TRIAL DAY 4: As Joseph Oberhansley walked in, I asked if he believed this jury would be fair and impartial. He “answered” by repeating the same thing as yesterday. @WDRBNews

Phone reception is poor in the courtroom, so I want to note that this was over an hour ago. Proceedings have started, and the jury is entering the courtroom.

Getting the day started, before the jurors are brought in, the defense and prosecution bring up a couple motions. The first from the defense (about hearsay), the judge is taking a moment to look it over before deciding.

The 2nd (from the prosecution) is about whether or not witnesses bringing up Oberhansley’s mental state “opens the door” for the defense to then bring in expert testimony on mental health (which they agreed not to). Prosecution says it does not open the door.

#OberhansleyTrial: Attorneys argue whether state’s evidence of victim, Tammy Jo Blanton, saying Joseph Oberhansley is “crazy” or “schizophrenic” would open the door for defense to bring in mental health experts. Judge is reviewing. @WHAS11

Defense argued they can absolutely cross examine any witness based on what they bring up regarding “crazy” or any state of mind/illness. Judge agreed they can cross examine, but also agreed it was already decided any reports or mental health experts/elements are not allowed.

The judge came back and ruled on the first motion: Hearsay is admissible for state of mind but not motive. The defense then entered a continuous objection to the first three witnesses, which was accepted so it wouldn’t allow testimony down.

#OberhansleyTrial: Judge tells Joseph Oberhansley “no outbursts and no talking out of hand.” Oberhansley responds and says he understands. Yesterday he interrupted the prosecutor a few times during opening statements. Jury is now being brought in. @WHAS11
