Italy’s Highest Appeals Court to Decide Amanda Knox’s Fate

Lawyers for Amanda Knox's ex-boyfriend made a final appeal to Italy's top criminal court Friday, urging it to overturn the pair's murder conviction for the 2007 slaying of Knox's roommate, saying there were errors of "colossal proportions" in the guilty verdicts.

Judges at the high Court of Cassation began deliberating shortly after noon, and a decision could come late Friday. A decision to confirm the convictions could result in an extradition request from Italy for Knox, who is currently free in the United States. Knox has vowed never to willingly return to Italy.

Seems there's some rumors that Raffaele could get another look at his case. I sure hope not, I hope his trying to separate himself from Amanda is seen as proof of both their guilt.
His lawyer comparing him to Forest Gump is laughable, there is no comparison there. Besides when he spoke to the Nencini court, he somewhat denied being that way.

NBC's Chapman Bell reports the ruling is expected to come down between 9 a.m. and 11 a.m. Seattle time. A one-hour warning will be given before the verdict is read.

My prediction: the convictions are upheld by the the Italian system. But will be thrown out by international courts. AK will never step foot inside an Italian prison. RS will be freed once international courts bring justice once and for all to this tragic case.

Before I do that, what international court has the authority to reverse the ruling made by the Court of Cassation? Legitimate question because to my knowledge, neither the ECHR or the ICJ have that ability.

its the state departments call on whether to extradite. one tv commentator says when two nations agree on an extradition treaty they accept and honor the laws of the other and agree to extradite based on the others laws, not theirs. which kinda makes sense.

another commentator said AK's lawyers could argue to the state dept. that this was a case of double jeopardy and she shouldn't be extradited because of that.

take your pick. I don't think she ever sets foot in Italy again. The state department can do anything it wants to do.

It's really a guess by anyone because as far as I know the State department hasn't made a statement to lead anyone to believe either way. In fact iirc there were representatives from the embassy who closely followed this trial.

Thanks to all of you for the articles and links. I was listening to CNN in my car. One legal expert said something about if AK conviction is upheld, she would have to appeal to the State Department, not the Justice Department and argue double jeopardy would apply.

I am confused. She was convicted, then was the conviction set aside? Or was she acquitted because of new evidence? Or was she freed because the conviction was appealed? Thank you for the clarification.

I am really hoping that politics and egos are set aside when rendering a decision. I can't help but think that if the conviction is upheld, Meredith was a British citizen and the U.S. and Britain are close allies, and Italy doesn't want to look like bumbling fools, AK will be extradited.

BBM: I just hope that if and when the extradition papers are issued, the U.S. honors Italy's request because if the U.S. tries to fight it -- especially if they fight it in the media -- the U.S. is going to look like a bunch of "bumbling fools" ...

As I , as total lay person, have always understood the process in Italy to be:
there are 4 steps to the legal process of a case:
Step 1: Appellate court gets the case, where it is tried and judged. In this case the judgement was: guilty.
Step 2: The defense gets to do a formal appeal of the initial verdict.
Step 3: The Prosecution gets to then one more time appeal the defense's appeal.
Step 4: the Cassation court finally decides whether the Appellate Court's original decision ultimately stands.
