Yes it is. I understand that and it applies here.
What matters to me is that if this ridiculous court calls her guilty again and tries to extradite her, that the US says no. And I think they will.
The treaty has a clause that they do not have to send anyone back when double jeopardy applies as it does here.
So I don't care for the Italian system. I am completely thrilled that my Great Grandmother and Grandfather moved here and no one I love is subject to this system.

I do not think the US will say no, especially with recent events such as Edward Snowden. Also terrorism - they cannot risk Italy harboring some terrorist and not extraditing them to US.

Eric Snowden? He is a completely different issue. He is a traitor. He hurt the whole country.
That is not what this is. I don't think she goes back.. I could be wrong but I think if they find them guilty on Friday she will stay.

Of course it does. They were acquitted on the same evidence that convicted them. That means they never should have been convicted at all.

You know what I hate about crimes like this? Finding unbiased information. It is harder than you think. So when you go looking you have to swipe and move on a lot to get to the truth. For me the facts I have seen I believe she is not guilty of this crime. I can not one smoking gun that puts her in that for me.

You are right about the unbiased information at this point. When I first started following this case, it was on "perugia shock", the first thing I came across that made me go "woah something is off here" was the alibi email.

From there it was down hill for me. She lies and can't keep her stories straight. It's funny that to this day I seem to know the timeline better than she does, she couldn't even get it right for her book.
Anyways I fully respect your opinion just thought I'd share where mine started.

What hatred for Amanda Knox? There are many who agree she is guilty but it's not a hatred for her that drives that opinion. She did not kill Meredith in your opinion but lots of people disagree with you on that opinion. That is my point on why this is not the case for the U.S. to be setting a extradition precedent with, it's not worth it. This case is debated over and over with supporters from both sides of the table.

And to add to that if I may, it's been so many years now that it is absolutely certain that it's not feelings that's driving this case. Everyone has had to move on with their lives, including Meredith's family. What this is about is justice.

I hope the US would fight for all our citizens who are unjustly convicted.

How do you know this? Were you there when Meredith was killed?

If it is 2 or 3, I am going to say the whole Italian justice system is corrupt (and repeat myself over and over ;)).

I understand what this decision was about. I am responding to posters who say they weren't acquitted. They were. Combine this with the obvious corruption involved, and it doesnt matter what the decision is tomorrow. AK is not going back to prison. RS on the other hand will have to sit in prison with all of the other wrongfully convicted italians. JMO

There was an acquittal, but it was annulled. That's the same as there being no acquittal.

The entire double jeopardy suggestion is based on US law, which states that the prosecutor cannot appeal a verdict. The belief, in the US, is that if a prosecutor can appeal a verdict, and the appeal is successful, then there is double jeopardy.

Let's look way up, across the border to that beautiful country in the North: Canada. In that country, there is double jeopardy, but the prosecutor can appeal a verdict. If the verdict is overturned, then the earlier trial judgement is annulled. Hard to believe, but this is exactly what happened in Italy.

Rather than suggest that US law should be imposed on the courts in Italy, let's impose Canadian law on the courts in Italy ... or rather, let's respect Canadian law and Italian law and accept the fact that Knox and Sollecito's acquittal was annulled by law.

The double jeopardy suggestion seems to hinge on the belief that US law applies to US citizens when they are convicted of a criminal offence in a foreign country. Is there any basis for that belief, or is merely a wish? Per US law, should Knox have had her appeals denied and been put to death shortly after she was convicted of murder?

It's not even a double jeopardy based on US law. In the US if a court of appeal reverses a conviction..the prosecution cannot appeal their decision..HOWEVER..the prosecution has the option to charge that defendant again with the same offense which would result in a new trial. On the other hand..in Italy the prosecution can subject the defendant to an APPELLATE trial.. if found guilty which what happened in Knox's case..the defense would appeal the conviction. Then the highest court in Italy, the Court of Cassation would have the final ruling. If that court reverses the conviction..only then double jeopardy would apply.

He was in several Italian radio and TV shows to make it clear that he can't remember. I am not sure what he is trying to accomplish with it. It all seems a bit too late to me. It goes like this:

"I can't say if she went out.
I can't be sure if she went out that evening.
I don't have any facts to back it up.
*But she might have gone out.
Sure.
*Introduced Rudy into Meredith's place.
Anything could have happened, what I said.
I told the judge at the preliminary investigation.
They asked me about Amanda particularly about this.
And I said I don't know if she went out that night."

Wow oh wow. Yes I agree, too late. This will only serve to reinforce their guilt. He should have gone with this strategy from the very very beginning, he might have had an actual chance that way.

Point is that they don't want another country to have an excuse to harbor and protect another Edward Snowden. If US doesn't keep it's end of extradition treaties. The other country won't either.
