It would strengthen his alibi about when he left Birchleaf, CY certainly would not be able to verify this.

But, GrammyJean, his purchase at Hugo's gas station would show the time he left home,and his phone records

The astronaut drove 900 miles . It wasn't mission impossible. But she was an astronaut so she had that going for her. :floorlaugh: Okay bad joke. A little levity goes a long way.

The state was making a joke, right?

Apparently that is the type of evidence the prosecution decided to present in court.

Jason's priority was to comfort his daughter. It was late, he'd had a long day, his wife had been murdered, and anything the police needed could wait until the following day. Investigators knew this, but their priority was to confiscate the vehicles and contents, and pin Jason to a story. Investigators desperately wanted Jason's story so that they could focus on undermining that story. Their priority was not the child, and not the grieving husband. Jason was their suspect and they had no respect for anyone or anything. They wanted to force Jason to do what they wanted, and if he didn't do what they wanted, they intended to go to the media and make their complaints heard loud and clear.

BBM. Love this. Sounds like a lullaby from a fairy tale. Then the mean, old ogres stepped in. The difference is, IMO, there is NO evidence the child was not their priority. How can you say that? The truth lies in, IMO, that she was not the priority to the "grieving" father.

It's completely irrelevant. Jason and Michelle could have discussed giving a baby up for adoption, aborting, letting Michelle raise the child alone, and all sorts of other possibilities ... but none of that happened. What happened is that they decided to not only have the child, but they also decided to get married.

IMO, it is not irrelevant.

he cut the grass on the anticipation of AF coming to visit. AFTER this is when he found out he wasn't coming. IMO, this is when he put his plan in to action.

My point is how do we know this is WHY he cut the grass. His words and his words only?

IMO, it is not irrelevant.

Some people might think that discussions about an unplanned pregnancy are more important than actions that follow that discussion, but I'm of the opinion that the actions speak much louder than words. They did get married, they did plan a family.

The fact remains. He is still in prison serving a life sentence. The courts are still undecided. It is still under appeal. He ain't going anywhere right now.

If Michelle had not been pregnant, IMO JY would NEVER had married her.

Okay. Let's say he was semi-committed.

I have asked every attorney I know and every one of them said for him to listen to what his attorney said.

Not a bit surprised. That's what they do.

I finished reading, the only other few points I will reference is something we talked about, no time of death.
That it was never established, and that the ME was not even asked if MY died on Nov 2 or Nov 3,
That a treadmill was on and a bottle of water found
And, that the garage door and kitchen door were left unlocked.
The assistant appellate defender was Barbara. S, Blackman and asked the court to vacate his conviction or
reverse and remand for a new trial.
Jason Young won his appeal.

And every single person on the stand, including the Fisher's, testified to how much he cared about his daughter. Please review the trial.

He didn't? Have you seen those tiny prints in the bathroom?

That's not really accurate. The Court of Appeals decision was unanimous --- all three judges concurred that a new trial must be ordered. Because it was unanimous, the State's only recourse is to petition the Supreme Court for discretionary review and it is not automatic that they will even look at it. In fact, in over 90% of cases where there is a unanimous decision with the CoA, the SC declines to review it. He is technically in limbo right now and it's not accurate to say that he's still serving a life sentence. The conviction is gone. He will be eligible to be released on bond if the SC declines. That is the most likely scenario here.

After learning that Michelle was pregnant, Jason and Michelle made a decision to get married and have a family. I have no doubt that they discussed all the options prior to coming to that decision.

Then why did he fool around? Why did he describe his sex life or lack of it to total strangers? Even to his own mother? Eeeew. Or work acquaintances who squirmed hearing the details? IMO, he had NO respect for his wife. None whatsoever. He cared only for himself.

Wow, people need to read more!! On Page 20, MY tells her therapist that her pregnancy was planned.

Page 29, Lorrin Freeman enters the case and testifies about the WDS and custody case being filed on behalf of LF.
Now, I am lost. So, it is her testimony about the admissability of those 2 actions in Trial 2 that won Jason his appeal, and she might be the new DA?

Yes, it was her testimony but she really had no choice but to testify. It doesn't mean that she would agree to do something like this as DA.

Hi JF I have been reading a lot of posts as I was not keeping up for a day or so. I did see the post where I learned you are female and like the other poster I thought you were a male. I think this is because your posts and replies are always so logical and you do not get into a lot of emotional responses.
I was also surprised to find at one point in time you were on the JY is guilty side of the fence. I though you did a great job of summarizing the flaws in the testimony that convinced you of reasonable doubt. I would really like to hear your theory of this crime. IS your switching your opinion based on the fact that you did not believe the state proved their case or do you have a theory?

Why does it matter that Shelly knows his plans?

He wanted to be seen. Acting normally. Doing his manly chores. Telling her his plans. The irony is as soon as he left MY told her they had been fighting. Fighting about her mother coming from Thanksgiving to Christmas. He didn't like that despite the fact that CY was a toddler and MY was 5 months pregnant and still earning her keep. MOO.
