Because jurors want to hear the accused state that he is innocent.

Just look at some of the posters here that have repeated said that he never proclaimed his innocence to anyone. If you don't say it, then the jury wonders "why didn't he deny it?". It also gives the jurors a chance to evaluate whether or not the accused is being honest.

I just think they need to get that question out there and answered first before they can begin any line of questioning. I personally think JY did great on the stand, he was completely different than I thought he would be.
Maybe he will take the stand again in Trial 3.....

Also, how can it be explained that CY . at some point afterwards, put shoes on and one of those shoes tested positive for blood..how did that happen?

I guess I could wear them more than one day in a row, but I don't. I rotate them--even my workout shoes. I have three of the same pair and switch them out. I even write the date on the bottom so I know when it is close to buy new pairs (of workout shoes).

No, its not.... My FIL numbers his jeans.. He has a pair for every day of the wk.. He numbers them and only wears them once a wk..Same with his other clothes....
I have flip flops that I wear only once a wk....

I counted at least 9 bloody footprints going towards the hall bathroom. There is definately more than a "couple". Two of those bloody footprints are on the carpet at the bathroom threshold, where the carpet meets the tile. If she was carried, it was not all the way to the bathroom but instead carried to a little past where the stairs meet the hallway.

Thats a lot of blood to be on the bathroom floor after walking across carpet.....

Yes, there were two pairs of slip on men's shoes in the Explorer - a pair in the back (Kenneth Cole I believe) and a pair on the front floorboard passenger side. The pair in the front was not collected. Keep in mind that there were other passengers enroute to Raleigh so it's unclear who the shoes may have belonged to.

LE filled out a search warrant in '08 to try to locate the shoes purchased in 2005, to include the Hushpuppies and some athletic shoes from a DSW receipt. They didn't find the Hushpuppies and this evolved into "Where are the shoes..." There is no evidence that the shoes he was wearing that night were ever missing. He didn't currently own Hushpuppy shoes and was not wearing the pair purchased in '05 but that was the implication - because of the bloody footprint.

Exactly. They had no choice. Put it out there early on. It's the elephant in the room. How effective was it? Maybe it was in the first trial? 8/4 to acquit. Were I on the jury I would have given it short shrift. MOO.

I know!! Why does the bathroom show more blood there than anywhere else and why so many footprints? And,after she was cleaned, there was still enough blood on her right foot to make an impression inside the black dress shoe.
And, how did she get out without stepping on the prints that were already there, and if someone was cleaning her, they didn't make any prints in the bathroom at all.

Go listen to the testimony of the first office on the scene. He testified he checked all the doors and windows and everything he checked (including the back patio door) was locked. That does not include the broken garage door. I'm only commenting on the back patio door. Agent Galloway was not the first, second, third, or even fourth person on the scene at Birchleaf Drive. Gotta go with the first one who was there.

Listening to his testimony now. Ya know what jumped out for me in the very beginning? The aerial photo of the surrounding area. Why choose that house in the midst of that area? It makes no sense. This wasn't random, IMO. Also struck by the demeanor of the first responder. Hardly appears to be looking to frame JY. And he was the one that first noticed the hose leaking. He found that unusual and notable.

I didn't want to get sucked into watching testimony again but it is enlightening.

Nobody is suggesting that police framed JY. Yes, there are things I question about the thoroughness about the investigation and the decision of prosecutors to present some of the evidence and their choice to only call witnesses who fit their timeline.

Earp also found the fact that CY was clean to be notable and unusual.

BBM. Yes he did make note of that. On cross it was brought out that he wouldn't have been aware of neighbor's coming to their aid. He knew about the dog but not about CY. Wasn't their a neighbor with young children? Didn't MF go to their house?

What jumps out at me is that he turns off the video camera several times. Unbelievable that any LE officer (or anyone) would be ok with that. May as well throw out the video as evidence.

With regards to the demeanor of the first responder--I wonder what people thought about Duane Deaver's demeanor all of those years.

The first responder didn't take any video. His sole purpose was to check out the house to ensure the safety of the EMTs.

Sorry, I was not clear. Agent Galloway took the video--you mentioned him in your post. And the name/order of entrance of the person is meaningless. The point is that he turned off the camera. Unreal,.

Google the words Duane Deaver. You might want to pop some popcorn first.

I just read about Deaver. The SBI results have never been mentioned as inaccurate or questionable in the appeal. To me it doesn't have any bearing on MY's case.

While you are reviewing the Duane Deaver debacle, you might want to google Melissa Dawn Huggins-Jones. Take a look at an aerial shot of where she was murdered, the circumstances and who did it.

You missed my point. You commented about the first responders demeanor and I was showing you that people thought Deaver was a good guy too.

Galloway said the tv and the treadmill were on in the bonus room--the TM was not running, just turned on. Did anyone ever testify what channel the tv was on?

I wonder if MY was working out and heard a noise.
