It should not be perceived that there is negativity associated with a brain injury. The issue is her credibility due to the brain injury.

Yes and all of that could have been avoided by conducting a proper line-up.

In an earlier part of the thread while discussing Cassidy's interaction with the dolls, one poster opined that a child as young as Casssidy does not identify gender characteristics but only responds to mommy and daddy types or something of the sort, so she picked a doll that looked like her mother and one that had the general features of her father.

That may have been the case with Cassidy. I really do not know. But what I do know is that I have a granddaughter that has been living with me pretty much 24/7 since just before her second birthday. One day my wife and I were watching her play. We sort of doted on her, and still do. That little girl took a couple of pieces of paper and stuffed them into the blouse that she was wearing to produce the effect of breasts. She walked around the house with her chest poked like that for a couple of hours. it had my wife and I almost rolling on the floor laughing.

That, to me, does indicate that a two and a half year old child can identify gender characteristics.

Now, back to our regularly scheduled program.

Glenn

The daycare workers recollection really didn't amount to much, imo. There was a male doll that CY could have chosen, but she did not. And, it was not like CY said Daddy did it or identified the other doll as Daddy,
she did not.
Therefore I don't think the admittance of this testimony helped or damaged either side , and I am not concerned at all that it is allowed in again. IMO

Yes, JY was her camp counselor.......someone she trusted, looked up to as a CHILD/YOUNG TEEN.

JY was someone who took advantage of her while his wife was out of town, someone he disrespected, humiliated.

Huh? I am pretty sure when Carol Anne and Jason slept together, she was a grown woman.

How do you know the dog and Cassidy never sought each other in all those hours? None of us know that and what is the point anyway? If they did or didn't means nothing IMO.

Those hours need to be accounted for in some way, and if you read the search warrants, it was suggested CY was drugged or she was taken from the home in Michelle's Lexus.
They clearly had trouble with the amount of time the child and dog were left alone, and so do I.
So, maybe they weren't alone for 10-11 hours or maybe the murder took place closer to the morning.
LE only has one small window of time to work with and that is 3-4am..but, what if it didn't occur in that time period?

You are right and thank you! I believed every word she said and to downplay the assault is a slap in the face to Gen.

As far as Carol A.......she was just plain pititful on the stand JY took advantage of her palin and simple. Michelle not home, lots of alcohol, sex on sofa, Carol woke up with black markker all over her face......totally humiliating, degrading.

Both of these women are indicitive of the way JY treated women. His disrespect and degrading of Michelle was observed by MANY before they married, after they married, up until he murdered her.

Lets not forget the long letter proclaiming his love he wrote to Gen...........ummmm when was this???

I had forgotten about the magic marker. I agree that he had a pattern with women. And that wasn't the only incident with CG. He punched out her windshield when he was angry about something else. I only wish GC would have taken MY aside and clued her in early on in their relationship. Would it have made a difference? Maybe she didn't since MY ended up getting pregnant? The email that he wrote was on Sept 12 2006. It went to her old work email and I don't think she saw it until after MY had been murdered. This was in her testimony. Link posted above. MOO.

She had declared her love for him many years prior when he was with GC. GC found a letter she had written and he went ballistic. Again in GC's testimony.

She was. In fact, wasn't she a married woman that visited a married man while his wife was away?

Did they check CY's blood to see if she was drugged????

Nope, just another one of the PTs made up BS points. I highly doubt she was drugged because she would have peed the bed if she was drugged.

Hey wait, maybe she did pee the bed. They would never know since they didn't collect the bed sheets.

Yes. Remember he swallowed her wedding rings?

This "brain injured, compromised, forgetful woman was an employee in a convenience store. She worked the register, took money and counted change, turned on gas pumps, locked and unlocked doors/alarms, maintained and kept various paperwork, dealt with delivery people, and was able to deal with customers. It's obvious she can read and write.

I think its very sad a lot of you keep referring to this woman in the negative way you do. If she were the way you describe her, she wouldn't be able to do all she did/does. I think it very wrong to talk about her the way you do.

The juros who all voted guilty obviously put some credence in her testimony. I feel jurors in a third trial would too.

Yes, in King NC which only has a population of about 6, 500 residents and she only worked there for a few months. We have no idea what her work detail consisted of other than she was working the graveyard shift. I do know what she didn't do though. She didn't tell another co-worker about her encounter with Jason, she didn't tell her boss, she didn't write it up, she certainly didn't call the police on Jason for getting in her face, and she can't find or remember who she said was there when it happened. And, it is a fact, she changed her description of Jason many times during the course of the investigation.

Wasn't that teasing?

"Now the dangers of swallowing diamonds or jewelry. Pointed tips or sharp edges can damage the delicate organs inside the body. It is quite obvious that a larger object is more likely to cause damage. When it comes to crimes where the thief swallows these objects, the processing of recovering the valuables from the body of thief are generally performed under supervision of a medically qualified staff."

Not one of Jason's better moments whether he really swallowed them or not, but that doesn't make him a murderer in any sense of the word.

It seems that Jason liked to clown around, and that he sometimes took things too far.

I'm pretty sure she said he was just teasing in the second trial. A bunch of people were spreading rumors earlier in the case that she had to change her flight to wait for it to pass, but they were wrong.

:waitasec: :waitasec:

Someone upthread mentioned Gracie probably having an alarm @ 4 Bros. where she worked, cause we know the security cameras were not working, so I would hope that the store owners/ managers left her with some kind of device to notify someone if she was in danger, right?

And, I am seriously sure she wasn't armed. So, if Jason came in yelling at her, cursing at her, wouldn't that cause her to be alarmed , she was all alone with cash and cigarettes and beer, and use the alarm?

Also, if you look at those transactions again, they were so closely timed together, that there is no way she could have rung up those people in the store, unless........wait for it............the pumps were on!!

Gracie's story is so busted and I am not saying she deliberately lied......but, she is and was very sadly mistaken. JMO

Tell her boss? Write it up? "Boo hoo, a customer yelled at me?" That's not reality.

What rings so true about Gracie is she remembered him because he was abusive. And that's the way things are in customer service....people remember the customers who are vile to them. And though I didn't need her testimony to believe in JYs guilt, Gracie's story has absolute credibility to me, and it was icing on the cake. It exactly fits into the timeline.

Coincidence? Nah. Just another of the many pieces of circumstantial evidence in this case.

Yeah, like mooning grandma. He doesn't have an ounce of respect for women. You could see him seething when Becky Holt cross-examined him. He couldn't hide his contempt and disrespect. IMO.

But couldn't even describe him. Must not have left TOO much of an impression on her.

Didn't she say he was bald?? LOL!! Hes far from bald ..Oh wait!! Maybe he had a piece of a clown outfit so he made him look bald... Boy that murder bag with all his stuff must have been heavy... Murder weapon, scotch tape, bald thingy and extra shoes...

Oh btw I have a couple friends who are managers of stores & when customers YELL at you & all up in your face YOU are to make a report.... And thats a fact....
I don't believe her for one second....

No one ( no adult anyways) can be taken advantage of unless YOU let that person do it.. She was grown and married.... A married woman messing with a married man.. I have NO respect for her... Unless she claimed JY raped her & theres proof he did then she was to blame also....
