

"Hopefully, we'll have that done by Friday. But if we don't, we're not going to rush it," Mull said. "We're going to take time and make sure it gets done properly, gets done correctly, so that when this case is done, it stays done."

Mull expects to go through several hundred potential jurors.

Opening statements could begin Friday afternoon at the earliest, but that might not happen until Monday.

The judge then asked all of the jurors (except the 16 in the box) to leave. Now those 16, they’re moving them to a separate small room. And they will be questioning the jurors one at a time, alone in the courtroom with just the judge, defense, and prosecution.
