IN - Tammy Blanton, 46, murdered, mutilated, Jeffersonville, 11 Sept 2014 *Mistrial*

1/7/20 Update: Still ruled incompetent to stand trial. Motion to continue trial-granted. Pretrial conference hearing on 10/1/19 has been re-scheduled on 2/27/20. He was transported to a state hospital for competency restoration.
2/27/20 Update: Defense files motion for pretrial hearing continuance-granted. Rescheduled for 6/15. Oberhansley was scheduled to be transported to Logansport State Hospital for competency restoration, where he had already spent several months in late 2017 through mid 2018. But the hospital had a two-month waiting list and when it was time for Oberhansley to be transported there in March, the state was already putting quarantine measures in place to mitigate the spread of COVID-19 and the hospital had put a hold on accepting new patients for a time. Oberhansley is being held in an Indiana Department of Correction facility.
5/12/20 Update: A transport order was issued Tuesday directing the Clark County Sheriff’s Office to transport Oberhansley to Logansport State Mental Hospital by 10 a.m. May 18. Next pretrial hearing on 6/25/20 & trial is set to begin on 9/8/20.

Attorneys prepare for Oberhansley's murder trial

June 25, 2020

JEFFERSONVILLE — Attorneys on both sides of a 2014 Clark County murder case met Thursday via Zoom to discuss details of the trial ahead.

Joseph Oberhansley is charged with murder, rape and burglary in connection with the September 2014 death of his ex-girlfriend, 46-year-old Tammy Jo Blanton, at her home. He is now undergoing competency restoration at Logansport State Hospital, where he has been since May.
[.....]
During Thursday’s hearing, in which Oberhansley did not participate, the judge told attorneys that the defendant was reported to be compliant in his stay at Logansport and has been taking his medication and going to meetings. A formal written report is expected when he has been there 90 days, which will be the first week in August.
[.....]
Now the state and defense may need to select a new county or rethink trial dates. Carmichael said during the hearing that the county has another high-profile case of its own there within a week of Oberhansley’s and doesn’t want to deplete the jury pool.

Attorneys will discuss whether a new date or county is the best route and report back to the judge next week. Carmichael said that no matter where the jury is from, they will need to be sequestered once selection begins to prevent them from learning about the case through media.

Jury selection is scheduled to start Sept. 8 in the now six-year-old case, with the jury pool coming from Allen County. Oberhansley was charged in September 2014 with murder, rape and burglary in connection with the death of 46-year-old Tammy Jo Blanton, who was found dead Sept, 11, 2014 at her Locust Street home with sharp force trauma injuries to her face, neck and chest.

Oberhansley was previously found incompetent for trial in January after evaluations by two psychologists and taken to Logansport State Hospital in May. The move to Logansport State Hospital was delayed due to restrictions from COVID-19.

Defense attorneys and prosecutors met Tuesday for a Zoom hearing with Clark County Circuit Court No. 4 Judge Vicki Carmichael after a call the court received Friday notifying that the defendant has had competency restored during the Logansport stay.

Court staff said 640 jurors will be called; it is estimated the trial will last about three weeks.
