p.s.s: this all seems too raw .. I think I watched this trial ( first trial 8 acquittal, 4 guilty --> mistrial). Second trial - exposes his first testimony.. lets get this guy... BRING OUT the ringer.... BRING OUT BOZ!!!! BOZ ZELLINGER!!!!!!!! bwahahahahaha!!!

Thanks for looking up the times, Otto. It sure raises the obvious question of who turned OFF the lights. If the theory is that it was premeditated murder, why would JY leave the lights on in the first place? If he had help, why did he need to return home at all?

Something doesn't add up in the timeline without excluding the witness statement about the lights being on at 3:30-4AM. That statement came in right after the murder, so it was a fresh memory. The camera was tampered with between 6-7AM. Jason can't be responsible for both. At 7:30 he was on his way from the hotel to his meeting.

If he had an accomplice, then the gas station witness is mistaken.
 

Thanks for the link! Here, we can see the yard lights that are reported as being turned on at 3:30-4AM. Within days of the murder, "interior, exterior, and yard lights" were reported as being turned on in the middle of the night. At 3:30-4AM, Jason had to have been somewhere else in order for him to be on his way to the meeting at 7:30AM.

Why would Jason, who was allegedly sneaking home to murder his wife, turn on all the lights during the murder?

Just before 3:15, Det. Spivey says that according to the medical examiner, there were over 30 blows. I seem to recall that the injuries were to her head, and that there were 10. I don't have the autopsy handy, but perhaps someone that does can check whether there were 30 or 10 "blows".

I was always under the impression that Michelle was dressed and awake when she was murdered (zip up hoodie), but this photo of the crime scene illustrates all the blood in the bed - with a blank spot where she may have been laying. Did she get up and was trapped by Jason's closet door, or was she actually in bed when she was attacked? Did she get up and was then propelled onto the bed? I was never clear about whether she was working on the computer, or the computer was on the bed beside her. Did we ever learn the time stamps on the last activity on Michelle's computer?

Did Jason phone her close to midnight? Is it a 5 hour drive, or a 2.5 hour drive ... one way?

If Jason left the hotel at midnight, he had to arrive at home at about 2:30-45AM, commit murder, settle his child for 30 minutes, and drive back to the hotel in time ... another 2 3/4 hours ... arrive at the hotel at 6AM, wait for someone to come out of the side door, grab the door, enter, turn the video camera to the ceiling, sprint to the room on the fourth floor unseen by all other cameras, staff, and guests, collect the receipt from the unlocked room, and be on the way to the appointment at 7:30AM.

After the murder, and after the child was awake and wandering through the crime scene, did Jason tell the child to stay on his side of the bed until someone returned. Did he then give her a couple of fruit snacks, and jelly beans in the kitchen, in case she got hungry?

Did she step in her mother's blood because he was in the shower and didn't realize that she was awake?

It's possible that someone sneaked up on Michelle while she was sleeping in her zip up hoodie. Was it light blue? She was 20 weeks pregnant, which means she might have been sleeping more deeply. If someone creeped up the back stairs through the office to the bedroom, could that person completely "sneak up on her" while her daughter was asleep down the hall? Aren't mothers more alert to sounds when they are alone at night with sleeping children, even if they are pregnant? Did she hear something?

Who could sneak in so silently that she was attacked in her bed?
Only the jewellery drawers were tampered with.

That's right.! An SUV was seen parked outside of the garage when interior, exterior, and yard lights were turned on at 3:30-4AM. The garage door was broken and apparently the door between the garage and the house was unlocked (per Appeal Decision). The back door of the SUV was reportedly open for loading (witness statement).

What time was the vehicle reportedly parked near the yard lights, at the driveway? Was that at 4:30? Who saw a couple flying out of the driveway in a van and at what time?

I suppose it's three reports. Does that include the elderly woman with a sense of humor that lived down the street? Did she witness the parked vehicle (and was then confused by bickering from the prosecution)?

One report was that the lights were on and an SUV was loading something, another was that there was a van at the end of the driveway, and a third was that a man and woman erratically drove a van out of the property in the early morning hours. What is the timeline? How does one resolve an SUV loading at the garage at 3:30-4AM, a vehicle parked at the end of the driveway, and a couple swerving at good speed out of the property? It's almost like there are too many excuses, and they didn't get the story lined up ahead of time ... or some part of the witness statement information should be taken seriously.

Loading the SUV? ... Parked at the end of the driveway? ... Speeding van with couple? What is most likely?

If she was on the upper level of the house she would not have necessarily heard an intruder enter on the first floor. The Petit family killers had no trouble entering the home without being heard. And their killers had been watching the house and the attractive mother and daughters. It was the husband who awakened once they were inside the house and who was attacked and injured. The killers had a history of entering homes while families were inside and stealing valuables. Evidently, that was part of their "thrill." It is entirely possible a similar scenario happened to Michelle.
 
I was just reminded of the fact that Michael Peterson needs to be added to this list of possible new trials.
So, that makes another one for the state of North Carolina to deal with. At the present time, all these convictions have been overturned, which leads to the BIG question of what is next? Will there be a bail hearing scheduled and in what amount? I know in the Young case, he was previously out on bond but returned for his court dates. What a mess in North Carolina.
 
BBM. ITA. She apparently showed no fear and I find that pretty compelling in his favor.

Early on, there was an order to provide DNA, inspection of his body, etc and he did cooperate with that.

He HAD to cooperate.

I do remember this. The man supposedly had on a wedding ring and the woman was described with bushy hair. The state did much to discredit this witness, even bringing in someone from her workplace. This case was a ping pong match for me, when the state was up , I was like Yeah, they got him and then the defense would counter, and I would be like Yeah, maybe not.

Most likely the witnesses actually saw something that pointed away from the husband so law enforcement totally ignored it and the DA's office decided to pursue charges anyway. Pure laziness. Numerous witnesses in the Cooper case weren't interviewed by cops and the cops testified later it was because they didn't find them credible. It was the same prosecutor for both cases, same courthouse of Judges.

Something is terribly wrong when law enforcement totally ignores witnesses who come forward because it is their civic duty and then are blasted on the witness stand by the same cops who ignored them. And then Judges pound the final nail with decisions that are obviously prejudicial to the prosecution.
 
Another similarity we have between this case, and that of Brad Cooper, is that there was an earnest effort from some people in the community to see the husband arrested and prosecuted for the murder. It seems like the community makes a decision that "the husband did it", and investigators pursue relationships with those in the community rather than investigate the murder independent of community influences.

IIRC, JY wasn't the only person they investigated. A young gentleman who lived in a trailor park behind the Young's were also looked at and eventually cleared.
